ORDERS and RULES.

1.-FLAG SHOWN WHEN SHIP IN CHARGE OF PILOT.

On any ship entering or leaving the Harbour, or changing her Flag "H" berth within the Harbour in charge of a Pilot, the Master of such to be flown when ship in ship shall see that flag H of the International Code of Signals is hoisted in some conspicuous part of such ship, and that the said flag is kept so hoisted from the time of such Pilot's taking charge of such ship until his services are dispensed with, and such ship properly moored and secured. Any Master guilty of a contravention of this Rule shall incur a penalty not exceeding twenty pounds. (13th July, 1886.)

2.-RULES FOR PILOTS (3RD NOVEMBER, 1887).

1. All Pilots shall, when navigating the channel over the Bar Soundings: into or out of the Port, pay strict attention to the soundings; they lead lines. shall provide themselves with, and use, properly marked lead lines and have them examined from time to time.

report shall be made within 48 hours of the discovery of such changes, &c., being observed. And all such Pilots shall also send to the Harbour Master, at the end of each month, a monthly report in such form as the Harbour Master may direct, and containing such information as he may require, and shall include therein all such changes as aforesaid as may have taken place. (Amended 28th February, 1905.)

3. A tide gauge will be placed inside the Bar near to the Signal Station, and will be under the supervision of the beach signal man, who will signal the rise and fall of the tide as follows:-Commencement of rise N flag hoisted half mast; high water N flag mast-headed and kept there until the water begins to fall.

4. All Pilots shall make passage over the Bar at least three times within the month, or their licenses will be suspended, and they will be compelled to pass a fresh examination before their licenses are renewed.

5. Pilots will produce their lead lines for examination whenever called upon to do so by the Harbour Master.

6. Pilots will observe the Rules, which have been in operation since 1st of June, 1863, for navigating narrow waters as laid down by the Board of Trade; such Rules can be seen at the Harbour Master's office during office hours. One steamer or sailing vessel when approaching another coming in the opposite direction, will keep on that side of the fairway or channel which is on her own starboard hand.

7. In thick or foggy weather, every steamer proceeding outwards will give one blast of the steam whistle at intervals. Every steamer entering the Port will give two blasts at intervals.

8. In all cases where two or more steam or sailing vessels are making for the Bar the following rules shall be observed :—

(a) Every vessel outward bound shall hoist signal P and Code Pennant between Wilmot Point and North Bruce Buoy. If such signal be repeated at the Signal Station the outward bound vessel shall proceed, otherwise it shall wait until the signal is repeated.

(b) Every vessel bound for the Port shall hoist signal R at the Fairway Buoy. If such signal be repeated at the Signal Station the vessel shall proceed inwards, otherwise it shall wait until the signal is repeated.

(c) Every vessel bound for the Port having on board European mails shall hoist the signal R.E.W. at the Fairway Buoy. If such signal be repeated at the Signal Station the vessel shall proceed inwards, otherwise it shall wait until the signal is repeated.

In the event of an outward bound vessel and a vessel bound for the Port making for the Bar at the same time, the vessel whose signal is not repeated shall wait until the signal of the other vessel has been hauled down and its own signal hoisted at the Signal Station. (29th August, 1905.)

9. If any Pilot commits a breach of any of the foregoing Rules, Penalties. he shall for such breach incur a penalty not exceeding the sum of 407., to be recovered as provided under Section 58 of the Lagos Pilotage and Harbour Ordinance; and such Pilot shall be liable to have his license suspended or revoked by the Governor.

10. Nothing in these Rules shall exonerate any ship or the Ordinary Master or Pilot thereof in charge at the time from keeping a proper precautions look out, or of the neglect of any precaution which may be required by the ordinary practice of seamen, or by the special circumstances of the case.

3.-CARRIAGE OF GUNPOWDER (31ST AUGUST, 1888).

1. Subject to the provisions of the Lagos Pilotage and Harbour Ordinance, every ship laden, or partly laden, with gunpowder shall, immediately upon entering the Harbour, be moored in the lagoon, clear of the channel for steamers, at a distance of not less than 200 yards, nor more than 300 yards, from Magazine Point, to the west thereof, and at a distance of not less than 500 yards, nor more than 800 yards, from the Powder Magazine, in a south-westerly direction therefrom.

2. Any boat laden, or partly laden, with gunpowder may, upon receiving permission in that behalf from the Harbour Master, proceed to, and remain in, the immediate vicinity of the Powder Magazine, when open, for the purpose of discharging gunpowder; and any boat whatever may, upon receiving the like permission, proceed to, and remain in, the immediate vicinity of the Powder Magazine, when open, for the purpose of loading gunpowder; provided that no boat laden, or partly laden, with gunpowder shall remain in the immediate vicinity of the Magazine, when open, longer than shall be absolutely necessary for the purpose of discharging or loading gunpowder; provided also that, without special permission received in that behalf from the Harbour Master, not more than one boat laden, or partly laden, with gunpowder shall be in the immediate vicinity of the Powder Magazine at one and the same time.

3. Subject to the last preceding Rule, every boat laden, or partly laden, with gunpowder shall, immediately upon entering the Harbour, be moored at the entrance of Five Cowry Creek, not further than 20 yards from the tripod placed there with a barrel on its top painted red.

4. Every boat which shall have proceeded to the immediate vicinity of the Powder Magazine for the purpose of discharging or loading powder, but which shall not have completed such discharge or loading before the closing of the Powder Magazine, shall proceed or return, as the case may be, to the mooring-ground appointed by No. 3 of these Rules, and shall remain there, until the Powder Magazine be again opened.

5. Subject to the provisions of the said Ordinance and No. 2 of these Rules, no gunpowder shall be put on board any ship or boat,

unless such ship or boat be moored as directed by No. 1 or No. 3 respectively of these Rules; and no ship or boat which shall have received gunpowder on board shall be afterwards moored at any other part of the Harbour, but shall leave the limits thereof with the least possible delay.

6. Subject to No. 2 of these Rules, no boat laden, or partly laden, with gunpowder shall call or touch at, or come alongside of, any wharf or place on the Island of Lagos.

7. Every boat laden, or partly laden, with gunpowder shall, while passing round the Island of Lagos, fly, and keep flying, a B flag.

8. No person on board any boat laden, or partly laden, with gunpowder shall smoke, or shall light, or keep lighted, or permit to be lighted, or kept lighted, any light or fire.

9. Any person infringing any of the above Rules shall be liable to a penalty not exceeding forty pounds, and such penalty may be enforced in every respect in the same manner as is provided for the recovery of penalties in the said Ordinance.

10. Nothing in these Rules contained shall enure to limit or otherwise to affect the liability of any person to any penalty under the said Ordinance.

11. In these Rules:

"The Harbour" means the Harbour of Lagos, and includes the foreshore thereof;

"The Harbour Master" includes every Officer appointed by the Governor to perform the duties of Harbour Master of Lagos, or lawfully acting as such;

"The Powder Magazine" means the existing powder magazine near Five Cowry Creek;

"Ship" includes every description of decked vessel used in navigation, exclusively of ships belonging to His Majesty or any Foreign Government; and

"Boat" includes canoe and every description of undecked, or not fully decked, vessel used in navigation.

4.-LIMITS OF THE HARBOUR DEFINED.

The limits of the Harbour of Lagos shall be the following:Within a line drawn from a point one and a quarter miles due Magnetic South from the Light House to the Light House, thence proceeding along the foreshore to the entrance of the Abekun Lagoon, thence to Apapa Point, thence following the foreshore to the mouth of the Agboyi Creek, thence proceeding in a straight line from the right bank of the Agboyi Creek to the land at Kuramo Island touching the most easterly point of Lagos Island, thence following the southern foreshore of Five Cowry Creek and the eastern foreshore of the main Lagoon to the Signal Station, thence to a fixed Harbour limit mark near the Signal Station,

thence due Magnetic South Seaward one and a half miles, and thence in a westerly direction to the point first herein before mentioned, excluding the Island of Lagos and Iddo Island. (11th October, 1897.)

5.-FISHING STAKES RULES. (10th November, 1898.)

1. Every applicant for the grant of a license to erect, maintain and work stakes in the Harbour of Lagos shall in the first instance furnish the Harbour Master with particulars of the place and the number of the stakes in respect of which he is applying for a license.

2. Upon being satisfied that the place is available and is a fit and proper site for the erection, maintenance and working of such stakes the Harbour Master shall issue a certificate which shall be in the form A. in the Schedule to these Rules.

3. Upon the presentation of such certificate, and, in the case of persons other than those entitled to a license without payment under Section 49 of the Ordinance upon payment of the fee, if any, prescribed by the Governor in Council, the Provincial Treasurer shall grant a license which shall be in the form B. in the Schedule hereto.

4. No license for the erection, maintenance and working of stakes shall be transferable.

5. No stakes shall be erected, maintained or worked either in (i.) The Channels of the Harbour of Lagos; or in

(ii.) Any place where water is of greater depth than seven feet; or in

(iii.) Any place where in the opinion of the Harbour Master stakes are likely to impede the navigation of steamships, canoes or other vessels.

6. Rows of stakes shall not be of greater length than 120 yards. 7. The distance between rows of stakes shall be not less than 120 yards, except in a parallel direction across the tide, when the distance may be 40 yards. (Amended.)

8. If owing to the shifting of a channel or deepening of water or for any other reasonable cause the Harbour Master is of the opinion at any time that the removal of any stakes is expedient, he may, by notice in writing, direct the removal thereof within one month from the date of such notice, and the licensee shall remove such stakes accordingly.

9. A licensee shall repair or clean his stakes within one month after receipt of notice in writing signed by the Harbour Master to repair or clean such stakes.

10. Any notice to be served under these Rules shall be served personally, or if the licensee cannot be found, at his last known place of abode upon an inmate thereof, or if an inmate cannot be found, or if such place of abode is unknown, by affixing the notice to the stakes in respect of which the licensee holds a license.
