the Time last above limited, to give their Attendance to and the Justices of the Peace at any Time assembled in such spe Sessions, within the same Divisions respectively, as fully effectually as by Law they have been bound to do with Division reputed and taken before the passing of this Act to a lawful and accustomed Division for the Meetings of Justices any of the Purposes aforesaid.

XI. And be it further enacted, That immediately after the E rolment of such Order, the Clerk of the Peace shall and h hereby required to cause to be published a Copy of the same Three successive Numbers of One or more such weekly papers as aforesaid, and shall also transmit One Copy there each Justice of the Peace dwelling within or usually ac within and for such County, Riding, or Division, having separate Commission of the Peace.

XII. And be it further enacted, That no Order to be made. 1 any Proceeding to be had or taken, in pursuance of this Act, be quashed or vacated for Want of Form, or removed by (r tiorari, or any other Writ or Process whatever, into any of E Majesty's Courts of Record at Westminster; any Law or Sta to the contrary notwithstanding.

XIII. And be it further enacted, That nothing in this A contained shall extend or be construed or taken to extend to a County of Middlesex in England, or to Scotland or Ireland.

and Survey on Tea, Coffee, Cocoa, Pepper, Tobacco, S
Foreign and Colonial Spirits and Wine, notwithstand
the Transfer to the Customs of the Import Duties on ar

HEREAS the Duties of Excise payable in Great Bri and Ireland respectively, at and immediately before Commencement of the Year One thousand eight hundred twenty-five, upon the Importation into Great Britain and i land respectively of Coffee, Cocoa, Pepper, Tobacco, Foreign and Colonial Spirits and Wine, have been repealed, in lieu thereof Duties of Customs have been granted and payable on the Importation of such Commodities respective into any Part of the United Kingdom: And Whereas De in and Sellers of Coffee, Cocoa, Pepper, Tobacco, Snuff, Forc and Colonial Spirits and Wine, and Manufacturers of Tobac and Snuff, were subject, under several Acts relating to Revenue of Excise in force previous to the granting of the sa Duties of Customs, and previous to the Year One thous eight hundred and twenty-five, to the Payment of Duties Excise upon Licences, and to the Survey of Officers of Exc and to Regulations relating to such Survey, and to the spective Stocks of such Commodities in the Possession of suc Traders, and to the granting of Permits for the Removal of such Commodities respectively, under and according to the several

Provisions and Regulations, Penalties and Forfeitures contained
in the said several Acts relating thereto respectively: And
Whereas Doubts have arisen how far such Regulations, or the
Jurisdiction and Management, Powers or Authorities of the
Commissioners and Officers of Excise in the Matters aforesaid,
are or may be applicable or remain in force;' Be it therefore
eclared and enacted by the King's most Excellent Majesty, by
id with the Advice and Consent of the Lords Spiritual and
emporal, and Commons, in this present Parliament assembled,
d by the Authority of the same, That all Acts relating to the
evenue of Excise in force at and immediately before the Year
ne thousand eight hundred and twenty-five, with respect to
ealers in and Sellers of Coffee, Cocoa, Pepper, Tobacco, Snuff,
›reign and Colonial Spirits and Wine, and Manufacturers of
obacco and Snuff respectively, and with respect to the taking
id keeping Account of and Survey of all Stocks of such Com-
odities respectively in the Possession of such Traders respect-
ely, and to the Manufacture of Tobacco and Snuff, and with
espect to the granting of Permits for the Removal of such Com-
odities as aforesaid respectively, have remained and continued,
nd are and shall be and remain and continue in full force and
irtue, as Laws relating to the Revenue of Excise (save and except
o far as any of such Act or Acts, or any Part or Parts thereof,
ay have been repealed or altered by any subsequent Act relating
o the Excise passed for that Purpose), and the said Acts shall
nd may be executed and carried into Effect in all Particulars
save and except as to the landing and shipment of the said Com-
nodities respectively, and the Collection and Payment of the
Duties of Customs on the said respective Commodities, and the
odging of such Commodities in Warehouses without Payment of
Duty,) by the said Commissioners of Excise and their Officers;
and that all and singular the Powers and Authorities, Rules,
Regulations, Provisions, and Directions (except as aforesaid) in
anywise relating to the Licences to be taken out by the Dealers
in and Sellers of such Commodities respectively, and to the
Survey by the Excise Officers of such Dealers and Sellers, and
of their respective Stocks of such Commodities respectively, and
to the granting of all Permits (except as hereinafter mentioned)
for the Removal of such Commodities respectively, contained in
any Act or Acts relating to the said Commodities respectively,
and the Jurisdiction and Management thereof by the Commis-
sioners and Officers of Excise, shall and may be possessed, used,
executed, exercised, and put in force by the said Commissioners
of Excise and their Officers, to all Intents and Purposes what-
soever (save and except as aforesaid); any thing in any Act or
Acts relating to the Duties or Revenue of Customs to the con-
trary in anywise notwithstanding.

Excise Laws in force before 1825, relating to Dealers in

and Manufacturers of certain

exciseable Articles, shall continue in force notwithstanding any thing in any Acts relating to the Customs.

II. And be it further enacted, That all Penalties and Forfeitures imposed by any Act or Acts relating to the Revenue of Customs or Excise respectively, which by Law the Officers of Excise are authorized to prosecute, and which the Commissioners of Excise shall order to be prosecuted, shall and be so promay secuted, sued for, recovered, levied, mitigated, and applied, and in and by such Ways, Means, and Methods, and in, under, and recovered

before such Jurisdiction respectively, as Penalties and Forfeite incurred or forfeited by reason of Offences committed agains: Law or Laws of Excise are or may be sued for, recovered, le mitigated, and applied by an Act passed in the last Session of liament, for consolidating and amending the Laws relating to Collection and Management of the Revenue of Excise throug out Great Britain and Ireland; any thing in any other Ac Acts to the contrary thereof in anywise notwithstanding.

III. And be it enacted, That it shall not be lawful to se remove, or convey any Tea from Great Britain to Ireland, · to deliver any Tea out of any Warehouse in Great Britai the Purpose of being sent, removed, or conveyed to Ireland, the full Duty of Excise on such Tea shall have been paid: satisfied; any thing in an Act made in the Sixth Year present Majesty's Reign, intituled An Act for the warehousi Goods, or in an Act made in the Seventh Year of His prese Majesty's Reign, intituled An Act to alter and amend the sex Laws relating to the Customs, or in any other Act or Acts in fur immediately before the passing of this Act, to the contrary anywise notwithstanding.

IV. And be it further enacted, That all and every Act Acts now in force, or hereby declared to be in force as afores Britain relating in England, relating to the Revenue of Excise on Tea Cocoa, Pepper, relating to Coffee, Cocoa, Pepper, Foreign and Colonial Sp and Wine, 'shall be established, observed, executed, and put : force in and throughout the United Kingdom of Great Bri and Ireland, in the same Manner, to all Intents and Purpos whatsoever, as heretofore in England; any thing in any Act Acts to the contrary thereof in anywise notwithstanding.

whole of the United Kingdom, certain Provisions containe
in several Acts for regulating the Rectification, compound
ing, dealing in, or retailing of Spirits, and for preventi
private Distillation in Scotland; and to provide for th
Payment of the Duty on Malt used in making of Spirits fre
Malt only.

HEREAS an Act was passed in the Third Year of the
Reign of His present Majesty, intituled An Act to gra
certain Duties in Scotland upon Wash and Spirits made from
Corn or Grain, and upon Licences for making and keeping

Stills, and to regulate the Distillation of such Spirits for Home Consumption, and for better preventing private Distillation in Scotland, until the Tenth Day of November One thousand eight undred and twenty-four: And Whereas by an Act passed in the Fourth Year of the Reign of His present Majesty, intituled An 4G. 4. c. 94. Act to grant certain Duties of Excise upon Spirits distilled from Corn or Grain in Scotland and Ireland, and upon Licences of Stills for making such Spirits, and to provide for the better colecting and securing such Duties, and for the warehousing of such Spirits without Payment of Duty, so much of the said hereinefore recited Act of the Third Year of His present Majesty's Reign, and of several other Acts recited in the last-mentioned Act, as related, amongst other Things, to the making or disilling of Spirits in Scotland and Ireland, was repealed; but the everal Clauses, Rules, Regulations, or Provisions, Fines, Penalies, or Forfeitures, in the said Acts contained, relating to the rectifying and compounding of Spirits, or to the Rectifiers or Compounders thereof, in Scotland or Ireland, or relating to Dealers in or Retailers of Spirits, were left unrepealed: And Whereas an Act was passed in the Sixth Year of the Reign of His present Majesty, intituled An Act to repeal the Duties pay- 6 G. 4. c. 80. able in respect of Spirits distilled in England, and of Licences for distilling, rectifying, or compounding such Spirits, and for the Sale of Spirits, and to impose other Duties in lieu thereof, and to provide other Regulations for the Collection of the said Duties, and for the Sale of Spirits, and for the warehousing of such Spirits, without Payment of Duty, for Exportation: And Whereas by another Act passed in the Sixth Year of the Reign of His present Majesty, intituled, An Act to repeal several Duties payable 60.4.c.81. on Excise Licences in Great Britain and Ireland, and to impose other Duties in lieu thereof, and to amend the Laws for granting Excise Licences, all the several Duties then payable on Excise Licences were thereby repealed, and other Duties were thereon imposed in lieu thereof: And Whereas so much of the said firstrecited Act of the Third Year of His said Majesty as was not ' repealed as aforesaid has, by Two Acts passed in the Fifth and Seventh Years of His Majesty, been further continued and ' remains in force until the Fifth Day of July One thousand eight hundred and twenty-eight: And Whereas it is expedient that 'so much of the first-recited Act of the Sixth Year aforesaid, and the several Regulations, Provisions, Penalties, and Forfeitures therein contained, as respect or relate to the Rectification and 'compounding of Spirits, and to the Rectifiers and Compounders of and Dealers in and Retailers of Spirits, should be extended to Scotland and Ireland, and to establish the same in and throughout the United Kingdom; and that the hereinbefore ' recited Act of the Third Year aforesaid, so far as the same re'mains in force, should be continued for a limited Time; and 'that so much of the several Enactments and Provisions of the 'said Act of the said Third Year as relate to the Prevention of private Distillation in Scotland should be made perpetual; and that so much of the said several Enactments and Provi'sions of the said Act as relate to the Rectification and compounding of Spirits, and to the Rectifiers and Compounders of

Duties, and for the Sale of Spirits, and for the warehousin such Spirits, without Payment of Duty, of Exportation, and of several Enactments, Regulations, Provisions, Penalties, and F feitures in the said Act contained, as are in force in respect or in relation to the Rectification and compounding of Spr and to the Rectifiers and Compounders of, and to the Deales: and Retailers of Spirits, except as to the Amount of Lice Duties payable by such Traders respectively, shall extend and applied to, and shall be established, observed, executed, and p in force in and throughout Scotland and Ireland respectively, in and throughout the United Kingdom of Great Britain and I land, in such and the like Manner to all Intents and Purposes a the said recited Act had in such respects been originally extende to the whole of the United Kingdom; any thing in the said A or in any other Act or Acts, to the contrary thereof in anyw notwithstanding.

II. And be it further enacted, That so much of the heret before recited Act of the Third Year of His Majesty as shall b in force at the Time of the passing of this Act shall be and the same is hereby continued and shall be and remain in full Force until the Tenth Day of October One thousand eight hundred a twenty-eight; and that from and after the said Tenth Day October One thousand eight hundred and twenty-eight, so mo of the said Act of the said Third Year, and the several Reg lations, Provisions, Penalties, and Forfeitures therein contained as relate to the Prevention of private Distillation in Scotland, ska be and the same is and are hereby made perpetual; and that much of the said Act as shall be in force as aforesaid, relating the rectifying and compounding, and to the Rectifiers and Con pounders of Spirits, not inconsistent with or repugnant to any the Provisions of the said first-recited Act of the Sixth Year made perpetual, aforesaid, shall be and the same is and are hereby made perpetua and shall be and the same are hereby extended and applied to and shall be established, observed, executed, and put in force and throughout England and Ireland, and in and throughout the United Kingdom of Great Britain and Ireland, in the same to all Intents and Purposes as if the said Act of the said Thr Year had in such respects been originally extended to the whole of the United Kingdom; any thing in the said Act, or in any other Act or Acts, to the contrary thereof in anywise notwithstanding.
