LE Gouvernement britannique, le Gouvernement belge et le Gouvernement français, désirant régler toutes les questions concernant les lieux de sépulture en Belgique des militaires anglais et français décédés au cours de la guerre, les soussignés, dûment autorisés par leurs Gouvernements respectifs, ont adoptés les dispositions suivantes : ART. I". Les Autorités britanniques et les autorités françaises indiquent aux Autorités belges les terrains qu'elles désirent voir affecter à des lieux de sépulture permanents pour les militaires de leurs armées décédés au cours de la guerre et inhumés en Belgique. II. Les Autorités belges font procéder en la forme réglementaire aux enquêtes préalables à cette affectation. III. Le Gouvernement belge procède à l'acquisition des terrains que, après enquête, il a reconnu pouvoir être affectés à la destination prévue. Ces terrains comprennent l'emplacement nécessaire à la création des chemins d'accès, s'il y a lieu. Les acquisitions sont faites au nom et aux frais du Gouvernement belge, conformément aux lois belges. IV. Le Gouvernement belge fait la remise à chacun des Gouvernements britannique et français, pour la jouissance seulement, des terrains dont il a acquis la propriété en exécution des dispositions qui précèdent. Les Gouvernements britannique et français pourvoient aux dépenses d'aménagement et d'entretien de ces terrains ainsi que des chemins à créer éventuellement pour donner * Vol. CV, page 219. accès à la voie publique. Dans les cimetières mixtes ces dépenses sont réparties entre les Gouvernements intéressés en proportion du nombre. nombre des militaires de chaque nationalité. V. Il sera accordé, aux frais du Gouvernement belge, des concessions à perpétuité pour les tombes des militaires anglais ou français qui ont été inhumés dans les cimetières communaux lorsque le transfert des corps dans les lieux de sépulture spéciaux ne sera pas jugé opportun. VI. Les lieux de sépulture militaires établis en dehors des cimetières communaux sont soumis à l'autorité, police et surveillance générale du Gouvernement belge. VII. S'il y a lieu, dans l'avenir, de prononcer pour des raisons d'intérêt général la désaffectation de cimetières servant de lieux de sépulture pour les militaires des armées anglaises ou françaises, le Gouvernement belge procurera aux Gouvernements britannique et français, s'ils le désirent, d'autres terrains en vue de la même affectation, aux conditions du présent accord. Le transfert des corps sera à la charge du Gouvernement belge. Un accord spécial réglera dans chaque cas l'attribution des autres dépenses résultant du transfert. VIII. Le présent accord est applicable aux terrains dont les Autorités britanniques et françaises se sont déjà procuré la disposition en vue de l'établissement de cimetières militaires.
