HER Highness the Princess Imperial of Brazil, Regent in the name of His Majesty the Emperor Senhor D. Pedro II, and His Majesty the Emperor of Germany and King of Prussia, in the name of the German Empire, having agreed on regulating by means of a Treaty the reciprocal extradition of criminals, appointed for that purpose their Plenipotentiaries, to wit: Her Highness the Princess Imperial, Regent of Brazil, Senhor Diogo Velho Cavalcante de Albuquerque, a member of His Majesty the Emperor's Council, Senator of the Empire, Commander of the Order of Christ, Grand Cross of the Order of Our Lady of the Conception of Villa Viçosa of Portugal, Minister and Secretary of State for Foreign Affairs, &c.; and His Majesty the Emperor of Germany and King of Prussia, M. Michelet von Frantzius, his Councillor of Legation, decorated with the Royal Iron Cross of Prussia of the White Ribbon, and with the Royal Cross of Merit of Bavaria of 1870-71, Knight of the Royal Saxon Order of Albert, and Chargé d'Affaires ad interim of the German Empire, &c.; Who, after having reciprocally communicated to each other their full powers, which were found to be in good and due form, have agreed upon the following Articles : ART. I. The High Contracting Parties bind themselves to deliver up, reciprocally, every individual who, in the cases provided for in the clauses of the present Treaty, may have been condemned or convicted in the territory of the party making reclamation, or those against whom a writ of arrest has been expedited by a competent authority, as principals or accomplices in the perpetration of one of the crimes or offences pointed out below: These crimes and offences are 1. Wilful homicide, or assassination; infanticide. 2. Polygamy, rape, violation, or stupration, provoked abortion. 3. Supposititious delivery, substitution, theft, concealment or abandonment of a child, so as to deprive it of all succour. 4. An attempt on the chastity of a woman with violence or threats, provided against by the laws of both the countries. 5. Illegal and wilful sequestration of the natural liberty of a man. 6. Wilfully hurting or wounding from which may arise an infirmity that appears incurable, permanent incapacity for labour, |
