Deutschland. nach Artikel III des zwischen Grossbritannien und dem Kongostaate unter dem Nr. 10581. 12. Mai d. J. abgeschlossenen Uebereinkommens von den vertragschliessenden 11. Juni1894. Theilen beabsichtigt; denn die daselbst als „lease" bezeichnete Ueberlassung eines Landstreifens kommt bei der Unbestimmtheit der Zeitdauer und ihrer unabsehbaren Ausdehnung im Effekt einer völligen Abtretung gleich. Hierdurch würden die Rechte des Deutschen Reiches beeinträchtigt werden und die vorerwähnte Abmachung seiner Zustimmung ebenso bedürfen, als wenn die Ueberlassung des Streifens durch Cession erfolgt wäre. Der Charakter dieser Ueberlassung wird dadurch nicht geändert, dass die Königlich Grossbritannische Regierung sich bezüglich dieses Landstreifens dem Deutschen Reiche gegenüber verbindlich macht, die hierüber vertragsmässig bestehenden Verpflichtungen des Kongostaates zu übernehmen. Das ist schon nach den Grundsätzen des internationalen Rechts selbstverständlich und folgt übrigens auch ausdrücklich aus dem zwischen dem Deutschen Reiche und dem Kongostaate geschlossenen Vertrage vom 8. November 1884, wonach im Fall einer Cession der Erwerber in die Pflichten des Kongostaates gegenüber dem Deutschen Reiche einzutreten hat. || Hiernach ist zu den Abmachungen in Artikel III des Abkommens vom 12. Mai d. J. die Genehmigung Deutschlands erforderlich. [ Diese Genehmigung wird seitens der Kaiserlichen Regierung erst ertheilt werden, nachdem ihre durch jenes Abkommen verletzten Interessen ihre volle Befriedigung erhalten haben werden. Bereits bei den Verhandlungen, welche zu dem Deutsch-Englischen Abkommen vom 1. Juli 1890 geführt haben, hat Deutschland den von seiten Grossbritanniens gestellten Wunsch auf Ueberlassung eines derartigen Streifens zurückgewiesen, weil dadurch seine politische Lage verschlechtert und seine unmittelbaren Handelsbeziehungen zum Kongostaate unterbrochen werden würden. Diese ungünstige Lage Deutschlands wird unter allen Umständen herbeigeführt, gleichgültig, ob sich der an Grossbritannien überlassene Streifen unmittelbar an der Deutschen Grenze befindet, oder sich von ihr einige Kilometer entfernt hält. Durch den Artikel III des mehrerwähnten Abkommens wird der Versuch gemacht, zur Benachtheiligung Deutschlands den im Jahre 1890 nicht erreichten Zweck zu verwirklichen. | Aus diesen Gründen hat die Kaiserliche Regierung gegen das Abkommen vom 12. Mai d. J. Einspruch eingelegt; sie wird dasselbe nicht eher anerkennen, bis ihre dadurch verletzten Rechte und Interessen volle Genugthuung erfahren haben. Hatzfeldt. Nr. 10582. DEUTSCHLAND. Juni 1894. of the 12th May, that Article may be withdrawn. || Her Majesty's Government are willing to meet the King's wishes in this respect. || The object and effect of the Article appear to them to have been greatly misunderstood at Berlin. By the provisions of Article IV, the projected lease was sedulously divested of all political significance. It could only have been used for the purpose. for which it was intended, namely, to give to Great Britain the means of constructing, maintaining and protecting, at her own expense, a line of telegraph, and eventually a road, connecting her East African territories with those within. her sphere of influence to the north of the Zambesi. || Such a road could not have diverted nor impeded the communications between the German East African possessions and the Congo State; and Her Majesty's Government would have been perfectly willing at any time to do all that was in their power to facilitate such communications across the strip of territory leased to them. But the time for the construction of such a road has not yet come; and as regards the more immediate object, the construction of a telegraph line, there are provisions in Article V of the Agreement which will give facilities for its construction. || In these circumstances, while Her Majesty's Government. feel that the objections which have been raised to the Article are founded on a misconception, they consent to its withdrawal rather than that it should be a cause of misunderstanding between the Contracting Parties and the German Government. Your Excellency, || I have had the honour to discuss with you personally England. the contents of the note which you addressed to me on the 11th instant, stating the objections of the German Government to Article III of the agreement, signed on the 12th May last, between Great Britain and His Majesty the King of the Belgians, as Sovereign of the Independent State of the Congo, and protesting against the agreement on that account. || Her Majesty's Government have given those objections their most careful attention, and I propose to address to Her Majesty's Ambassador at Berlin some explanations of the views and objects of Her Majesty's Government in regard to the Article, which will, I hope, enable him to satisfy your Government that there was not, and could not have been, any intention of infringing the rights or injuring the interests of Germany. || But they would greatly regret, that such a matter should England. be allowed to become a cause of difference, or to impair, even for a moment, Nr. 10588. the friendly feeling happily existing between the two countries, and they are 26. Juni 1894 nebst An- Nr. 10589. lage habe ich mich beeilt zur Kenntniss meiner Regierung zu bringen. selbe nimmt mit Genugthuung und Befriedigung davon Akt, dass es bei Abschluss des Abkommens zwischen der Königlich Grossbritannischen Regierung und der Regierung des Unabhängigen Kongostaates vom 12. Mai d. J. nicht in der Absicht der Regierung Ihrer Majestät der Königin von Grossbritannien und Irland gelegen hat, die Rechte und Interessen des Deutschen Reiches zu verletzen. In dieser loyalen Erklärung der Königlich Grossbritannischen Regierung ist die Kaiserliche Regierung erfreut eine erneute Bürgschaft dafür zu sehen, dass die freundschaftlichen Bezichungen, welche bisher zwischen den beiden Reichen bestanden haben, auch in Zukunft fortdauern werden. || Indem die Kaiserliche Regierung von der neuen Vereinbarung zwischen der Königlich Grossbritannischen Regierung und der Regierung des Unabhängigen Kongostaates über die Aufhebung von Art.
