On the ground, however, that it is immaterial for the purposes of this section whether the word is newly invented or fancifully applied so long as such application creates a distinction, it has been held that the word 'Alpine,' as applied to woollen and cotton goods (In re Trade Mark Alpine,' Chitty, J., 1885, W. N. 120; L. J. N. of C. 106; Solicitor's Journal, vol. 29, p. 500) and the word 'Lawford,' the name of a celebrated lawn-tennis player, as applied to tennis bats (Slazenger v.
