THE grave world events through which we have recently passed, the new ideas which have arisen from those events, and the duty which compels the present Mexican Government to act consistently with the progressive tendencies of the Mexican people, which themselves gave birth to the Government, have rendered it necessary for the Mexican nation to undertake the examination and revision of the Treaties concluded with various countries, with the object of modifying or renewing them so that they may conform to modern exigencies, while compatible with Mexican interests and aspirations. Consequently, after a careful examination of the Treaty of Friendship, Commerce and Navigation concluded between Mexico and China on the 14th December, 1899,* the President of the Republic has charged me to inform you that the United States of Mexico take advantage of the right conferred equally on the two High Contracting Parties by Article XIX of the same to terminate the Treaty after the expiration of one year from the date of the present note, which I beg you will consider as formal notification to that effect. The President of the Republic has likewise instructed me to inform you that the Mexican Government propose to strengthen the bonds of unchangeable friendship which exist between Mexico and the Republic of China by means of a new Treaty on similar lines, the bases of which they have commenced to study, and that they will receive with pleasure any suggestions your Government may see fit to make, in order to negotiate a new Treaty with the least possible delay. IN connection with their noticet in the Staatscourant of the 13th October, 1919, concerning the provisional continuation of the operation of the Declaration of the 12th July, 1892, regarding the provisional regulations of the commercial relations between the Netherlands and Spain, the Ministry for Foreign Affairs announce that the said Declaration and also the Declaration of the 13th November, 1899, § modifying the Declaration of the 12th July, 1892, have now been definitely denounced by the Spanish Government. IN connection with the Notice in the Official Gazette of the 4th January last respecting the Denunciation by the Spanish Government of the Declaration of the 12th July, 1892, concerning the provisional arrangement of the commercial relations between the Netherlands and Spain, the Ministry for Foreign Affairs notifies that it has been agreed§ between the Governments of the two countries to declare that the Declaration in question shall again be applicable for the period of three months as from the 20th March, 1921. EXCHANGE OF NOTES between the Netherlands and Spain concerning the Establishment of a Provisional Modus Vivendi between the two Countries.-Madrid, June 16/24, 1921.|| (No. 1.)-The Spanish Minister for Foreign Affairs to the Netherlands Minister at Madrid. (Translation.) Your Excellency, Madrid, June 16, 1921. IN your note of the 7th instant you recalled the fact that, in an interview which we had a few days previously, there appeared to be a possibility that, at the expiration of the Declaration of the 12th July, 1892, regulating the commercial relations between Spain and the Netherlands, a provisional modus vivendi could be arrived at pending the conclusion of a new Commercial Treaty. For that reason, your Excellency expressed a desire to know on what basis His Majesty's Government considered that such an Agreement could be arranged and when His Majesty's Government intended to commence negotiations for the conclusion of a definite Agreement. In reply to the first point, I have the honour to inform your Excellency that, in view of the short time which still remains before the 20th of this present month, which is the date of the expiration of the above-mentioned Declaration, I consider that the only feasible course for the moment is the * Date of publication in the Netherlands "Official Gazette." § Exchange of Notes of March 19/24, 1921, see "League of Nations Treaty Series," No. 179. 66 ⠀ League of Nations Treaty Series," No. 180. negotiation of a provisional modus vivendi on the basis of the application to Datch goods by Spain of the duties provided for in the second column of the Spanish Customs Tariff of the 17th May last, as modified by the Royal Decree of the 3rd instant, in exchange for which the Netherlands would apply to Spanish goods the lowest tariff actually in force in that country. This régime could remain in force for a minimum period of three months, dating from the 20th instant, and might continue in force until one month after denunciation by either of the two Governments. I have therefore the honour to make to your Excellency a formal proposal to this effect. and, should the Government of Her Majesty the Queen of the Netherlands see their way to accept it, the present modus vivendi might be considered as concluded by the exchange of the present note and your Excellency's reply to it. With regard to the other point in your Excellency's note, I must inform you that it is not possible for His Majesty's Government to state at what date it will be possible for them to commence negotiations for the conclusion of a new Agreement of a more definite nature, because His Majesty's Government do not know when the Customs Tariff, which the Commission on tariffs and valuations is to discuss and which will serve as a basis for the negotiation of future commercial Treaties, will be completed. In my letter of the 7th June last I ventured to ask your Excellency to be so good as to inform me upon what conditions the Spanish Government intended to base its proposals to the Netherlands Government for the conclusion of a provisional modus vivendi regulating commercial relations between the two countries. In reply, your Excellency informed me in your communication No. 56 of the 16th instant that, having regard to the impending expiration on the 20th June of the Declaration of the 12th June, 1892, which deals with this matter, you considered that there was barely time to set on foot negotiations with a view to concluding a provisional modus vivendi adopting as a basis an undertaking on the part of Spain to allow goods of Dutch origin to enter Spain subject to the application of the second column of the Spanish Customs [CXIV] 3 L Tariff of the 17th May, 1921, together with the modifications thereto contained in the Royal Order of the 3rd June, 1921. In return the Netherlands would apply to Spanish goods the minimum tariff at present in force. According to your Excellency's proposal, this régime would be applicable for a period of three months beginning on the 20th June, 1921, and would remain in force until denounced by either Government and for a period of one month after denunciation. I duly telegraphed your Excellency's proposal to the Foreign Minister at The Hague, and I have the honour to inform you that I have just received a telegram stating that the Government of Her Majesty the Queen of the Netherlands accepts the above-mentioned proposal made by His Catholic Majesty's Government. PRELIMINARY AGREEMENT between Norway and Russia for the Resumption of Trade and Commerce between the two Countries pending the Re-establishment of normal Diplomatic Relations.-Christiania, September 2, 1921.* [Ratified by Russia, September 19, and by Norway, THE Royal Norwegian Government and the Government of the Russian Socialist Federated Soviet Republic, who are both desirous that, pending the re-establishment of normal diplomatic relations, trade and commerce between the two countries should be forthwith resumed, have concluded the following preliminary Agreement: ART. I-(1.) The Norwegian Government agrees to grant free admittance to a Delegation of the R.S.F.S.R. Government, consisting of one or several authorised official representatives (head of the Delegation and his official assistants) and several trade agents and their staff of secretaries, experts, translators, clerks, &c. The R.S.F.S.R. Government, on the same conditions, grants admission to a Delegation of the Norwegian Government. The number of official representatives and trade agents shall be mutually agreed upon. (2.) Provisionally the number of the members of each Delegation, together with the said staff, coming from Norway and Russia, respectively, is fixed at twenty, this number being subject to increase by mutual agreement. * Official English text.
