Par application de l'alinéa 2 de l'article 1" du présent Protocole, le Gouvernement de Sa Majesté le Roi d'Espagn› se réserve la liberté de restreindre l'engagement prévu audit article aux contrats qui seraient considérés comme commerciaux par son droit national.

En vertu de l'article 8 du Protocole, le Gouvernement de Sa Majesté le Roi d'Espagne déclare que son acceptation du présent Protocole ne s'étend pas aux possessions espagnoles en Afrique ni aux territoires du Protectorat espagnol au Maroc.

En outre, il déclare son point de vue "que la reconnaissance, en principe, de la validité des clauses d'arbitrage ne porte nullement atteinte aux dispositions restrictives qui se trouvent actuellement dans les législations de ces territoires, ni au droit d'y introduire d'autres restrictions à l'avenir."

DECLARATION by Great Britain, France, Italy and Japan regarding the Integrity of the Frontiers of Albania.Paris, November 9, 1921.

L'EMPIRE britannique, la Franco, l'Italie et le Japon, reconnaissant que l'indépendance de l'Albanie, ainsi que l'intégrité et l'inaliénabilité de ses frontières, telles qu'elles ont été fixées par leur décision en date du 9 novembre 1921, est une question d'importance internationale;

Reconnaissant que la violation des dites frontières, ou de l'indépendance de l'Albanie, pourrait constituer une menace pour la sécurité stratégique de l'Italie,

Sont convenus de ce qui suit:

1. Au cas où l'Albanie se trouverait dans l'impossibilité de maintenir son intégrité territoriale, elle aura la liberté d'adresser au Conseil de la Société des Nations une demande d'assistance étrangère.

2. Les Gouvernements de l'Empire britannique, de la France, de l'Italie et du Japon, décident, dans le cas susdit, de donner pour instruction à leurs représentants dans le Conseil de la Société des Nations de recommander que la restauration des frontières territoriales de l'Albanie soit confiée à l'Italie.

3. En cas de menace contre l'intégrité ou l'indépendance aussi bien territoriale qu'économique de l'Albanie, du fait d'une agression étrangère ou de tout autre événement, et au cas où l'Albanie n'aurait pas recours dans un délai raisonnable à la faculté prévue à l'Article 1", les Gouvernements susdits feront connaître la situation qui en résultera au Conseil de la Société des Nations.

Au cas où une intervention serait jugée nécessaire par le Conseil, les Gouvernements susdits donneront à leurs représentants les instructions prévues à l'Article 2.

4. Au cas où le Conseil de la Société des Nations déciderait, à la majorité, qu'une intervention de sa part n'est pas utile, les Gouvernements susdits examineront la question à

nouveau, s'inspirant du principe contenu dans le préambule de cette Déclaration, à savoir que toutes modifications des frontières de l'Albanie constituent un danger pour la sécurité stratégique de l'Italie.

Desiring to contribute to the maintenance of the general peace, and to reduce the burdens of competition in armament;
