Inasmuch as the publication of the German Patent No. 110098 was proved to have occurred more than two hours before the application in bar was filed in this Office, although the difference of the local time in Vienna and Berlin is only a few moments, this copy of patent must be considered as anticipatory printed publication in the terms of Paragraph 3, Section 1 of the Patent Law.

PATENTS.-Communication Patents.

The Attorney-General, we are advised, has decided to accept applications filed as communications from abroad, after the manner prevailing in Great Britain and in many of the British Colonies. Until recently such applications have been refused.

Germany.

Unfair Competition.

We clip the following item from Advance Sheets of Consular Report. Regulating Unfair Competition in Germany.-The committee on trade and commerce of the German Bundesrath has for some time been at work framing a bill to make laws which will further tend to prevent unfair competition. The material and data which it has in hand were furnished by tradesmen and merchants from all parts of the Empire. It is expected that the draft of the bill will soon be made public. It is said that under the new laws the "Closing-out-sale business" will be prohibited.—Brainard H. Warner, jr., Consul, Leipzig, July 20, 1903.

Patents, Designs and Trade Marks.

The Fourteenth Annual Report of the Registrar, covering the operations of the year 1902, has just reached us.

An increase is shown of 23.8 per cent. over the previous year in the number of applications filed.

The New Zealand Patents Gazette is now published on lines somewhat similar to the English Illustrated Journal.

Following a recent decision of the Supreme Court the practice as regards the registration of "invented words" as trade marks has become more liberal.

PATENTS.-Application by Assignee.

An application may now be made in the name of an assignee, provided same

be accomplished by proof of assignment.
