The State Chancery and the " Freiburg Land. the CONVENTION between Germany and Turkey modifying their Treaty of Commerce of August 26, 1890.*—Signed at Constantinople, April 25, 1907. [Ratifications exchanged at Constantinople, June 24, 1907.] SA Majesté l'Empereur d'Allemagne, Roi de Prusse, au nom de l'Empire allemand, d'une part, et Sa Majesté l'Empereur des Ottomans, d'autre part, étant animés du désir de favoriser le développement des relations commerciales entre les deux pays, ont nommé pour leurs Plénipotentiaires savoir: Sa Majesté l'Empereur d'Allemagne, Roi de Prusse: le Baron Adolphe Marschall de Bieberstein, son Ambassadeur extraordinaire et Plénipotentiaire près Sa Majesté l'Empereur des Ottomans; et Sa Majesté l'Empereur des Ottomans: Ahmed Tevfik Pacha, son Ministre des Affaires Étrangères; Lesquels, après s'être donné réciproquement communication de leurs pleins pouvoirs, trouvés en bonne et due forme, sont tombés d'accord sur les articles suivants, concernant la modification du numéro 1 du procès-verbal de signature du Traité de Commerce et de Navigation, conclu entre l'Allemagne et la Turquie le 26 août, 1890: ART. I. Jusqu'à la mise en vigueur du tarif annexé audit * Vol. LXXXII, page 128. traité le Gouvernement Impérial ottoman aura le droit d'élever les droits d'entrée en Turquie de 8 à 11 pour cent ad valorem. Toutefois, cette augmentation des droits d'entrée ne pourra être appliquée aux importations allemandes en Turquie qu'à la condition de l'être également aux provenances des pays des autres Puissances. II. La présente convention formera partie intégrante du Traité de Commerce et de Navigation, conclu entre l'Allemagne et la Turquie le 26 août 1890. III. La présente Convention sera ratifiée, et les ratifications en seront échangées à Constantinople aussitôt que faire se pourra. En foi de quoi les Plénipotentiaires respectifs l'ont signée et y ont apposé le sceau de leurs armes. Fait à Constantinople, en double exemplaire, le 25 avril, 1907. (L.S.) MARSCHALL. (L.S.) TEVFIK. PROCÈS-VERBAL DE SIGNATURE. Ar moment de procéder à la signature de la convention additionnelle, conclue en date de ce jour entre l'Allemagne et la Turquie pour modifier le numéro 1 du procès-verbal de signature du Traité de Commerce et de Navigation du 26 août 1890 et vu la majoration des droits d'entrée en Turquie sur les provenances allemandes, le Plénipotentiaire soussigné, Ministre des Affaires Étrangères de l'Empire ottoman, déclare que la Sublime Porte prend les engagements suivants : : 1. La Sublime Porte mettra en pleine et entière exécution la nouvelle loi sur les analyses en douane, promulguée le 29 Rébiul-ewel 1323 (20 mai (2 Juin) 1905). II. La Sublime Porte améliorera, dans la mesure du possible, les institutions douanières, telles que: entrepôts, installations des quais de débarquement, etc., dans les ports principaux de la Turquie. III. Les droits de dépôt ("ardié ") ne seront payables en Turquie que pour la durée du séjour des marchandises au dépôt des douanes. Cette durée est comptée de la fin de la première semaine écoulée après l'entrée en dépôt des marchandises jusqu'au jour où leurs propriétaires en auront demandé le dédouanement et la sortie. IV. L'horaire pour la vérification des marchandises dans les bureaux de douane ottomans est fixé du 1er avril jusqu'à la fin d'août, de 2 heures et demie à 10 heures et demie; en septembre, de 3 heures à 11 heures; en octobre, de 3 heures et demie à 11 heures; du 1er novembre jusqu'à la fin de janvier, de 4 heures à 11 heures; en février, de 3 heures et demie à 11 heures; et en mars, de 3 heures à 10 heures et demie à la turque. V. En cas d'envois de marchandises du même genre, importées à la fois en petits emballages, contenant des articles d'alimentation et de consommation en récipients hermétiquement fermés et portant des marques de fabrique, l'examen en douane ne sera fait que sur des échantillons pris au hasard. Cette stipulation ne s'applique pas au cas où les circonstances spéciales font soupçonner l'intention de frauder les droits. COMMERCIAL AGREEMENT between Germany and the United States.-Signed at Washington, April 22, 1907; at Levico, May 2, 1907.* THE President of the United States of America, on the one hand, and His Majesty the German Emperor, King of Prussia, in the name of the German Empire, on the other, animated by a desire to adjust the commercial relations between the two countries until a comprehensive Commercial Treaty can be agreed upon, have decided to conclude a temporary Commercial Agreement, and have appointed as their Plenipotentiaries for that purpose, to wit: The President of the United States of America: the Honourable Elihu Root, Secretary of State of the United States; and His Majesty the German Emperor, King of Prussia: His Excellency Baron Speck von Sternburg, his Ambassador Extraordinary and Plenipotentiary to the United States of America ; Who, after an exchange of their respective full powers, found to be in due and proper form, have agreed upon the following Articles : ART. I. In conformity with the authority conferred on the President of the United States in section 3 of the Tariff Act of the United States approved the 24th July, 1897, it is agreed on the part of the United States that the following products of the soil and industry of Germany imported into the United States shall, from and after the date when this Agreement shall be put in * This Agreement was ratified by His Majesty the German Emperor, and the delivery of the ratification was made at Washington. ("Reichsgesetzblatt, No. 26 of 1907, page 309.) force, be subject to the reduced tariff rates provided by said section 3, as follows: Argols, or crude tartar, or wine lees, crude, 5 per cent. ad valorem. Brandies, or other spirits manufactured or distilled from grain or other materials, 1 dol. and 75 c. per proof gallon. Champagne and all other sparkling wines, in bottles containing not more than one quart and more than one pint, 6 dollars per dozen; containing not more than one pint each and more than one-half pint, 3 dollars per dozen; containing one-half pint each or less, 1 dol. and 50 c. per dozen; in bottles or other vessels containing more than one quart each, in addition to 6 dollars per dozen bottles on the quantities in excess of one quart, at the rate of 1 dol. and 90 c. per gallon. Still wines, and vermuth, in casks, 35 cents per gallon; in bottles or jugs, per case of one dozen bottles or jugs containing each not more than one quart and more than one pint, or twenty-four bottles or jugs containing each not more than one pint, 1 dol. and 25 c. per case, and any excess beyond these quantities found in such bottles or jugs shall be subject to a duty of 4 cents per pint or fractional part thereof, but no separate or additional duty shall be assessed upon the bottles or jugs. Paintings in oil or water colours, pastels, pen and ink drawings, and statuary, 15 per cent. ad valorem. II. It is further agreed on the part of the United States that the modifications of the Customs and Consular Regulations set forth in the annexed diplomatic note,* and made a part of the consideration of this Agreement, shall go into effect as soon as possible and not later than from the date when this Agreement shall be put in force. III. Reciprocally, the Imperial German Government concedes to the products of the soil and industry of the United States enumerated in the attached list† upon their importation into Germany the rates of duty indicated therein. IV. The provisions of Articles I and III shall apply not only to products imported directly from the country of one of the Contracting Parties into that of the other, but also to products which are imported into the respective countries through a third country, so long as such products have not been subject to any further processes of manufacture in that country. V. The present Agreement shall apply also to countries or territories which are now or may in the future constitute a part of the customs territory of either Contracting Party. VI. The present Agreement shall be ratified by His Majesty the German Emperor, King of Prussia, as soon as possible, and upon official notice thereof the President of the United States shall issue his proclamation giving full effect to the respective provisions of this Agreement. * See page 362. + Not printed. |
