Ajuste para a entrega de desertores de navios mercantes

DECRETO N. 9992 — de 8 de agosto DE 1883

Promulga o ajuste celebrado entre o Brasil e a Gran-Bretanha em 30 de Julho de 1888 para a entrega de desertores de navios mercantes

Tendo-se concluido e assignado nesta Côrte aos 30 dias do mez de Julho do corrente anno entre o Brazil e a Gran-Bretanha um ajuste para a entrega de desertores de navios mercantes, Hei por bem que esse ajuste seja observado e cumprido tão inteiramente como nelle se contém.

Rodrigo Augusto da Silva, do Conselho de Sua Magestade o Imperador, Ministro e Secretario de Estado dos negocios Estrangeiros, assim o tenha entendido e faça executar, expedindo os despachos necessarios. Palacio do Rio de Janeiro em 8 de Agosto de 1883, 67° da Independencia e do Imperio.

PRINCEZA IMPERIAL REGENTE.

O Governo do Imperio do Brazil, sendo Sua Alteza a Princeza Imperial Regente em nome de Sua Magestade o Imperador, e o Governo de Sua Magestade a Rainha do Reino Unido da GranBretanha e Irlanda, desejando a bem do commercio dos dous paizes, facilitar a descoberta, apprehensão e entrega de marinheiros que desertarem de navios mercantes de qualquer dos mesmos paises, sobre a base de exacta e completa reciprocidade, convieram no seguinte:

Fica mutuamente ajustado que si algum marinheiro ou aprendiz, não sendo escravo, desertar de navio pertencente a subdito de uma das partes contractantes, em qualquer porto dos territorios, possessões ou colonias da outra parte contractante, as autoridades desse porto e territorio, possessão ou colonia, deverão dar todo auxilio em seu poder para que esse desertor seja apprehendido e remettido para bordo, logo que isso lhes seja pedido pelo consul do paiz a que pertencer o navio do desertor, ou pelo seu delegado ou representante.

Está entendido que as precedentes estipulações não se referem a subditos do paiz em que se der a deserção.

The government of the Empire of Brazil, Her Highness the Princess Imperial acting as Regent in the name of His Magesty the Emperor, and the government of Her Magesty the Queen of the United Kingdom of Great Britain and Ireland, being desirous, for the benefit of the commerce of the two countries, to facilitate the discovery, apprehension and surrender of seamen who may desert from merchant vessels of either country, on the basis of a full and entire reciprocity, have agreed as follows:

It is mutually agreed that if any seamen or apprentices, not being slaves, should desert from any ship belonging to a subject of either of the Contracting Parties, within any port in the territories or in the possessions or colonies of the other Contracting Party, the authorities of such port and territory, possession or colony, shall be bound to give every assistance in their power for the apprehension and sending on board of such deserters, on application to that effect being made to them by the Consul of the Country to which the ship of the deserter may belong or by the deputy or representative of the Consul.

It is understood that the preceding stipulations shall not apply to subjects of the country where the desertion shall take place.

Nota da Legação Britannica ao Governo Imperial.

British Legation, Rio de Janeiro, June 16th 1888.

Monsieur le Ministre,- With reference to the correspondence which took place last year between Baron Cotegipe and Mr. Mac Donell on the subject of a proposed agreement between Great Britain and Brazil for the mutual surrender of merchant seamen desertors, I have the honour to forward herewith a copy of an Agreement signed on November 5. 1879 between Great Britain and Germany relative to the same question.

The terms of this Agreement comprehend all that it is possible for Great Britain to engage to do in that respect under existing law, and is similar in effect to all the arrangments concluded by Great Britain with Foreign States.

I have been instructed by Her Majesty's Gouvernment to submit the enclosed Agreement to the Imperial Government, and to state that Her Majesty's Government are willing to conclude a similar Agreement with the Imperial Government should the terms thereof be found acceptable, and should this be so, I am authorized to sign at once, while, if Your Excellency proposes any alterations, I shall have to. refer home for instructions.

As regards the question of the payment of expenses incurred in the recovery of deserters which was raised by Baron Cotegipe 's note of August 31st last, I have the honour, in accordance with the Marquess of Salisbury's instructions, to point out to Your Excellency that it does not seem necessary to insert a special provision on this head. The practice in Brazil appears to be to charge the ship to which the desertor belongs, either directly or indirectly, through Her Majesty's Consuls, and . Her Majesty's Government do not see any objection to this course being continued, as it is in accordance with the general usage abroad, and with the custom in various ports of the United Kingdom in similiar cases when desertors are recovered for Foreign Vessels.

While awaiting Your Excellency's reply to this communication, I avail myself of the opportunity to renew to Your Excellency the assurance of my highest consideration.

Legação Britannica, Rio de Janeiro, 16 junho de 1888.

Senhor Ministro,- Referindo-me á correspondencia havida o anno passado entre o Barão de Cotegipe e o Sr. Mac Donell a respeito de um ajuste proposto entre a Grã-Bretanha e o Brasil para a mutua entrega de marinheiros desertores de navios mercantes, tenho a honra de remetter inclusa còpia de um ajuste assignado em 5 de novembro de 1879 entre a Grã-Bretanha e a Allemanha e relativo ao mesmo assumpto.

Os termos desse ajuste comprehendem tudo quando a Grã-Bretanha se póde comprometter a fazer a tal respeito segundo a lei existente, e são com effeito sememelhantes a todos os ajustes concluidos pela Grã-Bretanha com os Estados estrangeiros.

Recebi ordem do Governo de Sua Magestade para submetter o incluso ajuste ao Governo Imperial e para assegurar-lhe que o de Sua Magestade está prompto a concluir um semelhante com o Governo Imperial si elle julgar aceitaveis os seus termos, e neste caso estou autorisado a assignar immediatameate; si porém Vossa Excellencia propuzer alterações, terei de pedir instrucções ao meu Governo.

Quanto á questão do pagamento de despezas feitas com a captura de desertores, aventada pela nota do Barão de Cotegipe de 31 de agosto ultimo, tenho a honra, de conformidade com as ordens do Marquez de Salisbury, de ponderar a Vossa Excellencia que não parece necessario inserir uma clausula especial sobre esse ponto. A pratica no Brasil parece consistir em cobrar do navio a que pertence o desertor, quer directa quer indirectamente, por meio dos Consules de Sua Magestade, e o Governo de Sua Magestade não vê objecção alguma a que essa pratica seja continuada, porquanto está de accordo com o uso seguido em toda parte e com o costume adoptado em varios portos do Reino Unido em casos semelhantes quando se capturam desertores para navios estrangeiros.

Aguardando a resposta de Vossa Excellencia a esta communicação, aproveito a opportunidade para renovar a Vossa Excellencia as seguranças da minha mais alta consideração.
