Referring to the note of October 12, last, No. 191, by which this Embassy asked that the Boundary Commissioners of Mexico and the United States abstain from rendering any further award concerning bancos, pending the settlement of the Chamizal, I have the honor, under special instructions I have received from the Department of Foreign Relations, to inform Your Department that my Government desires such suspension of awards only as regards the bancos lying above Rio Grande City.

I therefore request Your Excellency kindly to take note of the foregoing declaration and to take appropriate action to let the investigation and settlement of the cases of bancos in the lower stream between Rio Grande City and the Gulf of Mexico proceed. I beg Your Excellency to be pleased to accept the assurances of my highest and most distinguished consideration.

I have the honor to acknowledge the receipt of your note of the 23d ultimo requesting, in compliance with special instructions from your Government, that the suspension of awards concerning bancos pending the settlement of the Chamizal case, suggested in your note of October 12th, shall apply only to the bancos lying

above Rio Grande City, and that the investigation and settlement of the cases of bancos in the lower stream between Rio Grande City and the Gulf of Mexico proceed.

In reply it affords me pleasure to say that the Department has taken action in the sense requested by you.

Accept, Excellency, the renewed assurances of my highest consideration.

Tengo la honra de comunicar á Vuestra Excelencia, que he recibido el Pleno Poder necesario para efectuar el canje de las ratificaciones de la Convención celebrada entre México y los Estados Unidos de América, para someter al arbitraje el caso de "El Chamizal", así como el documento respectivo, por lo que ruego á Vuestra Excelencia se sirva señalarme día y hora para la realización de dicho canje.

Reitero á Vuestra Excelencia las seguridades de mi consideración más alta y distinguida.

I have the honor to inform Your Excellency that I have received the necessary Full Power in order to make the exchange of ratifications of the Convention concluded between Mexico and

the United States of America for the submission of the "El Chamizal" case to arbitration, as well as the document relating thereto, for which reason I request Your Excellency to kindly appoint a day and hour for the making of said exchange.

I reiterate to Your Excellency the assurances of my highest and most distinguished consideration.

I have the honor to acknowledge the receipt of your note of the 19th instant, requesting that a time and hour be fixed for the exchange of ratifications of the Convention for the arbitration of the Chamizal case and the supplementary protocol amendatory thereof, and to inform you in reply that I shall be glad to effect the exchange with you at six o'clock this afternoon at my home, if that time meets your convenience.

Excelentísimo Señor:

De acuerdo con lo que tratamos en la entrevista que tuve la honra de celebrar esta mañana con Usted, sobre el asunto de "El Chamizal," le manifiesto que he recibido un telegrama del Señor Secretario de Relaciones Exteriores de mi país, que á la letra dice lo siguiente:

"Comisionado Mexicano de Límites en Ciudad Juarez díceme que se le han presentado varios vecinos de los terrenos comprendidos en 'El Chamizal,' pidiéndole urgentemente ayuda ó consejo sobre la actitud que deben tomar respecto á una órden de desalojamiento inmediato de sus propiedades que á mas de cincuenta familias ha prevenido el Marshal de El Paso, que es funcionario federal de los Estados Unidos. Ellos parecen dispuestos á oponerse á viva fuerza pues creen estar en sus propiedades y en jurisdicción mexicana, mientras no se resuelva la cuestión internacional pendiente. Sírvase dar conocimiento á Departmento de Estado á efecto de que se retiren órdenes dadas al Marshal, si es que existen, y se suspenda toda clase de procedimientos."

En virtud de las instrucciones que se sirve darme mi Gobierno en el preinserto telegrama, suplico á Usted que tenga á bien recabar de quien corresponda que se retiren las órdenes dadas al Marshal de El Paso, á que se refiere dicho telegrama, si es que tales órdenes existen, y que se suspenda toda clase de procedimientos sobre el particular.

Con este motivo me es grato reiterar á Usted, Excelentísimo Señor, las seguridades de mi más alta consideración.
