PREFACE TO THE FOURTH EDITION.

THE exhaustion of the last edition of this work (formerly entitled "Collieries and Colliers") and several alterations of the law affecting this kind of property concur to make it advisable to publish a fresh edition. The author of the work has been joined in the preparation of the present edition by Mr. David Lewis, of the South Wales Circuit, who has had ample opportunities of becoming acquainted with the various incidents of the working of coal. No work has hitherto been published which treats specially of the legal matters connected with Collieries, to the exclusion of other kinds of mining. But the vast interests involved in coal-mining fully justify the production of a work in which those interests alone will be the subject. The successive chapters will be found to treat more or less fully of all the legal incidents of this kind of mineral property, such as the right to coal under copyhold lands and commons, railways, and canals. There are chapters on leases and covenants; on title by prescription, and the statute relating to that title; on fixtures; rights of way; rights connected with the flow of water, both natural and artificial, on the surface and subterraneous.
