BILATERAL TREATIES OF ARBITRATION AND CONCILIATION

Brazil-Uruguay

The American Ambassador to Brazil reported by a despatch dated August 28, 1934, that a treaty of conciliation and obligatory arbitration and a treaty of judicial assistance between Brazil and Uruguay were signed at Rio de Janeiro on August 22, 1934.

Italy-Switzerland

The American Embassy at Rome reported by a despatch dated September 14, 1934, that the treaty of arbitration and conciliation between Italy and Switzerland signed at Rome on September 20, 1924, has by mutual agreement between the two countries been renewed for a period of 10 years. A protocol extending the duration of the treaty was signed at Rome on August 20, 1934.

The American Legation at Tallinn reported by a despatch dated October 5, 1934, the appointment by the Estonian Government of Mr. Waclaw Makowsky, of Poland, as nonnational member for Estonia on the Commission of Inquiry provided for by the treaty of conciliation between the United States and Estonia signed August 27, 1929. Mr. Makowsky, a professor at the University in Warsaw and vice president of the Polish Parliament, fills the place left vacant by the death on August 8, 1934, of Mr. Alexander Lednicki.

PERMANENT COURT OF INTERNATIONAL JUSTICE

ARTICLE 36 OF THE STATUTE OF THE PERMANENT COURT OF INTERNATIONAL JUSTICE 2

Abyssinia

The Secretary General of the League of Nations informed the Secretary of State by a communication dated September 29, 1934,

that the representative of Abyssinia accredited to the League of Nations, renewed, on September 18, 1934, on behalf of his government, the declaration of accession of Abyssinia to the optional clause provided in the protocol of signature concerning the Statute of the Permanent Court of International Justice, signed December 16, 1920, and made the following declaration: 3

"On behalf of the Imperial Abyssinian Government and referring to the declaration dated April 15th, 1932, the undersigned recognises as compulsory ipso facto and without special agreement, in relation to any other Member or State accepting the same obligation, that is to say, on condition of reciprocity, the jurisdiction of the Court in conformity with Article 36, paragraph 2 of the Statute, excepting disputes in respect of which the parties have agreed to have recourse to another method of pacific settlement.

"This acceptance is given for a similar period of two years from to-day's date, with retroactive effect covering the period comprised between July 16th, 1933, and the date of signature of the present declaration.'

Greece

By a communication dated September 29, 1934, the Secretary General of the League of Nations informed the Secretary of State that on September 12, 1934, the delegate of Greece to the Assembly of the League of Nations signed a declaration renewing the acceptance by the Hellenic Government of the optional clause provided in the protocol of signature concerning the Statute of the Permanent Court of International Justice, signed December 16, 1920. The previous acceptance by the Hellenic Government expired on September 12, 1934.

The declaration of renewal reads as follows"

"On behalf of the Hellenic Government and subject to ratification, I recognise as compulsory ipso facto and without special agreement, in relation to any other Member of the League of Nations or State accepting the same obligation-that is to say, on condition of reciprocity-and for a further period of five years as from September 12th, 1934, the jurisdiction of the Permanent Court of International Justice, for the classes of disputes mentioned in Article 36, paragraph 2, of the Statute of the Court, with the exception of:

"(a) Dispute [sic] relating to the territorial status of Greece, including disputes relating to its rights of sovereignty over its ports and lines of communication;,

"(b) Disputes relating directly or indirectly to the application of treaties or conventions accepted by Greece and providing for another procedure.

"This acceptance is effective as from the date of signature of the present declaration."
