CHAP. 44.

An Act to amend the Law relating to the Judicial
Committee of Her Majesty's Privy Council.

[6th July, 1895.]

E it enacted by the Queen's most Excellent Majesty, by and

Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:

1.-(1.) If any person being or having been chief justice Provision as to or a judge of the Supreme Court of the Dominion of Canada, or having been or of a Superior Court in any province of Canada, of any of Colonial Chief the Australasian colonies mentioned in the schedule to this Judges. Act, or of either of the South African colonies mentioned in the said schedule, or of any other Superior Court in Her Majesty's dominions named in that behalf by Her Majesty in Council, is a member of Her Majesty's Privy Council, he shall be a member of the Judicial Committee of the Privy Council.

(2.) The number of persons being members of the Judicial Committee by reason of this Act shall not exceed five at any one time.

(3.) The provisions of this Act shall be in addition to, and shall not affect, any other enactment for the appointment of or relating to members of the Judicial Committee.

2. This Act may be cited as the Judicial Committee Amend- Short title. ment Act, 1895.

An Act for removing Doubts as to the Validity of an
Act passed by the Parliament of the Dominion of
Canada respecting the Deputy-Speaker of the
Senate.

[5th September, 1895.]

WHEREAS the Parliament of Canada have passed an Act

intituled "An Act respecting the Speaker of the Senate," and providing for the appointment of a deputy during the illness or absence of the Speaker of the Senate, and containing a suspending clause to the effect that the Act should not come into force until Her Majesty's pleasure thereon has been signified by proclamation in the Canada Gazette:

And whereas doubts have arisen as to the power of the Parliament of Canada to pass that Act, and it is expedient to remove those doubts:

Be it therefore enacted by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:

1. The Act of the Parliament of Canada passed in the session Confirmation held in the fifty-seventh and fifty-eighth years of Her Majesty's Act with reign, entitled "An Act respecting the Speaker of the Senate," respect to shall be deemed to be valid, and to have been valid, as from Speaker of the date at which the royal assent was given thereto by the Governor General of the Dominion of Canada.

2. This Act may be cited as the Canadian Speaker (Appoint- Short title. ment of Deputy) Act, 1895, Session 2.
