Aliens ordered deported but detained as witnesses.
Under the provisions of the act of March 3, 1903, expenditures on
account of persons who have been ordered deported, but who
are detained as witnesses for the Government, must be lim-
ited to expenses for their maintenance and the necessary
expenses of their detention, and therefore the payment to
such persons of a per diem in the nature of witness fees is not
authorized. 727.

Bannock Indians, appropriation for particular employees for.
Under the provisions of section 4 of the act of April 21, 1904, the
appropriation for particular employees for the Bannock In-
dians may be used by the Commissioner of Indian Affairs,
subject to the approval of the Secretary of the Interior, in
payment of other employees for said Indians not specifically
appropriated for, without the direction of the President and
the consent of said tribe. 652.
Claim, constable, for boarding escaped prisoner. See MARSHAL, constable.
Delaware Indians, appropriation for.
The phrase "Delaware tribe of Indians residing in the Cherokee
Nation," as used in the act of April 21, 1904, which made an
appropriation to pay certain claims of said tribe, includes only
such Delaware Indians, by blood or adoption, and their
descendants, as elected under the treaty of 1866 to preserve
their tribal relations. 496.

Per capita expenditure for support of Indian schools.
Under the terms of the appropriations made in the act of March
3, 1903, for the support of certain Indian schools, said schools
are not authorized to spend in excess of $167 per capita per
annum for the support and education of its pupils, except
when the attendance is so reduced by epidemic, accident, or
other sufficient cause as to render a larger per capita expendi-
ture absolutely necessary. 222.

Claim for refundment of tax on specific legacy.
A claim for the refundment of an internal-revenue tax paid,
under the act of June 13, 1898, on a specific legacy, or on a
contingent beneficial interest, which had not become vested,
of a legacy or distributive share of personal property passing
by will or the intestate laws of any State or Territory, must,
under the provisions of section 3228, Revised Statutes, be
presented within two years from the date the tax was paid.

Claim, reconsideration of, to correct error of law.
The Commissioner of Internal Revenue is authorized to recon-
sider and allow a claim which he had, through error of law,
previously rejected. 676.

Refundment of stamp tax on export bills of lading. See APPROPRIATIONS,

Refundment of stamp taxes illegally collected on export bills of lading.
Claims filed under the act of June 27, 1902, for the refundment of
sums illegally assessed and collected for documentary stamps
used on export bills of lading are not claims for the redemp-
tion of documentary stamps, within the meaning of the act of
June 30, 1902, which limits the time in which such claims
may be filed. 472.

ISTHMIAN CANAL COMMISSION.
Advertising for supplies and letting of contracts.
The provision in section 3709, Revised Statutes, relative to adver-
tising for supplies and the letting of contracts is applicable to
work done in connection with the construction of the canal.

Allotment of pay by employees.
The allotment or assignment of pay by employees of the Isthmian
Canal Commission is not authorized. 36.
Local revenues of Canal Zone.
The local revenues of the Isthmian Canal Zone are not such
moneys as are required to be accounted for to the Treasury
Department, but said revenues are to be accounted for in such
manner and under such rules and regulations as the President
and the Canal Commission shall prescribe, a report of the
same being made to the President and to Congress, as re-
quired by the act of June 28, 1902.

Transportation of remains of deceased employee.
The provision in the act of June 7, 1897, that "hereafter the
heads of Departments shall not authorize any expenditure in
connection with transportation of remains of deceased em-
ployees, except when otherwise specifically provided by law,"
has no application to the Isthmian Canal Commission, and
said Commission is therefore authorized to contract with its
employees for the payment, as a part of their compensation,
of the expenses of transporting their remains, in the event of
their death, to their homes in the United States. 775.
