Commencement of Act. Wales, and also an Act passed in the Sixth Year of King Gene LXII. And be it further enacted, That this Act, and the sever Matters [and Things herein contained, shall commence and take effect from and after the First Day of August One thousand eight hundred and twenty-eight, and not sooner. SCHEDULES referred to in this Act. No. 1. FORM OF AGREEMENT for uniting Counties, or Lunatic and for the Purpose of Providing a Lunatic Asylum, or House IT is agreed, this Day of by and between the Committees of Justices of the Peace severally appointed for the County [or Committee of Subscribers, as th Case may be] of to treat for the uniting of the said Counties, or Lunatic Asylum, [as the Ces may be] for the Purposes of an Act passed in the Ninth Year of His Majesty King George the Fourth, intituled An Act [hert insert the Title of this Act], that the said Counties, &c. [as the Case may be] shall from henceforth be united for the Purposes of the said Act, and adopt in all respects the Provisions, Rules, Orders, and Regulations, and comply with all the Requisites pre scribed by the said Act for Counties [as the Case may be] uniting for those Purposes, and that a County Lunatic Asylum, or House for the Reception of Lunatics and other Insane Persons, with all necessary Buildings, Courts, Yards, and Outlets, shall be imme diately provided at or near and properly fitted up and accommodated for the Purposes mentioned in the said Act; and that the necessary Expences attending upon the providing, building, fitting up, Repairs and Maintenance of the said County Lunatic natic Asylum, shall be defrayed by the said County or Counties 1 Lunatic Asylum, so united, in the following Proportions; (that o say,) The County of The County of as the Case may be]. [as the Case may be], under the Description f County Rates, with the Payment of the Sum of which of hath proposed and agreed o lend, and hath now actually advanced and paid towards deraying the Expences of purchasing Lands for building, repairing, xc. [as the Case shall be] the County Lunatic Asylum for the said County, &c. or the united Counties of, &c. [as the Case may be], and we do hereby confirm and establish the same unto the said his Executors, Administrators, and Assigns, for securing the Repayment of the said Sum of Interest for the same after the Rate of per Centum per Annum, and do order the Treasurer for such County, &c. or other Person [as the Case shall be], to pay the Interest of the said Sum of Half-yearly, as the same shall become due, until the Principal shall be discharged, pursuant to the Directions of the said Act. and Name. No. 3. FORM OF WARRANT. S. 30. To the Overseers of the Poor of the Parish of to wit. and Two of u Majesty's Justices of the Peace in and for the County: hereby require you, in pursuance of an Ac Parliament passed in the Ninth Year of the Reign of His pre Majesty King George the Fourth, intituled An Act [here inser: Title of this Act], to make out a True List of all Insane Pere being Paupers, within the Parish aforesaid, specifying the N Sex, and Age of each Insane Person, and whether such Ins Person be dangerous or otherwise, and for what Length of T such Lunatics shall have been disordered in their Senses, & where confined, or how otherwise disposed of; and you sha the Receipt of this Warrant prepare such List according to Form hereunto annexed, and verify the same on Oath before One Justice of the Peace, and return the same, accompanied a Certificate from a Physician, Surgeon, or Licensed Apothec as to the State and Condition of each Insane Person, to the Cle of the Peace or his Deputy; and on neglect to prepare su List, or to return the same within Fifteen Days to the Clerk the Peace or his Deputy, with such Certificate as aforesaid, or verify such List on Oath, you will for every such Offence i subject to a Fine not exceeding Ten Pounds. you hereby required to take notice, that it shall be lawful for you defray the necessary Expences of Examination of such Insa Persons by a Physician, Surgeon, or Apothecary, out of the Por Rates of the Parish. A true List of all Lunatics and dangerous Idiots within the Parish or Pre cinct of in the County of specifying the Name. Sex, and Age of each Lunatic and Idiot, and whether such Lunatics dangerous or otherwise, and for what Length of Time such Lunatics have been disordered in their Senses, and where confined, or how otherwis disposed of. Sworn by Overseers of the Poor of the said Parish of before me, One of His Majesty's Justices of the Peace acting in and at this Day of for the County of A.B. No. 5. FORM OF WARRANT. WHEREAS it appears to us, is the Case may be] that of His Majesty's Justices a Physician, or Surgeon, or Apothecary, chargeable to the Parish in the said County, is lunatic, insane, or a dangerous liot [as the Case may be], you are hereby directed to cause the to be conveyed to the County Lunatic Asylum or to the House of id tablished at in the County of situate the said House cing a House duly licensed for the Reception of Insane Persons. Given under our Hands and Seals, this Day of An Act to regulate the Care and Treatment of Insane Persons in England. 6 [15th July 1828.] WHEREAS the Laws now existing for licensing and regu-. WH England are ineffectual: And Whereas it is expedient that the 'several Repeal of Acts 14 G. 3. c.49. 19 G. 3. c. 15. 'several Statutes and Acts hereinafter mentioned should repealed, and some other Provision made in lieu thereof, licensing and regulating such Houses, and for improving Treatment of Insane Persons;' Be it therefore enacted by King's most Excellent Majesty, by and with the Advice Consent of the Lords Spiritual and Temporal, and Commons: this present Parliament assembled, and by the Authority of th same, That from and after the Commencement of this Act, several Statutes and Acts following shall be repealed; viz. an Ac passed in the Fourteenth Year of the Reign of His late Maje King George the Third, intituled An Act for regulating N houses; and also an Act passed in the Nineteenth Year of te Reign of His said Majesty King George the Third, intituled Act to continue an Act made in the Fourteenth Year of the R of His present Majesty, intituled An Act for Regulating Ma 26 G. 3. c. 91. houses,' for a further Time therein limited; and also an Act passe. in the Twenty-sixth Year of the Reign of His said late Majes King George the Third, intituled An Act for making perpetual a Act made in the Fourteenth Year of the Reign of His prese Majesty, intituled An Act for regulating Madhouses; and same several Statutes and Acts are hereby repealed, and fr and after the Commencement of this Act shall cease and dete mine, save only and except as to such Proceedings under my of the said recited Acts respectively as shall have commenced before the passing of this Act, and which shall and may be continued and proceeded in under the Authority of and according to the Provision of either of the said recited Acts or of this Ac as shall be most expedient. Secretary of Home Depart- Fifteen Commissioners within London, &c., of whom Five to bel Physicians. Proviso as to II. And be it further enacted, That it shall and may be lawful for His Majesty's Principal Secretary of State for the Home Department for the Time being, annually, on the First Day of August in every Year, or within Ten Days then next following, by an Instrument under his Hand and Seal, to appoint not less tha Fifteen Persons to be Commissioners, during the Space of One Year, for licensing and visiting all Houses within the Cities f London and Westminster, and within Seven Miles thereof, and within the County of Middlesex, for the Reception of Two of more Insane Persons, of which Commissioners Five at the least shall be Physicians; and the said Secretary of State shall cause the Names of such Commissioners to be published in the London Gazette within Ten Days after their Appointment: Provided always, that no Physician appointed as such Commissioner shall professionally attend upon the Patients in any House so to be licensed for the Reception of Insane Persons, unless he be spe cially directed to visit any Patient by any Relative or Friend, under whose Order such Patient has been admitted into such House, or by a Committee appointed by the Lord Chancellor, or Lord Keeper or Commissioners of the Great Seal of Great Bri tain, being intrusted, by virtue of the King's Sign Manual, with the Care and Commitment of the Custody of the Persons and Estates of Persons found Lunatic or Idiot, or of unsound Mind: Commissioners and the aforesaid Commissioners are hereby empowered to grant Licences, if they shall think fit, in the Manner directed by this Act, for Persons to keep Houses for the Reception of Two or Physicians at tending Pa. tients in such Houses. to grant Licences for more |
