The cases of the Argonaut and the Col. Jonas H. French grow out of substantially the same set of facts, and for this reason they are embodied in one memorial, in accordance with Rule 14 of the Rules of Procedure. 1 The schooners Argonaut and Col. Jonas H. French were fishing vessels registered according to the laws of the United States at the port of Gloucester in the State of Massachusetts. Both vessels at the time the claims arose were owned by American citizens; the Argonaut by the firm of James G. Tarr and Brother, consisting of James G. and David Tarr, and the Col. Jonas H. French by John Chisholm, all of whom resided at Gloucester in the State of Massachusetts. 3 In the month of July, 1887, the two vessels sailed from Gloucester for the Gulf of St. Lawrence, being fully equipped for fishing for mackerel. The Argonaut was in command of Benjamin F. Sprague and the Col. Jonas H. French was in charge of William F. Harris as master.5 On the 24th of July, 1887, the vessels were off East Point and Souris, Prince Edward Island, between four and five miles from land, and in the vicinity of some fifty other American fishing vessels."
