The merchants, seamen and other subjects of Sweden and Norway, shall be under the superintendence of the appropriate Officers of their Government.

If individuals of either nation commit acts of violence and disorder, use arms to the injury of others or create disturbances endangering life, the Officers of the two Governments will exert themselves to enforce order and to maintain the public peace by doing impartial justice in the premises.

Art. XXX. The superior authorities of Sweden and Norway and of China, in corresponding together, shall do so in terms of equality, and in the form of mutual communication (»chàu-hwui«). The Consuls and local Officers, civil and military, in corresponding together, shall likewise employ the style and form of mutual communication ( » chàu-hwui«). When inferior Officers of the one Government address superior Officers of the other, they shall do so in the style and form of memorial (shin-chin«). Private individuals, in addressing superior Officers, shall employ the style of petition (pinching<). In no case shall any term or style be suffered which shall be offensive or disrespectful to either party. And it is agreed that no presents, under any pretext or form whatever, shall ever be demanded of Sweden and Norway by China, or of China by Sweden and Norway.

Art. XXXI. Communications from the Government of Sweden and Norway to the Court of China shall be transmitted through the medium of the Imperial Commissioner charged with the superintendence of the concerns of foreign nations with China, or through the Governor General of the Liang Kwang, that of Min and Cheh, or that of the Liang Kiang.

Art. XXXII. Whenever ships of war of Sweden and Norway, in cruising for the protection of the commerce of the United Kingdoms, shall arrive at any of the ports of China, the commanders of said ships and the superior local authorities of Government shall hold intercourse together in terms of equality and courtesy, in token of the friendly relations of their respective nations. And the said ships of war shall enjoy all suitable facilities on the part of the Chinese Government in the purchase of provisions, procuring water and making repairs if occasion require.

Art. XXXIII. Subjects of His Majesty the King of Sweden and Norway, who shall attempt to trade clandestinely with such of the ports of China as are not open to foreign commerce, or who shall trade in opium or any other contra band article of merchandize, shall be subject to be dealt with by the Chinese Government, without being entitled to

any countenance or protection from that of the United Kingdoms; and the Government of Sweden and Norway will take measures to prevent their flag from being abused by the subjects of other nations as a cover for the violation of the laws of the Empire.

Art. XXXIV. When the present Convention shall have been definitively concluded, it shall be obligatory on both powers and its provisions shall not be altered without grave cause; but in as much as the circumstances of the several ports of China open to foreign commerce are different, experience may show that inconsiderable modification are requisite in those parts which relate to commerce and navigation, in which case the two Governments will, at the expiration of Twelve years from the date of said Convention, treat amicably concerning the same by the means of suitable persons appointed to conduct such negotiation.

The Tariff

of Duties to be levied on imported and exported merchandize at the Five Ports.

The Duties, which it is agreed shall be paid upon goods, imported and exported by Sweden and Norway at the Custom Houses of Canton, Amoy, Fuchow, Ningpo and Shanghai, are as follows; the articles being arranged in classes, viz:

Whereas it was provided by the Final Protocol signed at Peking on the 7th of September, 1901 (Article VI), that the existing Tariff on goods imported into China should be increased to an effective five per cent, and whereas it was further provided that all duties levied on imports ad valorem should be converted as far as feasible and with the least pos sible delay into specific duties, this conversion to be effected in the following manner:- The average value of merchandise at the time of landing during the three years 1897, 1898 and 1899, that is to say, the market-price less the amount of import duty and incidental expenses to be taken as the basis for the valuation of such merchandise:

have agreed and determined, on the basis aforesaid, upon the Tariff hereto appended together with certain Rules for the application thereof: and do hereby agree that the said Tariff and Rules shall be binding on the Governments and subjects of their respective Countries.

The Tariff and Rules aforesaid shall be binding on and after the date of the signature of the present instrument.

Should it be ascertained hereafter that any articles have been omitted from this Tariff which it is found can be conveniently provided for on a specific basis in terms of the Final Protocol of 1901, it is understood that the necessary additions shall be made at rates to be mutually agreed upon by Representatives of the various Powers by whom this Tariff has been signed.

It is understood that, in the event of there being any difference of meaning between the English and Chinese Texts of the Tariff and Rules, the sense as expressed in the English Text shall be held to be the correct sense.

The present Agreement has been drawn up in two identical copies and signed by the Special Commissioners of the Countries aforesaid. One copy shall be given to the Special Commissioner of Sweden and Norway and one copy shall be given to the Special Commissioners of China.

entre les Royaumes-Unis de Suède et de Norvège et l'Association Internationale du Congo.

Art. 1. Les Royaumes-Unis reconnaissent le pavillon de l'Association drapeau bleu avec étoile d'or au centre comme le drapeau d'un Etat ami.

Art. 2. L'association s'engage à ne prélever aucun droit d'importation ou de transit sur les marchandises ou articles de commerce importés par des sujets suédois et norvégiens dans les territoires actuels ou futurs de l'Association. Cette franchise de droit s'étendra aux marchandises et articles de commerce transportés par les routes, les chemins de fer ou les canaux qui sont ou seront établis autour des cataractes du Congo.

Art. 3. Les sujets suédois et norvégiens auront en tout temps le droit de séjourner ou de s'établir dans les territoires actuels ou futurs de l'Association. Ils jouiront de la protection accordée aux sujets ou citoyens de la nation la plus favorisée, y compris les sujets du Gouvernement de l'Association, en toute matière concernant leurs personnes, leurs propriétés, le libre exercise de leur religion, la revendication et la défense de leurs droits, ainsi que par rapport à la navigation, au commerce et à l'industrie. Spécialement ils auront le droit d'acheter et de vendre, de louer et bailler à ferme des terres, des mines, des forêts et des édifices situés dans les possessions de l'Association, d'y fonder des maisons de commerce et d'y faire le commerce et le cabotage sous pavillon suédois et norvégien.

Art. 4. L'Association s'engage à ne jamais accorder aucun avantage quelconque aux sujets d'une autre nation, sans que cet avantage soit immédiatement étendu aux sujets suédois et norvégiens.

Art. 5. Sa Majesté le Roi de Suède et de Norvège pourra nommer des Consuls ou autres agents consulaires dans les ports ou stations des territoires susdits de l'Association, et l'Association s'engage à les y protéger.

Art. 6. Jusqu'au moment où le service de la justice aura été organisé dans les dits territoires de l'Association, et où cette organisation aura été notifiée par elle, tout consul ou agent consulaire de Suède et de Norvège, qui y aura été dûment autorisé par le Gouvernement de Sa Majesté le Roi de Suède et de Norvège, pourra établir un tribunal consulaire pour l'étendue du district qui lui est assigné et, dans ce cas, exercera seul et exclusivement la juridiction tant civile que criminelle à l'égard des personnes et de la propriété des sujets suédois et norvégiens dans le dit district, conformément aux lois suédoises et norvégiennes.

Art. 7. Rien de ce qui est contenu dans l'article précédent ne dispense aucun sujet suédois ou norvégien de l'obligation d'observer les lois en vigueur dans les dits territoires de l'Association applicable aux étrangers, mais toute infraction de la part d'un sujet suédois ou norvégien à ces lois ne sera déférée qu'au tribunal consulaire suédois et norvégien.

Art. 8. Les habitants des dits territoires de l'Association, qui sont sujets de son Gouvernement, s'ils portent un préjudice quelconque à la personne ou à la propriété d'un sujet suédois ou norvégien, seront arrêtés et punis par les autorités de l'Association, conformément aux lois en vigueur dans les dits territoires. La justice sera rendue équitablement et impartialement des deux côtés.

Art. 9. Un sujet suédois ou norvégien ayant des motifs de plainte contre un habitant des dits territoires, sujet du Gouvernement de l'Association, s'adressera au Consulat de Suède et de Norvège et y exposera ses griefs. Le consul procédera à une enquête quant au bien fondé de la cause et fera tout ce qui est possible pour la régler à l'amiable. De même, si quelque habitant des dits territoires, sujet de Gouvernement de l'Association, avait à se plaindre d'un sujet suédois ou norvégien, le consul de Suède et de Norvège écoutera sa plainte et s'efforcera de régler la difficulté à l'amiable.

S'il surgit des différends de telle nature, que le consul ne puisse les régler à l'amiable, il requerra l'assistance des autorités de l'Association pour examiner la nature de la cause et la terminer équitablement.
