PRESENT: THE KING'S MOST EXCELLENT MAJESTY IN COUNCIL.

WHEREAS by The Western Samoa Order in Council, 1920 (hereinafter referred to as the Principal Order), His Majesty was pleased to make provision for the peace, order, and good government of the Territory of Western Samoa as therein defined;

And whereas it is expedient to amend the said Order:

Now, therefore, His Majesty, by virtue of the powers by "The Foreign Jurisdiction Act, 1890," or otherwise in His Majesty vested, is pleased, by and with the advice of his Privy Council, to order, and it is hereby ordered, as follows:

1. This Order may be cited as The Western Samoa (Amendment) Order in Council, 1920," and shall be read and construed as one with the "Principal Order."

2. Article (2) of the Principal Order shall be read as if the words "between the thirteenth and fifteenth degrees of south latitude were substituted for the words between the thirteenth and fourteenth degrees of south latitude."

3. This Order shall be deemed for all purposes to have commenced and come into operation on the same day as the Principal Order, which Order shall be read and construed accordingly.

4. His Majesty may from time to time revoke, alter, add to or amend this Order.

And the Right Honourable Viscount Milner, G.C.B., G.C.M.G., one of His Majesty's Principal Secretaries of State, is to give the necessary directions herein accordingly. ALMERIC FITZROY.

PRESENT: THE KING'S MOST EXCELLENT MAJESTY IN COUNCIL.

WHEREAS by treaty, grant, usage, sufferance, and other lawful means, His Majesty the King has jurisdiction in China:

Now, therefore, His Majesty, by virtue and in exercise of the powers in that behalf by The Foreign Jurisdiction Act, 1890," or otherwise in His Majesty vested, is pleased by and with the advice of his Privy Council to order, and it is hereby ordered, as follows:

1. This Order may be cited as "The China (Amendment No. 2) Order in Council, 1920," and shall be read as one with The China Order in Council, 1904 "* (hereafter called the Principal Order "), and with any Order amending the

same.

2. The words in Article 101 of the Principal Order "except the jurisdiction relative to dissolution, or nullity, or jactitation of marriage are hereby repealed.

3. This Order shall take effect on the day on which it is first exhibited in the Public Office of the Supreme Court at Shanghai.

And the Right Honourable George Nathaniel, Earl Curzon of Kedleston, one of His Majesty's Principal Secretaries of State, is to give the necessary directions herein.

BRITISH ORDER IN COUNCIL amending The Aliens Order, 1920."—London, December 3, 1920.‡

PRESENT: THE KING'S MOST EXCELLENT MAJESTY IN COUNCIL.

WHEREAS by The Aliens Order, 1920,"§ made in pursuance of The Aliens Restriction Acts, 1914 and 1919,"

His Majesty was pleased, by and with the advice of his Privy Council, to impose certain restrictions on aliens, and to make provisions in accordance with the said Acts for giving effect to the said Order;

And whereas His Majesty has power by Order in Council to revoke, alter or add to any Order in Council made under the said Acts;

And whereas it is expedient that the provisions of "The Aliens Order, 1920," should be amended in manner hereinafter appearing;

And whereas the provisions of Section 1 of "The Rules Publication Act, 1893," have been complied with:

Now, therefore, His Majesty is pleased, by and with the advice of his Privy Council, to order, and it is hereby ordered, as follows:

1. "The Aliens Order, 1920," shall be amended as follows:

:

(a.) The following sub-section shall be substituted for Sub-Section (6) of Article 3

(6.) Without prejudice to any other provision of this article where an alien to whom leave to land has not been granted by an immigration officer is found on shore in the United Kingdom, it shall be lawful for the immigration officer or any constable, notwithstanding any intervening prosecution and imprisonment of the alien, at any time within one month after the arrival of the alien to replace that alien on board the ship in which he arrived in the United Kingdom, or on board any ship belonging to the same owners and bound for the port from which the alien came to the United Kingdom.

(b.) The following sub-section shall be substituted for Sub-Section (6) of Article 7—

(6.) This article applies to any premises, whether furnished or unfurnished. where lodging or sleeping accommodation is provided for reward.

(c.) The following paragraph shall be substituted for the last paragraph of Sub-Section (1) of Article 23

A reference to the Scottish Board of Health shall be substituted for any reference to the Minister of Health, and a reference to Section 16 of "The Summary Jurisdiction (Scotland) Act, 1908," shall be substituted for the reference to Section 29 of "The Summary Jurisdiction Act, 1879.”

(d.) The following paragraph shall be added at the end of Sub-Section (2) of Article 26

Any permission or direction given, or order or requirement made or other action taken under any Order made under The Aliens Restriction Act, 1914, and no longer in force,

shall be deemed to have been given, made or taken under the corresponding provision of this Order, and any expulsion order made under "The Aliens Act, 1905,'* and in force at the time of the repeal of that Act, shall have effect as though it were a deportation order made under this Order. 2. This Order shall come into operation forthwith. ALMERIC FITZROY.

BRITISH ORDER IN COUNCIL further postponing the coming into operation of the provisions of "The Merchant Shipping (Convention) Act, 1914."-London, December 3,

1920.

PRESENT: THE KING'S MOST EXCELLENT MAJESTY IN COUNCIL.

WHEREAS on the 20th day of January, 1914, an International Convention for the Safety of Life at Sea, and for purposes incidental thereto, was duly entered into by His Majesty and the other signatory Powers more especially referred to and set out in the said Convention;

And whereas a Statute 4 & 5 Geo. V, c. 50, intituled "An Act to make such amendments of the law relating to merchant shipping as are necessary or expedient to give effect to an International Convention for the Safety of Life at Sea" (being the Convention above referred to) was passed on the 10th day of August, 1914, the short title of which is "The Merchant Shipping (Convention) Act, 1914 ";S

And whereas by Section 29, Sub-Section 5, of the said Act it was provided as follows:

This Act shall come into operation on the 1st day of July, 1915:

Provided that His Majesty may, by Order in Council, from time to time postpone the coming into operation of this Act for such period, not exceeding on any occasion of postponement one year, as may be specified in the Order ";

And whereas by divers Orders in Council the coming into operation of the said Act has been from time to time postponed, and now stands postponed, by virtue of an Order in Council of the 11th day of June, 1920,|| until the 1st day of January, 1921;

And whereas His Majesty deems it expedient that the provisions of the said Act should be further postponed:

Now, therefore, His Majesty, by and with the advice of his Privy Council, in pursuance of the powers vested in him by the above-recited provision, and of all other powers him thereunto enabling, doth order, and it is hereby ordered, that the provisions of "The Merchant Shipping (Convention) Act, 1914," shall be postponed from coming into operation until the 1st day of July, 1921.

BRITISH ORDER IN COUNCIL applying the provisions of Part II of The Fugitive Offenders Act, 1881," to the Colony of Kenya and other Territories in Africa.London, December 3, 1920.*

PRESENT: THE KING'S MOST EXCELLENT MAJESTY IN COUNCIL.

WHEREAS by treaty, grant, usage, sufferance or other lawful means His Majesty has power and jurisdiction in the territories of or adjacent to East Africa named in the first column of the Schedule to this Order;

And whereas by certain Orders in Council mentioned in the second column of the said Schedule and respectively set opposite to the names of the said territories specified as aforesaid in the first column thereof "The Fugitive Offenders Act, 1881," has been applied to the said territories respectively as if each of them were a British Possession;

And whereas by reason of the contiguity of the Colony of Kenya and of the said territories and the frequent intercommunication between them it seems expedient to His Majesty and conducive to the better administration of justice therein that Part II of "The Fugitive Offenders Act, 1881," should apply to the said Colony and territories as hereinafter provided:
