PREFACE.

THE object of this work is, to exhibit clearly and concisely the rules for determining the proper parties to actions, with the cases from which they are deduced, and the principles on which they are founded. In order to effect this object within the limits originally prescribed, and with a view to practical utility, it was thought better to omit the consideration of cases relating to the question of liability or non-liability, rather than involving any difficulty in the choice of parties; which cases are to be found collected in several treatises of acknowledged authority, particularly in Mr. Selwyn's Abridgment of the Law of Nisi Prius, and in Mr. Chitty's Treatise on Contracts; to both of which works, as well as to Mr. Smith's Compendium of Mercantile Law, and Mr. Wollaston's edition of Woodfall on the Law of Landlord and Tenant, continual reference has been made with advantage.
