Most Excellent Majesty King Edward the Seventh, and trade and commerce have vastly increased in Ibadan in recent years, and large numbers of British subjects and others have settled there:

Now therefore the Bale and Authorities of the Province of Ibadan for and on behalf of themselves their heirs and Successors and of the people of the Province of Ibadan do hereby agree and acknowledge that the hereinafter mentioned powers and Jurisdiction in the Province of Ibadan are vested in His Most Excellent Majesty Edward the Seventh of the United Kingdom of Great Britain and Ireland and of all British Dominions beyond the Seas King, Emperor of India, His Heirs and Successors that is to say :

1. Power and Jurisdiction over all persons not being natives of the Province of Ibadan for the repression and punishment of all crimes and offences.

2. Power and Jurisdiction for the Judicial hearing and determination of matters in difference where one or both of the parties to the suit is not a native of the Province of Ibadan.

3. Power and Jurisdiction for the administration and control of the property and persons of all persons not being natives of the Province of Ibadan.

4. Power and Jurisdiction over all persons whomsoever for the repression and punishment of the crimes of murder and manslaughter.

5. Power and Jurisdiction to execute and carry into effect the aforesaid powers and jurisdiction.

And the Bale and Council of the Ibadan Province for and on behalf of themselves their heirs and Successors and the natives of the Ibadan Province hereby declare that it is their strong desire that Barristers and Solicitors shall not be allowed to practise in the Courts exercising the civil jurisdiction herein before acknowledged.

And it is hereby understood and agreed between the parties hereto that all persons charged with committing indictable crimes and offences-the jurisdiction over which has been acknowledged by the treaty-shall be tried by a Judge of the Supreme Court of the Colony of Lagos with the aid of Assessors, the number of which shall not ordinarily be less than four and such Assessors may be Judges, Magistrates or Councillors of the Native Courts or other fit and suitable persons.

In witness whereof the said parties have hereunto set their hands and seals the day and year first above written.

SCHEDULE II.

Agreement made this 16th day of August, 1904, between His Excellency Charles Herbert Harley Moseley, Esquire, Companion of the Most Distinguished Order of Saint Michael and Saint George, Acting Governor and Commander-in-Chief in and over the Colony of Lagos for and on behalf of His Most Excellent Majesty Edward the Seventh of the United Kingdom of Great Britain and Ireland and of all the British Dominions beyond the Seas King, Emperor of India, His Heirs and Successors, of the one part, and the King Alafin of Oyo, and Head of Yoruba-land for and on behalf of himself his heirs and Successors and the people of Yoruba-land on the other part:

Whereas Yoruba-land lies adjacent to the Colony of Lagos and is under the protection of His Most Excellent Majesty King Edward the Seventh and trade and commerce have vastly increased in Yoruba-land in recent years, and large numbers of British subjects and others have settled there.

And whereas the Alafin of Oyo is King and Head of Yorubaland.

And whereas the Bale and Authorities of the Province of Ibadan have entered into an Agreement with the Governor of the Colony of Lagos dated the 8th day of August, 1904, acknowledging that certain powers and jurisdictions in the Province of Ibadan are vested in His Most Excellent Majesty King Edward the Seventh.

And whereas the Province of Ibadan forms part of Yoruba-land. And whereas the Bale and Authorities and people of the Province of Ibadan recognise the Alafin of Oyo to be King and Head of Yoruba-land:

And whereas it has been agreed that the said King Alafin of Oyo and Head of Yoruba-land should confirm and approve the aforesaid Agreement between the Governor of the Colony of Lagos and the Bale and Authorities of the Province of Ibadan, and should further acknowledge that certain powers and jurisdictions in Yoruba-land are vested in His Most Excellent Majesty King Edward the Seventh.

Now therefore the King Alafin of Oyo and Head of Yoruba-land for and on behalf of himself his heirs and Successors hereby confirms and approves of the Agreement dated the 8th day of August, 1904, entered into and concluded between His Excellency Charles Herbert Harley Moseley, Acting Governor of the Colony of Lagos for and on behalf of His Most Excellent Majesty King Edward the Seventh and the Bale and Authorities of the Province of Ibadan for and on behalf of themselves their Heirs and Successors, and the people of the Province of Ibadan a copy of which Agreement is annexed and signed as relative hereto.

And further the King Alafin of Oyo and Head of Yoruba-land for and on behalf of himself his heirs and Successors and of the
