personal appearance in Court) must bear the proper Fee Stamp (Schedule II, Act 1 (d), Court Fees' Act, 1870), and must be accompanied by an affidavit, setting forth the facts on which the petition is founded, to be sworn or solemnly affirmed, as the case may be, before the District Judge, who will be appointed a Commissioner for that purpose.

The party must also deposit in the District Court the amount requisite to defray the expense of transmitting the petition, and, if need be, the record to the High Court.

The District Judge, on receiving such petition and affidavit as aforesaid, when such costs of transmission have been paid into Court, shall transmit the petition and affidavit to the Registrar of the High Court, under the seal and signature of the District Court.
