14. If any steam vessel shall be surveyed under the provisions of this Ordinance, and if the surveyors shall decline to grant any certificate of survey, or shall grant a certificate of survey with which the owner, agent or master of the steam vessel shall be second survey. dissatisfied, or if they shall disagree the Governor may, on the application of such owner, agent or master, and on his paying the amount of fee chargeable for the survey of the vessel, appoint two or more other competent surveyors to survey the said steam vessel.

15. The surveyors so appointed shall forthwith survey the said steam vessel, and shall either decline to grant any certificate of survey, or shall grant such certificate of survey as, under the circumstances, may seem to them proper.

16. If the surveyors appointed under section 14 unanimously refuse to grant any certificate of survey, or unanimously agree as to the terms of a certificate of survey granted by them, such refusal or such certificate of survey shall be final and conclusive; but if they do not agree, the refusal originally made, or the certificate of survey originally granted by the surveyors who surveyed the said steam vessel in the first instance, shall remain and be of full force and effect: provided that if the second survey which may be directed to be held under section 14 shall result in the grant of a certificate of survey as claimed by the owner the further fees paid shall be refunded.

17. If the surveyors appointed under section 14 decline to grant a certificate unless and until certain works required by them are done to their satisfaction, so soon as the work is done the steam vessel may be again surveyed by the same surveyors or by the other surveyors authorised under this Ordinance, who may grant or refuse a certificate at their discretion.

18. Every survey made under section 14 shall be made subject to all the provisions and rules, both as to the payment of fees and otherwise, which are applicable to surveys made in ordinary cases under this Ordinance.

19. No steam vessel liable to be surveyed under this Ordinance shall proceed to sea from or ply within the waters of the Colony or Protectorate except under the following conditions, that is to

say:

For ships proceeding to sea—

(1) In the case of steam launches there shall be on board for service a quarter-master and an engine driver.

(2) In the case of a steam vessel not exceeding 100 tons register there shall be on board for service a master, a boatswain, and a third class engineer.

(3) In the case of a steam vessel exceeding 100 tons but not exceeding 200 tons register there shall be on board for service a master, a boatswain, a second class engineer, and an engine driver.

(4) In the case of a steam vessel exceeding 200 tons but not exceeding 400 tons register there shall be on board for service a master, a mate, a second and a third class engineer.

(5) In the case of all steam vessels exceeding 400 tons register
there shall be on board for service a master, a first mate,
and a first and second class engineer.

For ships being used in the navigation of inland waters —
(1) In the case of steam launches there shall be on board for
service a quarter-master and an engine driver.

(2) In the case of steam vessels exceeding 50 tons but not
exceeding 200 tons register there shall be on board for
service a river-master, a quarter-master, a third class
engineer, and an engine driver.

(3) In the case of all steam vessels exceeding 200 tons register there shall be on board for service a mate, a quartermaster, a second class engineer, and an engine driver.

The certificates of competency of masters, mates and engineers Certificates required by this Ordinance shall be the certificates usually granted required. by the Board of Trade to such officers as being competent.

All river-masters, boatswains, quarter-masters, third class engineers and engine drivers shall satisfy a Board of not less than two officers appointed by the Governor to grant certificates of their competency.

20. 21. Whenever any explosion shall occur on board any steam Investigation vessel subject to survey under this Ordinance, it shall be lawful for in case of explosion. the Governor, if he shall think fit, to direct that an investigation of the cause of such explosion be made by such surveyors as he shall think fit. A surveyor or surveyors appointed under this Ordinance may enter into and upon such steam vessel with all necessary workmen and labourers and remove any portion of such steam vessel, or of the machinery thereof, for the purpose of such investigation, and shall report to the Governor the cause of such explosion.

22. Nothing in this Ordinance contained shall be held to apply to any vessel-of-war, transport, or steam vessel in the service of His Majesty's Government, or of any British Possession or Protectorate, or that of any foreign State, or to vessels holding passenger certificates granted under the Merchant Shipping Act, 1894, or to steam vessels carrying cargo only, or to vessels navigating the River Niger.

23. The tonnage in this Ordinance referred to shall, in the case of British registered steam vessels, be the registered tonnage: and in the case of foreign registered steam vessels, shall be the tonnage of such vessels as nearly as possible approximating to the registered tonnage as measured in British registered steam vessels.

24. The following expressions as used in this Ordinance shall have the meanings herein attached to them :

"Steam vessels plying with passengers means ships carrying for hire one or more passengers, but shall include branch boats carrying passengers from or to ocean steamers.

"The Merchant Shipping Act, 1894," includes any rules made thereunder, and any Act amending the said Act.

"Steam vessels " means steam vessels exceeding fifty tons. "Steam launches" means steam vessels not exceeding fifty tons. "Inland waters' means and includes all rivers, creeks and lagoons inside the river bars.

"River Niger" includes the River Niger and all its affluents, branches and outlets within the Protectorate.

25. It shall be lawful for the Governor in Council to frame management rules for the management of steam launches as to the number of passengers to be carried, the rules for lights at night, the rules for navigation, inspection and survey of hull, machinery and boilers, the manner of steering, rate of speed, and use of signals by steam whistle and otherwise in the harbours and rivers, and in going alongside ships and wharfs as well as at sea.

Any person infringing any rule made under this section shall be liable to a penalty not exceeding five pounds for each offence.

26. All offences against this Ordinance shall be summarily heard and determined by, and all penalties shall be recoverable before a Police Magistrate or a Commissioner of the District in which the offence shall have been committed, any provision to the contrary in the Supreme Court Ordinance notwithstanding.

27. Unless and until altered or revoked by rules made in manner to be in force above prescribed, the rules contained in Schedule C hereto shall be

Surveyors.

Section 9-Each Certificate of Survey granted by Surveyors under this Ordinance shall be hung up, and remain at all times
suspended, in some conspicuous part of the vessel, for which the same is granted, where the same may be easily read; and in
default of compliance with this provision, every Owner, Agent, Master, or other person in charge shall be liable to a penalty
not exceeding five pounds for every day or part of a day on which such certificate is not so displayed.

Section 10-No Certificate of Survey, granted under this Ordinance, shall be held to be in force for the purposes of this
Ordinance after the expiration of the time for which the same was granted. Provided that if any steam vessel surveyed under
this Ordinance is absent from the Colony and Protectorate when her Certificate of Survey last granted expires, no penalty
shall be incurred in the Colony or Protectorate for want of a Certificate of Survey, until she first begins to ply or is about to
ply after her next subsequent return to the Colony or Protectorate.

Section 11-The Governor may require any Certificate of Survey granted under this Ordinance which has expired, or has
been revoked or cancelled, to be delivered up as may be directed, and any Owner, or Agent, or Master or any other person
five pounds for each offence.
