INTRODUCTORY NOTE

This section contains a complete listing of all proposed amendments, conditions, reservations, and understandings which were considered by the Senate during the debate on the Panama Canal Treaties. The order of presentation, which corresponds to the order of consideration by the Senate, is a follows:

A. The Neutrality Treaty

B. The Resolution of Ratification for the Neutrality Treaty
C. The Panama Canal Treaty

D. The Resolution of Ratification for the Panama Canal Treaty

Since the Senate followed the Committee of the Whole procedure of considering amendments to the treaties article by article, the amendments are listed by article, generally in the order in which they were considered. Exceptions to this rule are noted in explanatory footnotes. To facilitate understanding, the text of each treaty article is printed just before the proposed amendments.

Each listing includes the following:

(1) A heading which indicates, in order of presentation, (a) the title and number of the proposed change-e.g. Amendment No. 40with explanation when the title varied during the debate, or varied from the nomenclature in the resolution of ratification; (b) whether the measure was modified during debate; (c) the principal sponsor or sponsors; (d) the date the measure was first called up for consideration; along with (e) a page reference to the Congressional Record (daily edition) when the measure was considered; and (f) the final vote on the matter.

(2) A summary of the amendment.

(3) The actual text of the amendment.

(4) The roll call vote on the measure, with the date of vote and Congressional Record (daily edition) page reference.

A. THE TREATY CONCERNING THE PERMANENT NEUTRALITY AND OPERATION OF THE PANAMA CANAL

ARTICLE I

The Republic of Panama declares that the Canal, as an international transit waterway, shall be permanently neutral in accordance with the regime established in this Treaty. The same regime of neutrality shall apply to any other international waterway that may be built either partially or wholly in the territory of the Republic of Panama.

Proposed amendments to Article I

Amendment No. 40, as modified' (Allen, Laxalt), February 24, 1978 (Congressional Record, S 2276)—Tabled 55–34.

Summary.-Provided for a continued U.S. military presence in the Canal Zone area after 1999, but not beyond 2019, if the President of the United States determined that such a presence was necessary for the defense of the canal or the preservation of its neutrality.

Text.-Strike article I, and insert in lieu thereof the following:

ARTICLE I

The Republic of Panama declares that the Canal, as an international transit waterway, shall be permanently neutral in accordance with the regime established in this Treaty. The same regime of neutrality shall apply to any other international waterway that may be built either partially or wholly in the territory of the Republic of Panama: Provided, That the military presence of the United States in what was the Panama Canal Zone on September 7, 1977, shall be continued beyond December 31, 1999, but not beyond December 31, 2019, if the President of the United States deems it necessary for the defense of the Canal or maintenance of the neutrality thereof and shall prior to December 31, 1999, so certify to the Government of Panama.
