CHAPTER XXXII.

MARINE DISCIPLINE.

1. This Ordinance may be cited as "The Marine Discipline Short title. Ordinance," and applies to the Colony and Protectorate.

5. 6. Any person serving in the crew of any ship who—
(1.) Having entered into an agreement to serve in the crew of
any ship, fails to enter upon his employment;
(2.) Deserts, or without leave or lawful cause absents himself
from duty;

(3.) Is intoxicated during working hours;

(4.) Refuses without reasonable excuse therefor to obey orders or the order of any person placed by his employer in authority over him;

(5.) Brawls or creates a disturbance after being warned by his employer or someone placed by his employer in authority over him to desist;

(6.) Uses abusive or insulting language, calculated to provoke a breach of the peace, to his employer or any person placed by his employer in authority over him;

(7.) Wilfully does any act tending to the loss, damage, or serious risk of his employer's property;

(8.) Refuses or omits, without reasonable excuse therefor, to do any act proper and requisite to be done by him for preserving his employer's property;

shall upon conviction be liable to a penalty not exceeding five pounds, or to imprisonment for a period not exceeding one month.

7. When a person is accused of any offence under this Ordinance, he may be tried in any place where he is or to which he may be brought.

8. Any proceeding under this Ordinance may be taken either by proceedings. the employer or by any person placed in authority over the person charged with any offence thereunder.

CHAPTER XXXIII.

WEST AFRICAN FRONTIER FORCE.

Establishment and Constitution of Southern Nigeria Regiment.

2. In this Ordinance, unless the context otherwise requires,

(1)

"Governor" includes any officer administering the govern-
ment of the Colony.

(2) "Officer" means an officer commissioned or in pay as an
officer in His Majesty's Imperial or Colonial Forces, or
any arm, branch, or part thereof. Warrant and other
officers holding honorary commissions are officers within
the meaning of this Ordinance.

(3)

"Non-commissioned officer" includes an acting non-com-
missioned officer, and a schoolmaster and an enlisted
clerk.

(4) "Soldier" does not include an officer as above-defined, but
includes every other person subject to this Ordinance
during the time that he is so subject.

(5) "Superior officer" when used in relation to a soldier, includes all officers and non-commissioned officers.

(6) Military decoration" means any medal, clasp, good conduct badge, or decoration.

(7)

"Military reward" means any gratuity for long service or
good conduct; it also includes any good conduct pay or
any other military pecuniary reward.

(8) "Enemy" includes all armed mutineers, armed rebels,
armed rioters, and pirates.

(9) "Private" and "Privates" wherever either of these words appears in sections 6, 9, 18, 19, 20, 22, 23, 27, 28, 29, 30 (b), 30 (c), 31, 56, 57, 58, 61, 63 and 64, shall include Artillery and Maxim-Gun Carriers, Grooms and Grasscutters who shall be subject to all the provisions set out and contained in the said sections and any amendments thereof.

(10) "District Commissioner " includes any Officer in charge of a District.

(11) "Colony" includes the Protectorate as limited and defined by His Majesty's Order in Council of the 16th day of February, 1906, or any Order adding to or amending the

same.

(12) "Unit" means battalion of Infantry or battery of Artillery.

3. This Ordinance is divided into four parts, relating to the following subject matters; that is to say:

PART I.-CONSTITUTION AND GOVERNMENT.

4. The Southern Nigeria Regiment of the West African Frontier Force shall consist of two battalions of Infantry, comprising such a number of companies, and one battery of Artillery, comprising such a number of sections as the Governor may from time to time direct.

5. The Southern Nigeria Regiment of the West African Frontier Force is charged with the defence of the Colony, with the maintenance of order, and with such other duties as may be from time to time defined by the Governor; and it shall be lawful for him

(a) At any time and for any such purpose as His Majesty, through one of his principal Secretaries of State, may direct, to order that the Regiment or any part thereof shall be employed out of and beyond the Colony:

(b) To order, on the recommendation of the commanding officer, that any non-commissioned officers or privates of the Regiment shall proceed to the United Kingdom for the purpose of undergoing instruction or training or for other duty or employment.

6. It shall be lawful for the Governor to appoint an officer with the rank of Lieutenant-Colonel to command the Regiment, and a sufficient number of officers, non-commissioned officers, and privates, who shall all stand with each other in order of precedence and command as they have been here named; also a pay and quartermaster, and such other officers or non-commissioned officers performing special duties as may be necessary; and the Governor may from time to time fill up all vacancies that may occur from removal, death, absence, incapacity, or other cause, by promotions or fresh appointments, and may at any time enrol fit men as privates of the Regiment, and every such enrolment shall be an appointment under this Ordinance.

9. 10. 11. 12.
