ARTIGO XIII.

O presente Tratado entrará em vigor immediatamente depois da troca das ratificações e se tornará obrigatorio por um periodo de doze annos a partir do dia em que for posto em execução.

Cada uma das Altas Partes Contractantes, decoridos onze annos depois de entrar em vigor o presente Tratado, terá o direito, em um momento dado, de o denunciar à outra, expirando elle no fim do decimo segundo mez, a contar d'essa notificação. (107)

ARTIGO XIV.

O present Tratado será feito em duplicata nas linguas japoneza, portugueza e franceza e no caso de divergencia nos textos japonez e portuguez, se reccoreráao texto francez, o qual será obrigatorio para os dois Governos. (107)

ARTICLE XIII.

Le présent Traité entrera en vigueur immédiatement après l'échange des ratifications et restera obligatoire pendant une période de douze ans à partir du jour où il aura été mis à l'exécution.

Chacune des deux Hautes Parties Contractantes aura le droit, à un moment quelconque après que onze années se seront écoulées dequis l'entrée en vigueur du présent Traité, de notifier à l'autre Partie son intention d'y mettre fin, et à l'expiration du douzième mois qui suivra cette notification, ce Traité cessera et expirera entièrement. ARTICLE XIV.

Le présent Traité sera fait en double dans les langues japonaise, portugaise et française; et dans le cas où des différences existeraient entre les textes japonais et portugais, il en sera décidé d'après le texte français qui est obligatoire pour les deux Gouvernements.

Feito em seis exemplares em Pariz, aos cinco dias do undecimo mez do vigesimo anno de Meiji correspondente aos cinco dias do mez de Novembro do anno de mil oito centos e noventa e cinco.

Su Majestad el Emperador del Japón, y Su Excelencia el Presidente de la República de Chile, igualmente animados del desco de establecer sobre base firme y duradera relaciones de amistad y comercio entre sus respectivos Estados, súbditos y ciudadanos, han resuelto ajustar un Tratado de Amistad, Comercio y Navegación, y al efecto, han nombrado sus Plenipotenciarios, á saber:

Su Majestad el Emperador del Japón al Jushii Toru Hoshi, de la órden del Sol Naciente, de tercera clase, su Enviado Extraordinario y Ministro Plenipotenciario ante el Gobierno de los Estados Unidos de América y Su Excelencia el Presidente de la República de Chile al Señor Don Domingo Gana,

His Majesty the Emperor of Japan and His Excellency the President of the Republic of Chile, being equally animated by a desire to establish upon a firm and lasting foundation relations of friendship and commerce between their respective States and subjects and citizens, have resolved to conclude a Treaty of Amity, Commerce and Navigation, and have for that purpose named their respective Plenipotentiaries, that is to say:

His Majesty the Emperor of Japan, Jushii Toru Hoshi, of the Third Order of the Rising Sun, His Envoy Extraordinary and Minister Plenipotentiary near the Government of the United States of America; and His Excellency the President of the Republic of Chile,

Enviado Extraordinario y Ministro Plenipotenciario de la República de Chile ante el Gobierno de los Estados Unidos de América, quiénes, habiéndose comunicado, sus respectivos Plenos Poderes y halládolos en buena y debida debida forma, han convenido en los Artículos siguientes:

ARTÍCULO I.

Habrá sólida y perpetua paz y amistad entre el Imperio del Japón y la República de Chile, y sus respectivos súbditos y ciudadanos. (109)

ARTÍCULO II.

Su Majestad el Emperador del Japón puede acreditar, si así lo estimare oportuno, un Ajente Diplomático ante el Gobierno de la República de Chile, y, de igual manera, Su Excelencia el Presidente de la República de Chile puede acreditar, si así lo estimare conveniente, un Ajente Diplomático ante la Cortes de Tokio; y cada una del as Altas Partes Contratantes tendrá el derecho de nombrar, en interes del comercio, Cónsules Generales, Cónsules, Vice-Cónsules y Ajentes Consulares para que residan en todos los puertos y plazas de los territorios de la otra Parte Contratante en que sea permitida la residencia de iguales funcio

His Majesty the Emperor of Japan may, if he think proper, accredit a Diplomatic agent to the Government of the Republle of Chile; and, in like manner, His Excellency the President of the Republic of Chile may, if he see fit, accredit a Diplomatic Agent to the Court of Tokio; and each of the High Contracting Parties shall have the right to appoint Consuls-General, Consuls, Vice-Consuls and Consular Agents, for the convenience of trade, to reside in all the ports and places within the territories of the other Contracting Party where similar Consular Officers of other nations are permitted to reside; but before any Consul-General,

ARTÍCULO III.

Habrá recíproca libertad de comercio y navegación entre los territorios y posesiones de las dos Altas Partes Contratantes. Los súbditos y ciudadanos de cada una de las Altas Partes Contratantes, respectivamente, tendrán el derecho de entrar con seguridad y libremente con sus buques y cargamentos en todos los lugares, puertos, rios y estrechos de los territorios y posesiones de la otra, en que la entrada fucre permitida á súbditos ó ciudadanos de otras naciones; pueden permanccer y residir en todos los lugares y puertos en que se consiente residir y permanecer á súbditos y ciudadanos

Consul, Vice-Consul or Consular Agent shall act as such he shall, in the usual form, be approved and admitted by the Government to which he is sent.

The Diplomatic and Consular Officers of each of the Two High Contracting Parties shall, subject to the stipulations of this Treaty, enjoy in the territories of the other whatever rights, privileges, exemptions and immunities, are, or shall be granted there to officers of corresponding rank of any European nation or of the United States of America. ARTICLE III.

There shall be between the Territories and Possessions of the two High Contracting Parties reciprocal freedom of commerce and navigation. The subjects and citizens, respectively, of each of the High Contracting Parties shall have the right to come freely and securely with their ships and cargoes to all places, ports, rivers and straits in the Territories and Possessions of the other, where subjects or citizens of other nations are permitted so to come; they may remain and reside at all the places or ports where subjects or citizens of other nations are permitted to remain and reside, and they
