Summary.-Retained in force the first sentence of Article X of the 1936 Treaty with Panama (superseded by Article I of the 1977 Treaty), allowing the United States and Panama to take whatever

defense measures they consider necessary in the event of an international conflagration or a threat of aggression endangering Panama's security or the neutrality of the Canal.

Text.-In paragraph 1(b) of article I, immediately after "March 2, 1936," insert "except for the first sentence of Article X thereof,”. Vote to table, April 6, 1978 (Congressional Record, S 4917).— The result was announced-yeas 54, nays 33, as follows:

PANAMA CANAL TREATY

ARTICLE II

RATIFICATION, ENTRY INTO FORCE, AND TERMINATION

1. This Treaty shall be subject to ratification in accordance with the constitutional procedures of the two Parties. The instruments of ratification of this Treaty shall be exchanged at Panama at the same time as the instruments of ratification of the Treaty Concerning the Permanent Neutrality and Operation of the Panama Canal, signed this date, are exchanged. This Treaty shall enter into force, simultaneously with the Treaty Concerning the Permanent Neutrality and Operation of the Panama Canal, six calendar months from the date of the exchange of the instruments of ratification.

2. This Treaty shall terminate at noon, Panama time, December 31, 1999.

Proposed amendments to Article II

Amendment No. 97 (Schmitt, et al.), April 13, 19781 (Congressional Record, S 5481)-Tabled 55-34.

Summary.-Provided that Panama would grant the United States use of the American sector of the Corozal Cemetery in perpetuity, without charge or taxation, and that the American Battle Monuments Commission would administer this part of the cemetery. The amendment also included concomitant revisions of Articles III, XI, and XIII.

Text. Before the period at the end of paragraph 2 of article II, insert a comma and the following: "except that the provisions of this Treaty shall not terminate with respect to such part of Corozal Cemetery as encompasses the remains of citizens of the United States of America.".

At the end of the first paragraph of article III, add the following: "The Republic of Panama grants in perpetuity, without charge or taxation, to the United States of America the use of such part of Corozal Cemetery as encompasses the remains of citizens of the United States of America, which cemetery shall be administered by the American Battle Monuments Commission.".

In the first paragraph of article XI, insert ", except for such part of Corozal Cemetery as encompasses the remains of citizens of the United States of America," immediately after "the former Canal Zone.".

In the text above paragraph 2(a) of article XIII, immediately after "all real property," insert "except for such part of Corozal Cemetery

Summary. Required that the Treaty be approved by a national plebiscite in Panama before it could go into effect.

Text.-Amend Article II of the treaty by striking the period at the period at the end of Article II, section 1, substituting a semicolon, and adding the following: "Provided, however, That within such six-months period the people of Panama shall have approved
