En date de Constantinople, au mois de Février, 1847. CONSIDERANT les avantages du Règlement en vigueur relatif aux bâtimens de guerre et de commerce qui arrivent dans le port de Constantinople, le Gouvernement Impérial vient de décider qu'il serait applicable à tous les autres ports de l'Empire. En conséquence, nous vous remettons un exemplaire de l'Ordonnance qui a été expédiée à tous les employés des ports de l'Empire, pour y être mise à exécution. Vous êtes prié, M. le Ministre, d'en donner connaissance à vos Consuls nationaux, et de leur recommander de faire observer le dit Règlement avec la plus grande exactitude. Règlement. Les Dispositions suivantes du présent Règlement arrêté par la Marine Impériale, et concernant tous les navires en général qui se rendront dans les ports de l'Empire Ottoman, seront mises en vigueur, savoir: 1. A l'arrivée d'un bâtiment marchand dans un port, le capitaine de ce port se rendra à son bord, et après s'être informé du nombre de ses passagers et des hommes de son équipage, de l'espèce des marchandises dont il est chargé, et de l'échelle d'où il arrive, il lui indiquera, ainsi qu'aux bâtimens de guerre, l'endroit où il doit mouiller. * Martens. On préviendra les dommages que pourraient causer aux bâtimens les bas-fonds et les écueils qui se trouveraient dans un port et ses parages, en y plaçant des bouées et d'autres marques. 3. Il sera recommandé aux capitaines des navires qui aborderaient dans une échelle et stationneraient près du rivage pour y faire des vivres ou se mettre en réparation, de n'y jeter ni immondices ni matières combustibles ou inflammables, rien enfin qui soit préjudiciable au commerce; après avoir effectué son débarquement, ou réparé ses avaries, le navire devra se retirer à une distance de trente pics du rivage. 4. Aucun bâtiment ne pourra mouiller au milieu du port; et faute de ce conformer à cette recommandation, s'il éprouvait quelques dommages, il n'aurait droit à aucune espèce d'indemnité. 5. Il sera indiqué aux bâtimens chargés de briques, de vin, de charbon, et de paille, l'endroit de mouillage qui leur sera destiné. 6. On choisira un endroit exprès dans le port pour y jeter les immondices des bâtimens; c'est là qu'ils recevront leur lest, et qu'on le leur fournira au besoin. 7. Afin d'empêcher tout désordre, un préposé veillera à la garde de chaque fontaine où les bâtimens de guerre et marchands s'approvisionneront d'eau. 8. Le capitaine de port sera tenu de faire la manœuvre pendant les gros temps aux bâtimens qui seront à l'ancre dans le port. 9. On veillera à ce que les phares des Détroits et des ports soient allumés à temps, et à ce que leur lumière soit claire. 10. Il y sera allumé des feux pendant les temps de brouillards. 11. Si, par malheur, le feu se déclare dans le port, on tâchera, par tous les moyens possibles, de l'éteindre en fournissant les secours nécessaires. 12. Dans le cas où un bâtiment, en tombant sur un autre, lui causerait des dommages, on tâchera d'amener une transaction entre les capitaines; dans le cas contraire, il en sera fait un rapport exact au Conseil d'Administration de la Marine Impériale. 13. Si des disputes s'élèvent entre des matelots appartenants à un navire sous pavillon Ottoman, l'Autorité locale interviendra pour les appaiser; s'il s'agit de matelots étrangers, on s'en référera à leurs capitaines de port respectifs, qui devront s'interposer pour le maintien du bon ordre. 14. Le capitaine de port doit s'informer, au moment du départ d'un bâtiment, s'il a acquitté ou non les droits de port. 15. Le capitaine de port aura le pouvoir d'arrêter un bâtiment dans le cas où cette arrestation serait nécessaire. 16. Tout capitaine sera tenu, au moment de son départ, d'exhiber son Firman et ses papiers de bord. 17. Les marins d'un navire Ottoman ou étranger ne pourront passer la nuit à terre; ils devront être rentrés à bord au plus tard une demi-heure après le coucher du soleil. 18. Tout matelot qui sera trouvé à terre, tenant une conduite répréhensible ou portant des armes, sera emprisonné et puni. 19. En conformité du présent Règlement, il sera perçu deux piastres du G. S. par mille kilos, en calculant la capacité de chaque bâtiment, d'après la qualité des marchandises qu'il aura débarquées ou embarquées; ce droit est assigné aux capitaines du port. No. 9. -Firman. May God be pleased to preserve him long in exalted dignity! Let it be known, on receipt of this my noble Rescript, that Whereas those of my Christian subjects who have embraced the Protestant faith, have suffered inconveniences and difficulties in consequence of their not having been hitherto placed under a separate and special jurisdiction, and in consequence of the Patriarchs and Primates of their old creeds which they have abandoned, not being, naturally, able to administer their affairs, Whereas, in necessary accordance with my Imperial solicitude and benevolence towards all classes of my subjects, it is contrary to my Imperial pleasure that any class of them should be exposed to trouble; And whereas, by reason of their faith, the aforesaid Protestants form a separate community: It is in consequence my Royal pleasure that measures be taken for the sole purpose of facilitating the administration of their affairs, so that they may live in peace, quiet, and security. Let then a respectable and trustworthy person, chosen by themselves from among their own number, be appointed with the title of “Agent of the Protestants," to be attached to the Department of the Minister of Police. It shall be the duty of the Agent to take charge of the Register of the members of the community, and which is to be kept at the Police Department. The Agent is to register therein all births and deaths. All applications for passports and marriage licences, and on those special affairs of the community which are to come before the Sublime Porte, or any other department, are to be made under the official seal of the Agent. The present Royal and August Edict has been especially granted and issued from my Imperial Chancery for carrying my pleasure into execution. Hence, Thou, the above indicated Moushir, shalt carry the preceding Ordinance into scrupulous execution conformably with the explanations given. As, however, the assessment of taxes and the delivery of passports are subject to specific Regulations, thou shalt not permit any thing to be done in contravention thereto. Thou shalt not suffer any tax or Haratch to be required of the Protestants for marriage licences or for registration. Thou shalt be careful that, like unto the other communities of the Empire, every facility and required assistance be afforded to them in all their affairs, and in all matters concerning their cemeteries and places of worship. Thou shalt not permit any interference whatsoever on the part of any other community, with their rites, or with their religious concerns, nor, in short, with any of their affairs, either secular or religious, in any manner whatsoever, in order that they may be enabled to exercise the usages of their faith in security. Thou shalt not suffer them to be molested one iota in these, or in any other matters, and thou shalt be careful and attentive to maintain them in the desired quiet and security. They are to be permitted to make those representations to the Sublime Porte, which it may be necessary to make concerning their affairs, through their Agent. After thou hast taken due cognizance of these matters, thou shalt cause the present Noble Rescript to be registered in the proper quarter, and shalt cause it to be confirmed in the possession of the aforesaid subjects; and thou shalt be careful that the high Provisions thereof be always carried into due execution. His Imperial Majesty the Sultan, in order to afford a fresh proof of his Royal benevolence towards all classes of his subjects, has issued Imperial Orders adorned with the Royal cypher, addressed to the Greek, Armenian, and Catholic Patriarchs, to the Protestant Agent, and to the Chief Priest of the Jews, confirming their religious privileges, and the rights and immunities belonging to their churches and other places appertaining to them. Decreed: God, the dispenser of mercies, in placing my august person, in pursuance of His eternal will, upon the glorious and exalted throne of the Imperial Caliphate, having confided to my royal hands and sovereign rule as a sacred and a special deposit (to Him be the thanks and glory!) numerous countries and cities and many people of all classes and nations; ever since the glorious day on which I ascended the throne, according to the Imperial duties imposed upon the Caliphate, my Government has never ceased (by the divine grace), conformably with my Royal will and sincere and benevolent intentions, to give practically their constant and careful attention, that all classes of my Imperial subjects should enjoy full protection, and that they should be, more especially, one and all, at perfect ease with regard to their religious and spiritual affairs. The beneficial effects and advantages accruing thereby have been at all times manifest, and it is my ardent Imperial desire that no abuses whatever should arise out of negligence or carelessness.
