Now, therefore, His Majesty, by virtue and in exercise of the powers in this behalf by The Foreign Jurisdiction Act, 1890," or otherwise in him vested, is pleased, by and with the advice of his Privy Council, to order, and it is hereby ordered, as follows:

1. All property, rights and interests in Egypt belonging to German nationals at the date when the Treaty comes into force (not being property, rights or interests acquired under any general licence issued by or on behalf of His Majesty) and the net proceeds of their sale, liquidation, or other dealings therewith, so far as such property, rights and interests or such net proceeds are vested in or otherwise under the control of the Custodian of enemy property or other British authority under the Trading with the Enemy Acts or the Trading with the Enemy Proclamations issued from time to time by the General Officer Commanding-inChief the British Forces in Egypt, are hereby charged:

(a.) First, with payment of the amounts due in respect of claims by British nationals with regards to their property, rights and interests, including companies and associations in which they are interested in German territory, or debts owing to them by German nationals, and with payment of any compensation awarded by the Mixed Arbitral Tribunal or by an arbitrator appointed by that Tribunal in pursuance of paragraph (e) of Article 297 of the Treaty, and with payment of claims growing out of acts committed by the German Government or by German authorities since the 31st July, 1914, and before the 4th August, 1914.

(b.) Secondly, with payment of the amounts due in respect of claims by British nationals with regard to their property, rights and interests in the territories of AustriaHungary, Bulgaria, and Turkey in so far as those claims are not otherwise satisfied.

Provided that any particular property, rights or interests so charged may at any time, if the High Commissioner thinks fit, be released from the charge so created.

2. In the application and enforcement of the charge created by this Order the claims of or debts owing to British nationals resident or carrying on business in Egypt shall enjoy priority over the claims of or debts owing to other British nationals.

3. All decisions of the Mixed Arbitral Tribunal constituted under Section VI of Part X of the Treaty, if within the jurisdiction of that Tribunal, shall be final and conclusive, and binding on all courts.

4. For the purpose of enforcing the attendance of witnesses before the Mixed Arbitral Tribunal, whether sitting in Egypt or not, and compelling the production before the

Tribunal of documents, the High Commissioner shall have power to issue orders which shall have the like effect as if the proceedings before the Tribunal were an action in the Supreme Court, and the order were a formal process issued by that court in the due exercise of its jurisdiction, and shall be enforceable by that court accordingly, and disobedience to any such order shall be punishable as contempt of court.

5. Sections IV, V and VI of Part X of the Treaty relating to property, rights and interests, to contracts, prescriptions and judgments, and to the Mixed Arbitral Tribunal, and all provisions of the said Treaty affecting or relating to the charge created by this Order shall have full force and effect as law.

6. The time at which the periods of prescription or limitation of right of action referred to in Article 300 of the Treaty shall begin again to run shall be at the expiration of six months after the coming into force of the Treaty, and the period to be allowed within which presentation of negotiable instruments for acceptance or payment, and notice of non-acceptance or non-payment or protest may be made under Article 301, shall be six months from the coming into force of the Treaty.

7. Rules made during the war by any recognised Exchange or Commercial Association providing for the closure of contracts entered into before the war by an enemy, and any action taken thereunder are hereby confirmed, subject to the provisos contained in paragraph 4 (a) of the Annex to Section V of Part X of the Treaty.

8. The power under "The Egypt Order in Council, 1915,' to make King's Regulations, shall extend to the issue of regulations for the purpose of enforcing the charge created by this Order, and for making such arrangements as may be required for establishing and assessing the claims and debts. for the payment of which the property charged is rendered liable, and for the payment, in whole or in part, of the sums due.

9. In this Order the term British nationals resident or carrying on business in Egypt" means persons who are subject to "The Egypt Order in Council, 1915," and who are so resident or carrying on business.

10. The Treaty of Peace Order, 1919," shall not apply to Egypt except so far as may be consistent with the provisions of this Order or of any Proclamation issued by the General Officer Commanding-in-Chief the British Forces in Egypt, or with any rules or directions given thereunder.

11. This Order may be cited as "The Egypt (Treaty of

Peace) Order in Council, 1920," and shall be read as one with "The Egypt Order in Council, 1915."

12. This Order shall be deemed to have had effect as from the date when the Treaty of Peace came into force.* ALMERIC FITZROY.

WHEREAS by reason of conditions arising out of the war difficulties have been experienced by citizens of the United States of America in complying with the requirements of The Copyright Act, 1911, as to first publication within the parts of His Majesty's Dominions to which the Act extends of their works first published in the United States of America during the war;

And whereas His Majesty is advised that the Government of the United States of America has undertaken, upon issue of this Order, to extend the protection afforded by the United States Law of the 18th December, 1919, § entitled "An Act to amend Sections 8 and 21 of the Copyright Act, approved the 4th March, 1909," to British subjects;

And whereas by reason of the said undertaking of the Government of the United States of America, His Majesty is satisfied that the said Government has made, or has undertaken to make, such provision as it is expedient to require for the protection of works first made or published between the 1st August, 1914, and the termination of the war in the parts of His Majesty's Dominions to which this Order applies, and entitled to copyright under Part I of "The Copyright Act, 1911";

And whereas by "The Copyright Act, 1911," authority is conferred upon His Majesty to extend, by Order in Council,

the protection of the said Act to certain classes of foreign works within any part of His Majesty's Dominions, other than self-governing Dominions, to which the said Act extends;

And whereas by reason of these premises it is desirable to provide protection within the said Dominions for literary or artistic works first published in the United States of America between the 1st August, 1914, and the termination of the war which have failed to accomplish the formalities prescribed by The Copyright Act, 1911," by reason of conditions arising out of the war:

Now, therefore, His Majesty, by and with the advice of his Privy Council, and by virtue of the authority conferred upon him by The Copyright Act, 1911," is pleased to order, and it is hereby ordered, as follows:

1. The Copyright Act, 1911," shall, subject to the provisions of the said Act, and of this Order, apply to works first published in the United States of America between the 1st August, 1914, and the termination of the war, which have not been republished prior to the commencement of this Order in the parts of His Majesty's Dominions to which this Order applies, in like manner as if they had been first published within the parts of His Majesty's Dominions to which the said Act extends:

Provided that the enjoyment by any work of the rights conferred by The Copyright Act, 1911," shall be conditional upon publication of the work in the Dominions to which this Order relates not later than six months after the termination of the war, and shall commence from and after such publication, which shall not be colourable only, but shall be intended to satisfy the reasonable requirements of the public.

2. The provisions of Section 15 of "The Copyright Act, 1911," as to the delivery of books to libraries, shall apply to works to which this Order relates upon their publication in the United Kingdom.

3. In the case of musical works to which this Order relates and provided that no contrivances by means of which the work may be mechanically performed have before the commencement of this Order been lawfully made, or placed on sale, within the parts of His Majesty's Dominions to which this Order applies, copyright in the work shall include all rights conferred by the said Act with respect to the making of records, perforated rolls and other contrivances by means of which the work may be mechanically performed.

4. This Order shall apply to all His Majesty's Dominions, Colonies and Possessions with the exception of those hereinafter named, that is to say:

The Dominion of Canada;

The Commonwealth of Australia ;
The Dominion of New Zealand;
The Union of South Africa;

Newfoundland.

5. Nothing in this Order shall be construed as depriving any work of any rights which have been lawfully acquired under the provisions of "The Copyright Act, 1911," or any Order in Council thereunder.

6. This Order shall take effect as from the 2nd day of February, 1920, which day is in this Order referred to as the commencement of this Order.

And the Lords Commissioners of His Majesty's Treasury are to give the necessary orders accordingly.

BRITISH ORDER IN COUNCIL declaring January 10, 1920, as the date of the Termination of War between Great Britain and Germany.-London, February 9, 1920.*

PRESENT: THE KING'S MOST EXCELLENT MAJESTY IN COUNCIL.

WHEREAS by "The Termination of the Present War (Definition) Act, 1918," it is provided that His Majesty in Council may declare what date is to be treated as the date of the termination of the present war, and that the date so declared shall be as nearly as may be the date of the exchange or deposit of ratifications of the Treaty or Treaties of Peace, and that His Majesty may also similarly declare what date is to be treated as the date of the termination of war between His Majesty and any particular State;

And whereas at Versailles on the 28th day of June, 1919, a Treaty of Peace between the Allied and Associated Powers and Germany was signed on behalf of His Majesty;

And whereas by the said Treaty of Peace it was provided that a procès-verbal of the deposit of ratifications should be drawn up as soon as the Treaty has been ratified by Germany on the one hand and by three of the principal Allied or Associated Powers on the other, and that from the date "London Gazette," February 10, 1920.
