En foi de quoi, les soussignés ont dressé le présent Protocole, qui aura la même force et durée que la Convention additionnelle à laquelle il se rapporte.

LA Commission Internationale de Navigation Aérienne a, au cours de sa quatrième session réunie à Londres sous la présidence de M. le Général Sir W. Sefton Brancker, assisté de M. Albert Roper, Secrétaire général, approuvé, dans sa séance du 30 juin 1923, conformément aux dispositions de l'Article XXXIV de la Convention (2) portant réglementation de la navigation aérienne, des modifications à certains alinéas de l'Article XXXIV de ladite Convention qui sera rédigé comme suit, en français, en anglais et en italien :

Art. XXXIV. Il sera institué, sous le nom de Commission Internationale de Navigation Aérienne, une Commission (1) "Treaty Series, No. 13 (1925)." (2) CXII, page 931.

internationale permanente placée sous l'autorité de la Société des Nations et composée de :

Deux représentants pour chacun des Etats suivants : Etats-Unis d'Amérique, France, Italie et Japon;

Un représentant pour la Grande-Bretagne et un pour chacun des Dominions britanniques et pour l'Inde; Un représentant pour chacun des autres Etats

contractants.

Chaque Etat représenté à la Commission (la GrandeBretagne avec ses Dominions et l'Inde comptant à cette fin pour un Etat) aura chacun une voix.

La Commission Internationale de Navigation Aérienne déterminera les règles de sa propre procédure et le lieu de son siège permanent, mais elle sera libre de se réunir en tels endroits qu'elle jugera convenables. Sa première réunion aura lieu à Paris. La convocation pour cette réunion sera faite par le Gouvernement français, aussitôt que la majorite des Etats signataires lui auront notifié leur ratification de la présente Convention.

Cette Commission aura les attributions suivantes :

(a.) Recevoir des propositions de tout Etat contractant, ou lui en adresser, à l'effet de modifier ou d'amender les dispositions de la présente Convention; notifier les changements adoptés;

(b.) Exercer les fonctions qui lui sont dévolues par le présent Article et par les Articles IX, XIII, XIV, XV, XVI, XXVII, XXVIII, XXXVI et XXXVII de la présente Convention.

(c.) Apporter tous amendements aux dispositions des Annexes A à G;

(d.) Centraliser et communiquer aux Etats contractants les informations de toute nature concernant la navigation aérienne internationale;

(e.) Centraliser et communiquer aux Etats contractants tous les renseignements d'ordre radiotélégraphique, météorologique et médical intéressant la navigation aérienne;

(f.) Assurer la publication de cartes pour la navigation aérienne, conformément aux dispositions de l'Annexe F;

(g.) Donner des avis sur les questions que les Etats pourront soumettre à son examen.

Toute modification dans les dispositions de l'une quelconque des Annexes pourra être apportée par la Commission Internationale de Navigation Aérienne, lorsque ladite modification aura été approuvée par les trois quarts du total possible des voix qui pourraient être exprimées si tous les Etats étaient présents: cette majorité doit, en outre, comprendre au moins trois des cinq Etats suivants: Etats-Unis d'Amérique, Empire britannique, France, Italie, Japon. Cette modification aura plein effet dès qu'elle aura été

notifiée, par la Commission Internationale de Navigation Aérienne, à tous les Etats contractants.

Toute modification proposée aux Articles de la présente Convention sera discutée par la Commission Internationale de Navigation Aérienne, qu'elle émane de l'un des Etats contractants ou de la Commission elle-même. Aucune modification de cette nature ne pourra être proposée à l'acceptation des Etats contractants, si elle n'a été approuvée par les deux tiers au moins du total possible des voix.

Les modifications apportées aux Articles de la Convention (exception faite des Annexes) doivent, avant de porter effet, être expressément adoptées par les Etats contractants.

Les frais d'organisation et de fonctionnement de la Commission Internationale de Navigation Aérienne seront supportés par les Etats contractants; le total en sera réparti à raison de deux parts pour les Etats-Unis d'Amérique, l'Empire britannique, la France, l'Italie et le Japon et d'une part pour chacun des autres Etats.

Les frais occasionnés par l'envoi de délégations techniques seront supportés par leurs Etats respectifs.

Art. XXXIV. There shall be instituted, under the name of the International Commission for Air Navigation, a permanent Commission, placed under the direction of the League of Nations, and composed of

Two representatives of each of the following States: the United States of America, France, Italy and Japan.

One representative of Great Britain and one of each of the British Dominions and of India.

One representative of each of the other Contracting States.

Each State represented on the Commission (Great Britain, the British Dominions and India counting for this purpose as one State) shall have one vote.

The International Commission for Air Navigation shall determine the rules of its own procedure and the place of its permanent seat, but it shall be free to meet in such places as it may deem convenient. Its first meeting shall take place at Paris. This meeting shall be convened by the French Government, as soon as a majority of the signatory States shall have notified to it their ratification of the present Convention.

The duties of this Commission shall be

(a.) To receive proposals from or to make proposals to any of the Contracting States for the modification or amendment of the provisions of the present Convention, and to notify changes adopted.

(b.) To carry out the duties imposed upon it by the present Article and by Articles IX, XIII, XIV, XV, XVI,

XXVII, XXVIII, XXXVI and XXXVII of the present Convention.

(c.) To amend the provisions of the Annexes A-G.

(d.) To collect and communicate to the Contracting States information of every kind concerning international air navigation.

(e.) To collect and communicate to the Contracting States all information relating to wireless telegraphy, meteorology and medical science which may be of interest to air navigation.

(f.) To ensure the publication of maps for air navigation in accordance with the provisions of Annex F.

(9.) To give its opinions on questions which the States may submit for examination.

Any modification of the provisions of any one of the Annexes may be made by the International Commission for Air Navigation when such modification shall have been approved by three-fourths of the total possible votes which could be cast if all the States were represented: this majority must, moreover, include at least three of the five following States: the United States of America, the British Empire, France, Italy, Japan. Such modification shall become effective from the time when it shall have been notified by the International Commission for Air Navigation to all the Contracting States.

Any proposed modification of the Articles of the present Convention shall be examined by the International Commission for Air Navigation, whether it originates with one of the Contracting States or with the Commission itself. No such modification shall be proposed for adoption by the Contracting States unless it shall have been approved by at least two-thirds of the total possible votes.

All such modifications of the Articles of the Convention (but not of the provisions of the Annexes) must be formally adopted by the Contracting States before they become effective.

The expenses of organisation and operation of the International Commission for Air Navigation shall be borne by the Contracting States: the total shall be allocated in the proportion of two shares each for the United States of America, the British Empire, France, Italy and Japan and one share each for all the other States.

The expenses occasioned by the sending of technical delegations will be borne by their respective States.

Art. XXXIV. Sarà istituita, col nome di Commissione Internazionale di Navigazione Aerea," sotto l'autorità della Società delle Nazioni, una Commissione internazionale permanente così composta:

Due rappresentanti per ciascuno dei seguenti Stati: Stati Uniti d'America, Francia, Giappone e Italia;

Un rappresentante della Gran Bretagna e uno per ciascuno dei Domini britannici e per l'India;

Un rappresentante per ciascuno degli altri Stati contraenti. Ogni Stato rappresentato alla Commissione (la Gran Bretagna coi suoi Domini e l'India contando a questo fine por un solo Stato) avrà un voto.

La Commissione Internazionale di Navigazione Aerea stabilirà la propria procedura e la propria sede permanente, ma sarà libera di riunirsi dovunque lo riterrà opportuno. La sua prima riunione avverrà à Parigi. La convocazione ne sarà fata dal Governo francese, appena la maggioranza degli Stati firmatari gli avrà notificato la ratifica della presente Convenzione.

Alla Commissione Internazionale di Navigazione Aerea competerà :

(a.) Ricevere da ciascuno degli Stati contraenti o far loro le proposte di modificazioni o di emendamenti alle disposizioni della presente Convenzione, e notificare le variazioni adottate;

(b.) Esercitare le funzioni che le sono attribuite dal presente Articolo et dagli Articoli IX, XIII, XIV, XV, XVI, XXVII, XXVIII, XXXVI, e XXXVII della presente

Convenzione;

(c.) Emendare le disposizioni degli allegati A-G;

(d.) Raccogliere e comunicare agli Stati contraenti le informazioni di ogni genere concernenti la navigazione aerea internazionale;

(e.) Raccogliere e comunicare agli Stati contraenti tutte le notizie relative alla radiotelegrafia, meteorologia e scienze mediche, interessanti la navigazione aerea;

(f.) Assicurare la pubblicazione delle carte per la navigazione aerea, a norma delle disposizioni dell'allegato F;

(g.) Dar parere sulle questioni che gli Stati sottoporranno al suo esame.

Le modificazioni degli allegati potranno essere adottate dalla Commissione Internazionale di Navigazione Aerea soltanto se saranno approvate dai tre quarti del totale assoluto dei voti, cioè del totale dei voti che potrebbero essere raccolti, se tutti i rappresentanti degli Stati fossero presenti: questa maggioranza deve inoltre comprendere almeno il voto di tre dei cinque Stati seguenti: Stati Uniti d'America, Impero Britannico, Francia, Italia, Giappone. Le modificazioni avranno vigore dal giorno in cui saranno state notificate dalla Commissione a tutti gli Stati contraenti.

Le modificazioni proposte agli Articoli della Convenzione saranno esamite dalla Commissione Internazionale di Navigazione Aerea, sia che provengano da uno degli Stati contraenti, sia dalla Commissione medesima. Tali proposte
