XIX. XX. And whereas it is impossible that any Act can be so worded S. 45. Article but that Difficulties may be started by perverse and unreasonable Men, be it enacted by the Authority aforesaid, That if any Doubt shall at any Time hereafter arise concerning the Construction and Execution of this Act in any Particular, the same shall be determined by the Commander in Chief, by and with the Advice and Consent of a Council of War, consisting of Field Officers.

WHEREAS it is of absolute Necessity, in these Times of 1385) and the sthe Danger, to erect, build, make, repair, and finish Breast-works, Feb. 1733, Trenches, Guard-houses, Platforms, and Ambuscade Paths, for the better Preservation and Defence of this Island; and to the End the said Work may speedily and effectually be accomplished:

Be it enacted by his Excellency Christopher Codrington, Esq; Council of Captain General and Commander in Chief, by and with the Advice and and Captains Consent of the Council and Assembly of this Her Majesty's Island of empowered to Antigua, That it shall be in the Power of a Council of Officers (which Fourth of said Council shall consist of the Field Officers of the three Regiments Slaves in repairing of Foot, and Body of Carbineers, with the respective Captains Trenches, &c. belonging to the same; provided always, the said Council consist not of less than the Commander in Chief, or Lieutenant Governor, or President of this Island, for the Time being, four Field Officers, and eight Captains, who shall be called together whenever the said Commander in Chief, Lieutenant Governor, or President, shall think meet and convenient) to direct and order one Quarter of all the Slaves young and old within this Island, and them to be the ablest Workers, for repairing the Trenches and Breast-works already appointed, making new ones, clearing Ambuscade Paths, and making Guard-houses and Platforms belonging to the said Guards, for the better Security of the same.

A. D. 1704. III. And be it further enacted by the Authority aforesaid, That bitants to send the several Captains, within their respective Verges, are hereby Slaves. obliged to issue out their Warrants to the Serjeants of their Comneglecting to panies to summon the Inhabitants to send their Proportion of Slaves, forfeit 58. per and whatever Person shall neglect or refuse daily to comply with the same, pursuant to the said Summons, for each Slave that is absent shall forfeit the Sum of five Shillings per Diem; which said Fine shall be levied by Warrant under the Hand of each Captain within his particular Verge by Distraint or otherwise, directed to the Serjeant, who is hereby impowered and required to execute the said Warrant, under the Penalty of paying the said Fine or Fines himself, or be enforcing Fine confined upon the Fort until he complies with the same; and if any Master (the General's Aids de Camp excepted) shall neglect or refuse cept Aids de appearing with his Slaves at the said Publick Works, for each Day that he is absent, he shall be confined the Space of two Days upon the Fort within this Island, that his said Officer shall think most convenient.

IV. And it is further enacted by the Authority aforesaid, That if any of the above Captains, or other superior Officers, shall neglect or refuse to send their Hands to the said Works, a Warrant shall issue from under the Hand of the Commander in Chief, Lieutenant or Deputy Governor, or President, to levy the Fines and Forfeitures accruing thereby.

V. And whereas it is absolutely necessary to keep standing Guards in the Out Part of this Island, thereby the better to prevent any Depredations or Incursions, which otherwise may be made by the Enemy in the Night Time, which Guards, without being duly and constantly visited every Night, will be but of little Service; be it therefore enacted by the Authority aforesaid, That all the Commission Officers belonging to Horse and Foot, with the Body of Carbineers, are hereby obliged to ride each in their Turn to visit the said Guards, according to such Regulation and Appointment as shall be agreed on Captain em- by the said Council of Officers, or the major Part of them; and it shall likewise be in the Power of each Captain, within his respective Verge, where there are any Persons capable of riding besides Officers, to order and appoint such to perform equal Duty with the Rest, and who on Neg- whoever shall neglect rounding in his Turn, for each Night shall forfeit 24s. to forfeit the Sum of twenty-four Shillings, to be levied by Warrant be levied by from under the Hand of the Captain of the said Verge; if an Officer, Warrant, &c. by Warrant under the Hand of the Colonel, whose Regiment he shall belong to; if a Carbineer, by Warrant under the Hand of the Com

VI. And be it further enacted, That if any of the said Colonels Officer refus or Captains shall refuse or neglect to grant their several Warrants liable to 54. above mentioned, which the said Officers by this Act are obliged to, Penalty. they shall forfeit the Sum of five Pounds Current Money, for every such Neglect, as aforesaid, to be levied upon the said Officer or To be levied Officers, his or their Goods and Chattels, by Warrant from under the by Governor's Hand of the Commander in Chief, Lieutenant, or Deputy Governor, or President of the Island, for the Time being, directed to any Field Marshal or Adjutant, whom the said Commander in Chief, Lieutenant Governor, or President, shall authorize to execute the same. VII. WHEREAS the Seamen belonging to Her Majesty's Ships of War frequently desert the same, by being encouraged by the Masters of Merchant and other Vessels and Sloops, trading in, to, or about this Island, or by the Inhabitants thereof, who clandestinely receive and protect them, whereby it happens that either the Queen's Ships must want their due Complement of Seamen, or, by being supplied from the Merchant Ships, great Injuries may be done to those Masters that are innocent, to the manifest Prejudice of their Owners, and Discouragement of Trade; for the preventing which Mischiefs for the future:

II. Be it enacted by his Excellency Sir William Matthew, Knight, Captain General and Commander in Chief, with the Council and Assembly of this Island, and it is hereby enacted by the Authority of the same, That no Ship or Vessel whatsoever shall sail from any Port, Harbour, or Creek of this Island, but that the Master, Mate, or any other Person thereunto belonging (if thereunto required) shall be obliged to give an Account, upon Oath, to the best of his or their Knowledge, to the Commander in Chief, Lieutenant Governor, or President of this Island, for the Time being, or to the Treasurer of the same, what Seamen, Soldiers, or other Person or Persons of any Kind, Degree, or Quality soever, they have taken on Board their Ship or Vessel, since their last Arrival in any Port, Harbour, or Creek of this Island.
