CHAPTER I.

An Act to regulate the Time and Manner of adminiftering certain Oaths.

E it enacted by the Senate and Reprefentatives of the United States of America in Congress affembled, That the oath or affirmation required by the fixth article of the Conftitution of the United States, fhall be administered in the form following, to wit, "I, A. The Prefident of the Senate for the time being, fhall alfo adminifter the faid oath or affirmation to each Senator who fhall hereafter be elected, previous to his taking his feat: And in any future cafe of a Prefident of the Senate, who fhall not have taken the faid oath or affirmation, the fame fhall be administered to him by any one of the members of the Senate.

Sec. 3. And be it further enacted, That the bers offtate members of the feveral ftate legiflatures, at the legislatures, next feffions of the faid legiflatures refpectively, executive& and all executive and judicial officers of the fejudicial offi veral ftates, who have been heretofore chosen or appointed, or who shall be chosen or appointed before the first day of August next, and who fhall then be in office, fhall, within one month thereafter, take the fame oath or affirmation, except where they fhall have taken it before; which may be administered by any perfon authorised by the law of the state, in which fuch office fhall be holden, to administer oaths. and when. And the members of the feveral ftate legislatures, and all executive and judicial officers of the several states, who fhall be chofen or appointed after the said first day of Auguft, fhall, before they proceed to execute the duties of their respective offices, take the foregoing oath or affirmation, which shall be administered by the perfon or perfons, who by the law of the ftate fhall be authorised to administer the oath of office; and the perfon or persons so adminif tering the oath hereby required to be taken,

fhall caufe a record or certificate thereaf to be made, in the fame manner, as by the law of the ftate, he or they, fhall be directed to record or certify the oath of office.

Sec. 4. And be it further enacted, That all officers appointed, or hereafter to be appointed under the authority of the United States, fhall, before they act in their respective offices, take the fame oath or affirmation, which fhall be administered by the perfon or perfons who fhall be authorised by law to adminifter to fuch officers their refpective oaths of office; and fuch officers fhall incur the fame penalties in cafe of failure, as fhall be impofed by law in case of failure in taking their respective oaths of office.

Sect. 5. And be it further enacted, That the Secretary of the Senate, and the Clerk of the House of Representatives for the time being, clerk of the fhall, at the time of taking the oath or affirmation aforefaid, each take an oath or affirmation in the words following, to wit; "I, A. B. Secretary of the Senate, or Clerk of the House of Reprefentatives (as the cafe may be) of the United States of America, do folemnly swear or affirm, that I will truly and faithfully discharge the duties of my faid office, to the best of my knowledge and abilities.
