belonging to the English company, and their allies, as he may have taken poffeffion of fince the ninth of Ramzam, in the year 1180, being the date of his treaty with the Pefhwa; and the faid territories fhall be delivered over to the English, and the Nabob Mahomed Ally Cawn, within fix months after this treaty being complete. And the English in fuch cafe agree, that fo long as Hyder Ally Cawn fhall afterwards abstain from hoftilities against them and their allies, and fo long as he fhall continue in friendship with the Pefhwa, they will in no refpect act hoftilely towards him.

X. The Pefhwa engages on his own behalf, as well as on behalf of his allies, the Nabob Nizam Ally Cawn, Ragojee Boufala Syna Saheb Subah, and the Nabob Hyder Ally Cawn, that they fhall in every refpect maintain peace towards the English and their allies, the Nabob Afoph-ul-Dowlah, Bahauder, and the Nabob Mahomed Ally Cawn, Bahauder, and shall in no refpect whatever give them any disturbance. The English engage on their own behalf, as well as on behalf of their allies, the Nabob Afoph-ul-Dowlah, and the Nabob Mahomed Ally Cawn, that they fhall in every respect maintain peace towards the Pefhwa and his allies, the Nabob Nizam Ally Cawn, and Ragojee Boufala Syna Saheb: and the English further engage on their own behalf, as well as on behalf of their allies, that they will maintain peace alfo towards the Nabob Hyder Ally Cawn, under the conditions fpecified in the ninth article of this treaty.

XI. The honourable Eaft India company, and the Pefhwa, mutually agree, that the veffels of each fhall afford no difturbance to the navigation of the veffels of the other; and the veffels of each fhall be allowed access to the ports of the other, where they fhall meet with no moleftation; and the fulleft protection fhall be reciprocally afforded.

XII. The Pefhwa and chiefs of the Maratta ftate

hereby agree, that the English fhall enjoy the privilege

of

of trade, as formerly, in the Maratta territories, and fhall meet with no kind of interruption: and in the fame manner, the honourable Eaft India company agree, that the fubjects of the Pefhwa fhall be allowed the privileges of trade, without interruption, in the territories of the English.

XIII. The Peshwa hereby engages, that he will not fuffer any factories of other European nations to be established in his territories, or thofe of the chiefs dependent on him, excepting only fuch as are already established by the Portuguese; and he will hold no intercourse of friendship with any other European nations: and the English on their part agree, that they will not afford affiftance to any nation of Deccan or Indoftan at enmity with the Pefhwa.

XIV. The English and the Pefhwa mutually agree, that neither will afford any kind of affiftance to the enemies of the other.

XV. The honourable the governor general and council of Fort William engage, that they will not permit any of the chiefs, dependants or fubjects of the English, the gentlemen of Bombay, Surat, or Madras, to act contrary at any place to the terms of this treaty: in the fame manner the Pefhwa Madhoo Row Pundit Purdhan engages, that none of the chiefs or fubjects of the Maratta ftate fhall act contrary to them.

XVI. The honourable Eaft India company, and the Pefhwa Madhoo Row Pundit Purdhan, having the fulleft confidence in Maha Rajah Subadar, Madhoo Row Sindia, Bahauder, they have both requested the faid Maha Rajah to be the mutual guarantee for the perpetual and invariable adherence of both parties to the conditions of this treaty; and the faid Madhoo Row Sindia, from a regard to the welfare of both ftates, hath accordingly taken upon himself the mutual guaranty. If either of the parties fhall deviate

from

from the conditions of this treaty, the faid Maha Rajah will join the other party, and will, to the utmost of his power, endeavour to bring the aggreffor to a proper understanding.

XVII. It is hereby agreed, that whatever territories, forts, or cities in Guzerat were granted by Ragonaut Row to the English, previous to the treaty of colonel Upton, and have come into their poffeffion, the reftitution of which was ftipulated in the feventh article of the said treaty, shall be restored agreeable to the terms of the faid article.

This treaty, confifting of seventeen articles, is settled at Salbey, in the camp of Maha Rajah Subadar Madhoo Row Sindia, on the fourth of the month Jummad ul Saany, in the year 1197 of the Hygera, correfponding with the 17th of May 1782, of the Chriftian æra, by the faid Maha Rajah and Mr. David Anderfon. A copy hereof shall be fent by each of the above-named perfons to their refpective principals at Fort William and Poonah; and when both copies being returned, the one under the feal of the honourable East India company, and fignature of the honourable the governor general and council of Fort William, fhall be delivered to Maha Rajah Madhoo Row Sindia, Bahauder, and the other under the feal of the Peshwa Madhoo Row Pundit Purdhan, and the fignature of Ballajee Pundit Nana Furnavefe, fhall be delivered to Mr. David Anderson, this treaty fhall be deemed complete and ratified, and the articles herein contained fhall become binding on both the contracting parties.

The following was added at the Time of the Ratification at Poonah, and the final Exchange at Gualiar.

THIS treaty, confifting of feventeen articles, was ratified on the 15th of the month of Mohrummum ul Hirram, in the year 1196 of the Hygera, and shall be invariably and perpetually binding on both the contracting parties,

Farnavefe,

Farnavefe, was delivered, near Gualiar, to Mr. David Anderfon; and a counterpart of the fame, under the feal of the company, and the fignatures of the governor general and council of Fort William, was in like manner delivered to Maha Rajah Madajee Sindia, Bahauder, by which exchange the faid treaty is become complete, and from this date fhall be binding on each of the contracting parties.

Extract of Bengal Secret Confultations, the 15th March, 1783.

RESOLVED, That the board affent to the two propofitions made by Bow Buckfey to Mr. Anderfon, upon the grounds of the treaty for the better prefervation of the peace established with the Maratta government; viz.

Firft, That the English and Maratta governments do mutually agree not to afford refuge to any chiefs, merchants, or other perfons, who fhall hereafter fly for protection to either, from the territories of the other.

Secondly, That the 11th article of the treaty, concerning the intercourfe of fhipping, be explained to mean according to former cuitom (Monjib Sabuck Duftow.)

Refolved, That the prefident and council at Bombay be defired to restore to the Marattas, the guns
