CASE WANTED.-Will you do me the favour to refer me in your next issue to the report, which I think appeared in your columns only a few months ago, of a judgment delivered by a County Court judge in a Midland district in a case of claim for damage to a plate glass shop front? My idea of the law there laid down is, that if a person erects in a public thoroughfare what is more costly than need be for the mere purpose of utility, the risk is his. Accidents should be calculated upon, larity alleged by Mr. Buckle: and the public must not be unduly mulcted for the mere whims or the refined taste as the case may be of those who are constantly exposing their curiosities or elegan even if they do not recur with the precise regu cies to casual damage. R. W. G. THOMAS BOLTON, ESQ., THE death of the late T. Bolton, Esq., of Oken, near Wolverhampton, an eminent solicitor, happened quite suddenly at St. George's-crescent, Llandudno, on the 14th ultimo. Mr. Bolton was a Roman Catholic, and was educated at the old Catholic school of Baddesley Clinton, now the property of Earl Ferrers. He originated the Catholic union in Wolverhampton, and it was during the agitation for Catholic emancipation he first displayed those remarkable qualities for political controversy and public advocacy which afterwards gained for him so high a standing in his profession. He was articled to Messrs. Thatcher and Phillips, of Wolverhampton, and afterwards became a partner with the latter gentleman, now the coroner for the district. For years Mr. Bolton had taken an active part in politics, and up to his last election he had been the Liberal agent for South Staffordshire, with uniform success to the cause which he represented. He was also engaged in the borough election up to 1861, and introduced Sir Richard Bethel, now Lord Westbury, as the colleague of Mr. Villiers, incorporation of the borough, Mr. Bolton was in the representation of the borough. On the elected a member of the council, but was shortly afterwards appointed the legal adviser and clerk to the borough justices. He served the office of sheriff under the late J. Barker. Esq., and became also for some time Judge of Offlow Hundred. He was solicitor to the Wolverhampton New Waterworks Company, to the board of guardians of Wolverhampton, and to the overseers of Wolverhampton, Willenhall, and Wednesfield Board of Health, and until recently the responsible adviser of the Government Inspector of Mines for WorNOTES AND QUERIES ON cestershire and South Staffordshire, and was POINTS OF PRACTICE. besides solicitor to many important iron companies, and also to many of the leading iron N.B.-None are inserted unless the name and address of the masters of the district. In the Wolverhampton Chronicle of the 30th ult. we observe in a speech of Lord Dartmouth, at the distribution of prizes of the 46th Staffordshire Rifle Corps, the following remarks: "He deeply regretted that their old friend, the late Mr. Bolton, was no longer among them; for. differing as he did in his political as well as religious views, he yet came forward in a most generous, hearty, and hospitable manner, and extended his hospitality to them at his own house; and there must be but one opinion, and all must regret they had lost so kind and consistent a friend as the late Mr. Bolton." The body was brought from Llandudno, and the next day buried in the Roman Catholic burial-ground attached to the same, mortgages his copyhold property to B. for the Catholic church at Brewood, when a solemn securing 8001. The deed of covenants contains a power of sale, and also a covenant by the mortgagor for pay-requiem was sung by the vicar-general, assisted ment of the 8001. It is proposed to stamp the surrender by the clergy of the district. with 20s. od. val. duty, but a question has arisen as to universally respected, and is much regretted by whether the deed of covenants ought to be stamped the town and neighbourhood. with a 108. stamp under the title "Covenant" in the table of stamp duties; or with a 20s, ad valorem stamp as being a deed made as an additional or further security under the title "Mortgage" in the same table. In the case of Sellis v. Trevor and another, 12 L. J., N. S., 401, Ex. (which was decided under the old Stamp Act), it was held that the deed of covenants was sufficiently stamped with the ad. val. duty, and that it did not require a 35s. deed stamp. I shall feel obliged if any of your experienced readers will favour me with their views on the subject, and refer me to any modern case bearing on the question. In the case cited, Rolfe, B. seemed to think that the surrender and deed of covenants constituted but one mortgage. Leasehold specifically bequeathed, executor withholds assent, and sells to pay his debts. The estate is notwithstanding insolvent. What should the purchaser of the leasehold require in the shape of succession or legacy returns, to be able to show on a re-sale, a title clear of any claim for duty? And what, in case the sale of the leasehold had left a surplus after payment of debts? S. B. 37. MORTGAGE OF COPYHOLDS-STAMP.-A., by a conditional surrender and deed of covenants accompanying 38. ENROLMENT OF ENFRANCHISEMENT DEED.-IS it usual to enrol enfranchisement deeds? If not, should the purchaser bear the expense on a sale? S. R. G. 39. WILL.-G. C., a mortgagee in fee by his will, gave and devised certain premises, "and all other his real estate," to his wife and her assigns for her life, and after giving certain pecuniary legacies, gave and bequeathed "all the residue of his ready money, money at the bank, and in the stocks, funds, railway shares, and other securities, and all other his personal estate whatsoever and wheresoever," unto his trustees upon trust for investment and conversion. No further mention of the real estate is made until we come to these words: "And upon trust for his said trustees after the death of his said wife, to pay the dividends, interest, and proceeds of the remainder of his said capital, stock, and the rents of his said houses, land, and real estate unto A. B. for his life, and upon his decease to pay, assign, or convey to C. D. and E. F., their heirs, executors, administrators, or assigns, the whole of the said real and personal estate, provided always, and said testator thereby empowered, his said trustees at such time as they should think fit after the decease of his said wife, to sell and dispose of all his real estate and the proceeds should be paid "as therein directed." The members of this society held their first meeting of the session on Monday evening, the 11th inst., in the Committee-room of the Literary and Philosophical Society, when Wm. C. Bousfield, Esq., solicitor, delivered an excellent and instructive lecture on "The Arrangement Clauses of the Bankruptcy Act of 1861, and the effect of the Act of 1868 upon the working of them." A vote of thanks to the lecturer brought the proceedings of the meeting to a close. WORCESTER AND WORCESTERSHIR At the general annual meeting of this society, held in the library 7th Jan. 1869, Mr. Allen, VicePresident, in the chair; Mr. Beale, Mr. Bedford, Mr. Bird, Mr. Crisp, Mr. Corbett, Mr. R. P. Hill, and Mr. Hughes were present. Letters from Mr. J. Stallard (President), and Mr. Southall, regretting their inability to attend, were read. The following report was read by the secretary: The "Your committee in presenting their annual report for the past year feel gratified to refer once more society during that period. In the course of the to the steady progress which has been made by the past year there has been an increase of nine members and subscribers, making the present total of members and subscribers seventy-three. number of books taken out during the past year is a satisfactory proof of the value of the library, and that it is duly appreciated by the members. The number of books taken out during 1867 was 487, whilst during the present year 621 volumes (exclusive of weekly publications, which constant reference), has been taken out, showing are in an increase of 134 volumes. The attendance of members and subscribers at the library for the purpose of referring to books has also been greatly on an increase. Having regard to these facts and looking to the present position of the society, your committee have given their best attention to the subject of adding new works to the library and the careful selection of them, regard being had to the wants and requirements of the several branches constituting its members and subscribers. The outlay in this respect has been quite as great as your committee could venture to sanction, being 431. 16s. 1d. (after a liberal discount deducted), and upwards of 91. for binding, showing an expenditure in this item of 531. 16s. 1d., from which may be inferred how strongly your committee were disposed to view the importance of the subject. The attention of Parliament during the past session having been so largely taken up with great political questions few measures of importance to the legal profession have been introduced, and none upon which it appeared necessary for your committee to take action. The annual dinner took place at Hadley Bowling-green, on the 17th July last, at which the society was, as at the previous dinner in October, again favoured with the presence of members of the Bar; but your committee have to express their regret at the small attendance of their own members on these occasions, and they recommend that in future the half-yearly meeting in July should be held previous to the day of dining, so as to enable the committee to fix a time and place for the purpose which may as far as possible meet the convenience and arrangements of The committee feel pleasure in acknowledging the presentation of several books and publications by members and others. Arnault, director of the Hippodrome, who had brought out a rival tightrope dancer under the same denomination. fact, the name does not belong to either of the men, that of the hero of the Niagara Falls being Gravelet, and of the pretender, Corelly. The tribunal first applied to, however, considering that the former had acquired a certain notoriety in different countries under the appellation in question, and that Arnault, in announcing the appearance of Corelly as Blondin, was committing an act of unfair competition, had condemned him by default to pay to Gravelet 10,000f. as damages. fresh trial the sum was reduced to 500f. Arnault again appealed, but the Imperial Court now confirmed that decision, and condemned the director of the Hippodrome to the payment of all the costs. FATAL ENCOUNTER BETWEEN TWO LAWYERS. -The St. Joseph Herald of Dec. 24 gives the following account of a fatal encounter in that city between two lawyers of the St. Joseph bar, Messrs. A. T. Green and Joseph I. Early. For some time past angry feelings had existed between these two men, which have well-nigh culminated, at times, in an encounter. The immediate cause of the present meeting was the publication in this paper of two communications, one on Tuesday and the other on Wednesday last. The former was brought to this office by Mr. Early, and the latter by Mr. Green, both lawyers, and each recently connected with the editorial department LUCAS, HENRY, out of business, Woburn-mews west, Russell-sq. of a newspaper-one published in Nebraska and one in this city. The facts, as we gather them from Mr. Everett and other eye-witnesses, are briefly these -About four o'clock yesterday afternoon the two met on Francis-street, a little west of Fourth. Mr. Early immediately told Mr. Green that he must retract the article published in the Morning Herald, or prepare to defend himself. Mr. Green refused to retract, when Early struck him-some say with a revolver, and others insisting that he first threw away the revolver, after being informed by Mr. Green that he was unarmed at any rate, his revolver was soon dropped or thrown upon the ground, and they clenched. Mr. Everett, who heard the scuffle from his law office, called to Mr. Lucien E. Carter, a brother lawyer, and both hurried to the street, where they saw the two in close conflict, Mr. Early standing on the kerbstone and Mr. Green in the gutter. Early had Green by the hair with one hand, and was kicking and striking him. Mr. Everett and Mr. Steele, a citizen who chanced to be passing by, at once interfered, and separated the combatants. As soon as released, Early snatched a heavy cane from Green's arm, and struck him a severe blow on the head. Early then faced Green, declaiming in a menacing manner, and shaking the cane at him. Green straightened up, drew a small Smith and Wesson revolver, and fired at Early, the ball striking him in the left breast. Green held out the revolver, as if about to shoot again, when Mr. Everett hastily snatched it from his hand. Green then walked to his office in an adjoining block.
