Zijne Majesteit de Koning van het Vereenigd Koninkrijk van Groot-Britannië en Ierland en van de Britsche Overzeesche Bezittingen, Keizer van Indië,

wenschende tot eene voorloopige schikking nopens het luchtvaartverkeer tusschen Nederland en Groot-Britannië en Noord-Ierland te geraken, hebben daartoe tot Hunne Gevolmachtigden benoemd, te weten:

Zijne Majesteit de Koning van het Vereenigd Koninkrijk van Groot-Britannië en Ierland en van de Britsche Overzeesche Bezittingen, Keizer van Indië:

Her Majesty the Queen of the Netherlands and

His Majesty the King of the United Kingdom of Great Britain and Ireland and the British Dominions beyond the Seas, Emperor of India,

being desirous of entering into a provisional agreement relating to air navigation between the Netherlands and Great Britain and Northern Ireland, have appointed as their Plenipotentiaries for this purpose:

His Majesty the King of the United Kingdom of Great Britain and Ireland and the British Dominions beyond the Seas, Emperor of India:

Sir CHARLES MURRAY MARLING, K. C. M. G., C. B., His Majesty's Envoy Extraordinary and Minister Plenipotentiary at The Hague;

who, after having communicated to each other their full powers found to be in good and proper form, have agreed as follows:

Article 1.

This provisional agreement ap plies only to private and commer cial aircraft, duly registered as such

onderscheidenlijk door de Nederandsche en de Britsche Regeering volgens de voorschriften zijn ingechreven. Elk der beide verdragluitende Staten verbindt zich in redestijd aan de particuliere en andelsluchtvaartuigen van den nderen Staat vrijheid van vreedaam verkeer boven zijn territoir n territoriale wateren toe te taan, mits de in deze voorloopige chikking vermelde voorwaarden worden nageleefd.

Elk der beide verdragsluitende Staten heeft het recht het vervoer an personen en goederen tegen betaling tusschen twee punten -innen zijn territoir ten behoeve an de eigen luchtvaartuigen voor e behouden.

Artikel 2.

De Nederlandsche Regeering en e Britsche Regeering hebben ieder et recht het vliegen boven beaalde gedeelten van haar territoir, p straffen bij de wet bedreigd, te erbieden, onder het voorbehoud, at in dit opzicht geen onderscheid al worden gemaakt tusschen de articuliere en handelsluchtvaarigen der beide Staten.

In buitengewone omstandigheen evenwel heeft elk der verdraguitende Staten het recht het liegen boven zijn territoir of boven edeelten van zijn territoir te beerken of geheel te verbieden, in elk geval het hierboven bedoelde oorbehoud niet van toepassing is. De in dit artikel genoemde ver

Each of the two contracting States undertakes in time of peace to allow the private and commercial aircraft of the other State liberty of innocent passage above its territory and territorial waters provided that the conditions set forth in the present provisional agreement are observed.

Each of the two contracting States shall have the right to reserve to its national aircraft the carriage of persons and goods for hire between two points within its own territory.

Article 2.

The Netherlands Government and the British Government shall each have the right to forbid flight over certain areas of its territory under the penalties provided by its legislation, but subject to the reservation that no distinction shall be made in this respect between the private and commercial aircraft of the two States.

In exceptional circumstances, however, each of the contracting States shall have the right to restrict or to forbid the flight over the whole er over parts of its territory, this measure not being subject to the reservation mentioned above.

passagiers moeten voorzien zijn van alle identiteitsbewijzen en paspoorten, welke de geldende wetten en verordeningen voorschrijven.

Artikel 6.

Een luchtvaartuig mag geen inrichting voor draadlooze telegraphie of telephonie medevoeren zonder bijzondere vergunning van den Staat, tot welks nationaliteit het behoort. Het gebruik van deze inrichtingen boven het territoir van elk der verdragsluitende Staten zal onderworpen zijn aan de voorschriften, welke door de bevoegde autoriteit van dien Staat zijn gegeven. In elk geval mag een zoodanige inrichting slechts bediend worden door die leden der bemanning, die daartoe een bijzondere vergunning hebben.

Geen wapenen, munitie, ontplofbare stoffen, vergiftige gassen of postduiven mogen worden medegevoerd. Geen photographische of cinematographische toestellen mogen worden medegevoerd zonder bijzondere vergunning van den Staat, waarboven het luchtvaartuig zich bevindt.

Artikel 7.

Een luchtvaartuig, dat aan het Internationaal verkeer tusschen He beide Staten deelneemt, mag passagiers en goederen vervoeren, doch moet voorzien zijn:

wat de passagiers betreft, van een aamlijst;

all the documents of identity and passports required by the laws and regulations in force.

Article 6.

No apparatus for wireless telegraphy or telephony shall be carried by an aircraft without a special licence issued by the State, to which it belongs. The use of such apparatus above the territory of each of the contracting States shall be subject to the regulations made by the competent authority in that State. In any case such apparatus shall only be used by such members of the crew as are provided with a special licence for the purpose.

No arms, munitions, explosives, asphyxiating gases or carrier pigeons shall be carried. No phothographic or cinematographic apparatus shall be carried without special permissions from the State flown over.

Article 7.

An aircraft engaged in international navigation between the two States may carry passengers and goods, but shall be provided:
