2.-RULES FOR STEAM LAUNCHES. (SECTION 25.) 1. The number of passengers to be carried in steam launches shall be determined by the surveyors at their discretion, with due regard to the accommodation available, the number of the crew, and the service on which it is intended that the launch be used. 2. As a general rule, the number of saloon and deck passengers that may be carried will be determined by the following measure ments: Saloon. The clear area of cabin and deck space intended for the use of saloon passengers, divided by twenty-four, shall determine the number of saloon passengers that shall be allowed. Deck. The clear area of deck or well space intended for the use of deck passengers and crew, divided by six, shall determine the number of deck passengers and crew that shall be allowed. Gangways or passages less than two feet wide are not to be included in these measurements. In steam launches fitted with cockpits and which have shelters fitted over the cockpits, the top of which is sufficiently strong to carry passengers, the superficial area of the top of the shelter may also be measured and passengers allowed at the rate of nine square feet per passenger. The top of the shelter over one cockpit only is to be so measured. 3. The following deductions are to be made for cattle or cargo carried in the space measured for passengers : For every square yard of space measured for passengers . 4. Steam launches are to have two working anchors and cables, and if intended to go to sea, they shall be fitted with a compass properly adjusted. 5. Steam launches shall carry or tow one boat in readiness for immediate use. They shall carry at least two lifebuoys of approved pattern, and sufficient lifebelts, so that there shall be one for each person on board. 3. RULES FOR NAVIGATION IN INLAND WATERS. (SECTION 25.) 1. Steam launches, when meeting other steamers or vessels of any kind coming in the opposite direction, shall put their helms to port and keep to the right, or starboard side, of the channel, and shall blow one short blast on the steam whistle. 2. Steam launches, when under way at night, that is to say, between sunset on one day and sunrise on the day next succeeding, shall carry the usual lights prescribed by the Board of Trade, viz.:-A steaming (or mast-head) light, and a starboard and port light. 3. When a steam launch is overtaking another or any other vessel, the steam launch so overtaking shall pass on the starboard side of the vessel so overtaken. 4. A steam launch which is being overtaken by any other vessel going in the same direction, shall, if at night, show from her stern, to such overtaking vessel, a white or flare-up light. 5. Where the channel is too narrow to admit of one steam launch or other vessel passing another while going in the same direction, the overtaking steam launch or other vessel shall slow or stop her engines until a part of the channel is reached which will admit of her passing the other safely and without danger to either vessel. 6. Where two steam launches meet while going in opposite directions, and the channel is too narrow to admit of their passing one another, the steam launch proceeding with the tide or current shall have the right of way, the other stopping or reversing if necessary, in order to allow of the first mentioned steam launch proceeding on her way. 7. All steam launches when towing any description of craft (other than the usual dinghy), whether alongside or astern, shall carry, in addition to the lights mentioned in Rule 2, one other bright light below the steaming (or mast-head) light, such additional light to be not less than six feet below the mast-head light in a vertical direction. 8. All steam launches shall, when navigating in narrow and winding waterways, whether by day or night, proceed at a moderate speed, and on nearing the turning points blow one short blast with their steam whistles, and, if they should hear a similar whistle from another steam launch proceeding in the opposite direction, they should proceed as directed in Rule 6. 9. All steam launches, when navigating any of the inland waters and approaching any part of such waters where there is customary traffic of canoes or reasonable and probable cause to expect such traffic, shall give the usual and timely warnings on the steam whistle to indicate their approach and reduce speed as may be necessary to avoid any accident or distress to any canoe that may be passed. 10. In thick or foggy weather a steam launch having way upon her shall sound, at intervals of not more than two minutes, a prolonged blast on the steam whistle. 11. A steam launch under way, but stopped and having no way upon her, shall sound, at intervals of not more than two minutes, two prolonged blasts, with an interval of about one second between them. 12. These rules shall not apply to vessels navigating the inland waters of the Western Province (a). (a) See Schedule to the Inland Waters Navigation Ordinance, chap. 63, post. 4.-RULES GOVERNING THE TRANSHIPMENT OF PASSENGERS IN OPEN ROADSTEADS, AND SPECIAL EQUIPMENT REQUIRED BY STEAM VESSELS WHEN SO EMPLOYED. (SECTION 5.) 1. Every steam vessel which is employed in the transhipment of passengers in open roadsteads shall be required to carry at least two surf-boats specially equipped for this purpose. Such equipment shall include properly constructed bottom boards; two "mammy chairs" complete with slings, &c., and at least two spare paddles and one spare steering oar. 2. For each surf-boat so carried there shall be a competent crew of not less than ten paddlers and one steersman. Provided that if a steam launch is employed to tow any surf-boat the crew of paddlers may be reduced to six. 3. A ship's officer shall invariably accompany every such surfboat for the purpose of taking charge of the crew and generally superintending the transhipment of the passengers. 4. No baggage shall be carried in any surf-boat while it is being used for the transhipment of passengers, except in the case of small hand packages carried by passengers themselves. Provided that the deck passengers or others who may elect to travel in other boats with their baggage may be permitted to do so, and that reasonable care shall be taken of such passengers. 5. All baggage carried by steam vessels as above shall be stowed below hatches as soon as it is received on board, and remain there until required to be removed from the vessel; such hatches to be properly covered and battened down during rough weather or when crossing any bars. Reasonable care is to be taken in the transhipment of baggage by means of surf-boats, and tarpaulins are to be provided and used to cover such baggage when the state of the weather or sea requires it. 6. Steam vessels employed on this service are to be fitted with proper gangway doors, which are always to be kept shut when the vessel is under way. CHAPTER LXI. LICENSING OF BOATS. (No. 6-1900.) tion. 1. In this Ordinance, unless the context otherwise requires, the Interpretafollowing expressions have the meanings hereby assigned to them, that is to say— "Boat" shall include any canoe, boat, lighter, raft, or any other craft of whatsoever kind or description which is not propelled by steam, electricity, oil, or gas, employed in the harbour of Lagos or upon any of the inland waters of the Colony or Protectorate. "Inland waters" shall include all rivers, creeks, and lagoons inside the river bars of the Colony and Protectorate. (1 of 1907, s. 2.) 2. The owner of every boat plying for hire, or carrying pas- Licenses to be sengers, goods or merchandise, shall within ten days of January 1st taken out of each year, or if the boat shall have been acquired subsequently yearly. to the 1st day of January, then within ten days of such acquirement, register and take out a license for such boat in accordance with the provisions of this Ordinance. (3 of 1866, s. 1, part.) 3.—(1) The Harbour Master or such other officer as may be Registration from time to time appointed by the Governor (hereinafter called and licensing the Licensing Officer) shall have the superintendence of all matters provisions. relating to the registration and licensing of boats in the Colony and Protectorate. (2) The registration and licensing of boats shall be under the immediate control of the Licensing Officer in the Lagos District and under the immediate control of the District Commissioner in every other district. 4. The Licensing Officer shall cause a register to be kept in Register to be each district which shall contain (a) The name and address of the owner of every boat registered under this Ordinance, such names and addresses to be numbered consecutively in each district; kept. License to bear name and address (b) The number of the license issued (if any) in respect thereof, and the date of the issue thereof; (c) Any further particulars which the Licensing Officer may consider advisable. 5. Every boat, prior to its being placed on the register and a license being issued in respect thereof, shall in the Lagos District be examined by the Licensing Officer or some person deputed by him, and in every other district by the District Commissioner or some person deputed by him, who, after satisfying himself that the boat is in a seaworthy condition, shall give to the owner a certificate to that effect. A fee of one shilling shall be paid by the owner of every boat in respect of such certificate. 6. Upon production of the certificate referred to in Section 5, the owner of the boat shall be entitled to have his boat registered in accordance with the provisions of Section 2 of this Ordinance. 7. The Licensing Officer in the Lagos District, or the District Commissioner in every other district, shall grant to the owner of of owner and every boat which has been registered as aforesaid a license, which shall bear upon the face of it number of boat. Change to be notified. Penalty. Fees. Name to be painted on boat. (a) The name and address of the owner; (b) The number under which the boat is registered. Every change of address of an owner or change of owner shall be reported to the Licensing Officer in the Lagos District and the District Commissioner in every other district by the owner of the boat, and such change shall be noted in the register. 8. Every owner who omits, within one month of any such change, to report the same to the Licensing Officer in the Lagos District, and the District Commissioner in every other district, shall be liable on conviction in a summary manner to pay a fine of two pounds, or in default thereof to imprisonment for one month with or without hard labour. 9. (1) There shall be payable in respect of every license issued under this Ordinance a fee of ten shillings. (2) Every license shall bear on the face of it the date of its issue, and shall expire on the 31st day of March following. (3) Every license shall be signed by the Licensing Officer or the District Commissioner issuing the same. (4) Every license purporting to be signed as above shall, in the absence of any evidence to the contrary, be received in evidence without proof of signature. 10.--(1) Every licensed boat shall have the name of the owner, the number of the license for such boat, and place of issue of |
