CONVENTION between Germany and Denmark, for the Rectification of their respective Frontiers.—Signed at Copenhagen, February 12, 1900.

[Ratifications exchanged at Copenhagen, February 11, 1902.] (Translation.)

His Majesty the German Emperor, in the name of the German Empire, and His Majesty the King of Denmark, animated by a desire to fix the alteration of the frontier between the German Empire and Kingdom of Prussia on the one side and the Kingdom of Denmark on the other, which has become necessary through the regulation of the Norderau and of the Kjarmühlenau, and with this purpose to come to an agreement together, have named as Plenipotentiaries:

The German Emperor, the Minister Plenipotentiary, &c., Wilhelm von Schoen;

The King of Denmark, the Minister for Foreign Affairs, ad interim, Vice-Admiral Niels Frederik Ravn;

Who, after exchanging the full powers with which they were duly provided, have agreed on the following provisions:

:

ART. I. According to the map annexed the above-mentioned frontier up to now was laid between frontier-post 91 and frontierpost 94 through the Norderau (Fovsau) and between frontier-posts 124 and 126 through the frontier along the Kjarmühlenau between the parishes Heils and Aller, and so the frontier followed throughout the middle line of the two river courses.

II. More lately the two river courses have been regulated and have been made straight, the Norderau by the Norderau Drainage and Irrigation Company and by an Association of landed proprietors on the Danish side, and the Kjarmühlenau by the owner of the Kjarmühle, so that on the Norderau now portions of German territory lie on the right and portions of Danish territory on the left of the new courses, and on the Kjarmühlenau portions of German territory lie on the left and portions of Danish territory on the right of the same.

III. In both places the extent of the Danish territory to be exchanged is greater than the German.

The difference on the Norderau, according to German maps and measurements which also here on the Danish side are recognized as correct, amounts to 331 square metres. On the Kjarmühlenau, according to the German maps and measurements to 687 square meters, according to the Danish ones to 238 square meters. Both 687 + 238 parties accept it as = 462.5 square meters, taking an esti2 mate of the maps and measurements on either side.

[blocks in formation]

IV. Both the Contracting Parties agree that in future the new water-courses shall form the boundary between the territories. First of all, however, to avoid the loss of territory otherwise suffered by the Kingdom of Denmark, amounting to 331 + 462.5 = 793.5, the Kjarmühlenau shall be correspondingly altered.

V. This alteration shall be carried out in the place where the present course of the stream in question has a bend to the northeast of Kjarmühle on the property of the proprietor of Kjarmühle, in such a manner that the line, marked here by posts by the survey officials of both parties, forms the southern bank of the new watercourse which is to be dug out to a breadth of 370 meters or 12 Danish feet.

VI. The alteration of the Kjarmühlenau, settled in the foregoing Article, shall be carried out by the proprietor of the Kjarmühle in accordance with the directions and under the superintendence of the Royal Prussian Landrath of the Hadersleben district. The former shall bear the cost of the alteration up to a sum guaranteed to him, on a scale agreed on by both, by the Norderau Drainage and Irrigation Company. This sum, as well as the other expenses of rectifying the frontier, is to be made up by the Company who pay threequarters of it, and the Danish Association of Landed Proprietors one-quarter.

VII. When the alteration is finished the Commissioners appointed on the German and on the Danish side, will on the spot see that the work has been duly executed and will make a

survey.

VIII. In accordance with the due execution of the alteration of the Kjarmühlenau agreed on in Article V, the frontier will run from post 91 to post 94 through the middle of the new bed of the Norderau and from post 124 to post 126 through the middle of the new bed of the Kjarmühlenau.

Accordingly

(a.) The territories marked yellow on the map hitherto under Danish sovereignty are ceded to the Kingdom of Prussia; and

(b.) The territories marked red on the map hitherto under Pussian sovereignty are ceded to the Kingdom of Denmark.

A special marking of the new frontier by posts is not required for at the places where the posts stand the new water-courses correspond everywhere with the former ones.

IX. The ratification of this Treaty shall be effected within twelve months after signature.*

In witness whereof the respective Plenipotentiaries have signed

This period was prolonged for an additional twelve months by agreement between the Contracting Parties.

and sealed the present Treaty, in duplicate, drawn up in the German and Danish languages.
