And be it enacted, That if any Person shall unlawfully Destroying naliciously cut, break, or destroy, or damage, with Intent Machines or stroy or to render useless, any Threshing Machine, or any Machinery ine or Engine, whether fixed or moveable, or any Tool or ment prepared for or employed in any Manufacture what- Threshing r (except the Manufacture of Silk, Woollen, Linen, Mohair, Machines, &c. tton Goods, or Goods of any one or more of those Mate- Felony, with mixed with each other, or mixed with any other Material, Transportation ▾ Framework-knitted Piece, Stocking-hose, or Lace), every Offender shall be guilty of Felony, and being convicted of, shall be liable, at the Discretion of the Court, to be ported beyond the Seas for the Term of Seven Years, or to prisoned for any Term not exceeding Two Years, and if a to be Once, Twice, or Thrice publicly or privately whipped e Court shall so think fit), in addition to such Imprisonment. And be it enacted, That if any Artificer, Workman, Jour- Penalty on an, Apprentice, Servant, or Labourer, shall wilfully and Journeymen, fully damage, spoil, or destroy any Goods, Wares, or Work &c. spoiling Goods, or nitted to his Care or Charge, without the Consent of the PerWork, 51. to by whom he shall be hired, retained, or employed, every such der, being lawfully convicted thereof before any Justice or ces of the Peace, shall forfeit and pay such Sum of Money all appear to the Justice or Justices to be a reasonable Comation for the Damage, Injury, Spoil, or Destruction so comed, not exceeding in any Case the Sum of Five Pounds, ch Sum of Money shall be paid to the Party grieved; and y Person so convicted shall, in default of immediate Payt, be committed to the Gaol of the County of the City or wn, or to the House of Correction, there to be imprisoned only, to be imprisoned and kept to hard Labour, for any Term not eeding Three Calendar Months. the Party grieved. And be it enacted, That if any Person shall unlawfully maliciously set fire to any Mine of Coal or Cannel Coal, every h Offender shall be guilty of Felony, and being convicted reof, shall suffer Death as a Felon. VII. Proviso for Damage from adjoining Mine. VIII. And Destroying VIII. And be it enacted, That if any Person shall unlawy any Engine, and maliciously pull down or destroy, or damage with Inter Erection, &c. used in any destroy or to render useless, any Steam Engine, or other Ere Mine, Felony, or any Shaft, Passage, Drain, or Level for sinking, draining punishable by working any Mine, or any Staith, Building, or Erection e Transportation. conducting the Business of any Mine, or any Bridge, W way, or Trunk for conveying Minerals from any Mine, wie such Engine, Staith, Building, Erection, Bridge, Waggon Trunk be completed, or in an unfinished State, every suc fender shall be guilty of Felony, and being convicted the shall be liable to any of the Punishments which the Cour award, as hereinbefore last mentioned. Setting fire to or destroying a Ship, Felony, with Death. IX. And be it enacted, That if any Person shall unlawi and maliciously set fire to, or in anywise destroy any Sh Vessel, whether the same be complete or in an unfinished Sz or shall unlawfully and maliciously set fire to, cast away, anywise destroy any Ship or Vessel, every such Offender sha guilty of Felony, and being convicted thereof, shall suffer D as a Felon. Exhibiting false Signals, destroying a shipwrecked Vessel or Cargo, &c. or forcibly im peding Men from saving their Lives, Felony, with Death. XI. And be it enacted, That if any Person shall exhibit r false Light or Signal, with Intent to bring any Ship or Vessel Danger, or shall unlawfully and maliciously do any thing tend to the immediate Loss or Destruction of any Ship or Vesse Distress, or shall destroy any Part of any Ship or Vessel whe shall be in Distress, or wrecked, stranded, or cast on Shore." shall destroy any Goods, Merchandize, or Articles of any K belonging to such Ship or Vessel, or shall by Force prevent. impede any Person endeavouring to save his Life from such or Vessel (whether he shall be on board or shall have quitted same), every such Offender shall be guilty of Felony, and be convicted thereof, shall suffer Death as a Felon. XII. And be it enacted, That if any Person shall unlawf and maliciously break down or cut down any Sea Bank or Wall, or the Bank or Wall of any River, Canal, or Marsh, where by any Lands shall be overflowed or damaged, or shall be in di ger of being so, or shall unlawfully and maliciously throw dow level, undermine, or otherwise destroy any Lock, Sluice, Wea Tunnel, Towing Path, Floodgate, Aqueduct, Reservoir, Cut, Dan Drain, Watercourse, or other Work on any navigable River a Canal, every such Person shall be guilty of Felony, and be convicted thereof, shall be liable, at the Discretion of the Court to be transported beyond the Seas for Life, or for any Term no less than Seven Years, or to be imprisoned for any Term not ex ceeding Four Years, and if a Male to be Once, Twice, or Thrice publicy ely or privately whipped (if the Court shall so think fit), in onment. Felony, with Death; to certain Crops or Plantations, &c. Felony, with Transportation. Destroying or damaging Trees, Shrubs, &c. by Night, Felony, with Transportation. Like Punishment on destroying Trees, Shrubs, &c. in the Daytime, if the Value exceeds 51. Destroying or damaging Trees, Shrubs, &c. of any Value under 51. punishable on summary Conviction. Destroying, or privately whipped (if the Court shall so think fit), in adi to such Imprisonment. XVII. And be it enacted, That if any Person shall unlaw. and maliciously kill, maim, or wound any Cattle, every Offender shall be guilty of Felony, and being convicted thes shall suffer Death as a Felon. XVIII. And be it enacted, That if any Person shall uniss and maliciously set fire to any Stack of Čorn, Grain, Pulse. Hay, Coals, Turf, Charcoal, or Wood, every such Offende be guilty of Felony, and being convicted thereof, shali Death as a Felon; and if any Person shall unlawfully and ciously set fire to any Crop of Corn, Grain, or Pulse, standing or cut down, or to any Part of a Wood, Copp Plantation of Trees, wheresoever the same may be growing, such Offender shall be guilty of Felony, and being co thereof, shall be liable, at the Discretion of the Court, 221 transported beyond the Seas for the Term of Seven Years, e be imprisoned for any Term not exceeding Two Years, ar Male to be Once, Twice, or Thrice publicly or privately wha (if the Court shall so think fit), in addition to such Imprison XIX. And be it enacted, That if any Person shall unia and maliciously, between Sunset and Sunrise, cut, break, root up, or otherwise destroy or damage the Whole or any of any Tree, Sapling, or Shrub, or any Underwood, every Offender shall be guilty of Felony, and being convicted there shall be liable, at the Discretion of the Court, to be transpa beyond the Seas for the Term of Seven Years, or to be imprise for any Term not exceeding Two Years, and if a Male to Once, Twice, or Thrice publicly or privately whipped (if t Court shall so think fit), in addition to such Imprisonment: any Person shall, between Sunrise and Sunset, unlawfully a maliciously cut, break, bark, root up, or otherwise destroy: damage the Whole or any Part of any Tree, Sapling, or Shri any Underwood (in case the Amount of the Injury done exceed the Sum of Five Pounds), every such Offender sha guilty of Felony, and being convicted thereof, shall be liabi any of the Punishments which the Court may award for the Fer hereinbefore last mentioned. XX. And be it enacted, That if any Person shall, betwe Sunrise and Sunset, unlawfully and maliciously cut, break, ba root up, or otherwise destroy or damage the Whole or any Pr of any Tree, Sapling, or Shrub, or any Underwood, the In done being under the Value of Five Pounds, every such Offender being convicted before a Justice or Justices of the Peace, si be committed to the Common Gaol or House of Correcti there to be kept to hard Labour for such Term, not exceed Twelve Calendar Months, as the convicting Justice or Justice shall think fit. XXI. And be it enacted, That if any Person shall unlawf and maliciously destroy, or damage with Intent to destroy, Plant, Fruit, or Vegetable Production growing in any Garde Orchard, Nursery Ground, Hothouse, Greenhouse, or Conse vatory, every such Offender, being convicted thereof before & Justice or Justices of the Peace, shall, at the Discretion of the Justice e or Justices, either be committed to the Common Gaol or e of Correction, there to be imprisoned only, or to be impriand kept to hard Labour, for any Term not exceeding Six dar Months, or else shall forfeit and pay the Amount of the done, and also a Sum of Money not exceeding Twenty ds, as to the Justice shall seem meet; and if any Person so Second Ofcted shall afterwards commit any of the said Offences, such fence, Felony. der shall be deemed guilty of Felony, and being convicted of, shall be liable to any of the Punishments which the Court ward for the Felony hereinbefore last mentioned. or Fine; II. And be it enacted, That if any Person shall unlawfully Destroying, &c. aliciously destroy or damage with Intent to destroy, any cul- Vegetable d Root or Plant used for Food of Man or Beast, or for Medi- Productions, or for Distilling, or for Dyeing, or for or in the Course of any Gardens, &c. not growing in facture, and growing in any Land, open or inclosed, not being Imprisonment rden, Orchard, or Nursery Ground, every such Offender, g convicted thereof before a Justice or Justices of the Peace, , at the Discretion of the Justice or Justices, either be comed to the Common Gaol or House of Correction, there to mprisoned only, or to be imprisoned and kept to hard Labour, any Term not exceeding One Calendar Month, or else shall it and pay the Amount of the Injury done, and also such Sum Money, not exceeding Twenty Shillings, as to the Justice Justices shall seem meet; and in default of Payment thereof, ether with the Costs, if ordered, shall be committed as afore, for any Term not exceeding One Calendar Month, unless ment be sooner made; and if any Person so convicted shall Second Ofrwards be guilty of any of the said Offences, and shall be fence, Imprivicted thereof in like Manner, every such Offender shall be sonment, &c. mitted to the Common Gaol or House of Correction, there be kept to hard Labour for such Term, not exceeding Six endar Months, as the convicting Justice or Justices shall think XXIII. And be it enacted, That if any Person shall unlawly and maliciously cut, break, throw down, or in anywise deoy any Fence of any Description whatsoever, or any Wall, Stile, Gate, or any Part thereof respectively, every such Offender, ing convicted before a Justice or Justices of the Peace, shall for e first Offence forfeit and pay the Amount of the Injury done, d also such Sum of Money, not exceeding Five Pounds, as to e Justice or Justices shall seem meet; and if any Person so onvicted shall afterwards be guilty of any of the said Offences, id shall be convicted thereof in like Manner, every such Offender all be committed to the Common Gaol or House of Correction, here to be kept to hard Labour for such Term, not exceeding welve Calendar Months, as the convicting Justice or Justices hall think fit. Destroying, &c. Wall, Stile, or Persons possessed of Houses under XXIV. And be it enacted, That every Person who, being posessed in any Manner or Right whatever of any Dwelling House or other Building held under or by virtue of any Lease or Agree- Lease, &c. who ment, or for any Term of Years, or other less Term, certain or shall demolish at Will, (whether the Possession of such Dwelling House, or other or waste them, Building, or Part of such Dwelling House or other Building, shall declared have been obtained for the fraudulent and malicious Purpose of guilty of Mis pulling demeanor. |
