through the Minister of Finance, the Bonds so liquidated, the sales effected, and the Certificates cancelled in consequence: a similar Account shall be rendered to the Board of Control.

XXIV. With respect to the Crown Estates, which, although mortgaged for the payment of the Debt, by the Royal Decree of the 30th of August, 1800, and by other Royal Decrees anterior to the same, have not been so applied; it is my Royal Will, that the means considered as best calculated for immediately effecting the sale be submitted to me, and that my Subjects may have a fresh proof of those beneficent intentions with which I am animated in their behalf.

XXV. I absolutely prohibit every other application of the resources and property aforesaid, than that which I have appointed by this Decree; and it is my Royal Will, that the Board of Public Credit shall inform me of every attempt to contravene this my Sovereign determination.

You will understand this aright, and make the necessary dispositions for its due accomplishment.

CONVENTION between Austria and Rome, relative to the passage of Austrian Troops through the Papal TerritorySigned at Rome, the 14th of August, 1815.

(Translation.)

Convention between the Plenipotentiaries of His Holiness and of His Imperial and Royal Apostolic Majesty.

WHEREAS it is stipulated in the 2nd Article of the Convention of the 12th June, 1815, concluded at Vienna between His Holiness and His Majesty the Emperor of Austria, as follows:-" His Holiness shall grant a passage to the Austrian Troops forming part of the Army of Naples, so long as that Army shall occupy that Kingdom. There shall, therefore, be established for that object one or more Mili tary Roads (Routes d'étapes) between the Kingdom of Naples and the Po, in a manner the least onerous for the said States. These Roads shall be fixed by a Special Convention, as well as the indemnity to be agreed upon for the supplies which the Government of His Holiness shall furnish to the same Troops. The same Convention shall also regulate all the details relating to these objects, and to those appertaining to all the branches of the Military Department."

The High Contracting Parties, in order to carry into effect the before-recited Article, have named as their Plenipotentiaries, that is

to say:

His Holiness, the Signor Cardinal Ercole Consalvi, Secretary of State, and Monsignor Luigi Ercolani, Treasurer-General.

His Imperial and Royal Apostolic Majesty, the Chevalier Ludovico de Lebzeltern, Knight of several Orders, His Aulic Counsellor, and His Envoy Extraordinary and Minister Plenipotentiary at the Court of Rome; and the Baron Köller, Knight Grand Cross of several Orders, Lieutenant Field-Marshal, and Intendant of the Austrian Army of Italy;

Who, after having exchanged their Full Powers, have agreed upon the following Articles:

Military Road.

ART. I. A Military Road (route d'étape) shall be established in the States of His Holiness, for the passage of the Troops belonging to the Austrian Army of Naples.

II. This Road shall traverse the States of His Holiness through Terracina, Rome, Viterbo, and Acquapendente, and, issuing from Tuscany by the part of Lojano, through Bologna for the Troops which shall proceed to Modena, and through Bologna and Ferrara for the Troops which shall proceed to Padua.

III. The following shall be the Stations or Depôts: Terracina, Tortreponti, Velletri, Rome, Monterosi, Viterbo, Montefiascone, and Acquapendente, and, issuing from Tuscany by the part of Lojano, Bologna, for the Troops which shall proceed to Modena, and Bologna, Malalbergo, and Ferrara, for the Troops which shall proceed to Padua.

IV. The Troops shall have 3 days for repose ;-one at Velletri, another at Rome, and the 3rd at Viterbo.

V. At every Station or Depôt, there shall be a Local Commandant of His Holiness, who shall, if possible, be chosen from among those Officers who understand the Italian and German languages.

VI. There shall be 3 Austrian Officers as Commandants of Transports for the part which appertains to them, one at Terracina, another at Rome, and the Srd at Acquapendente, who, in concert with the Local Commandants of His Holiness, shall see that order, discipline, and subordination are maintained among the Troops during their march. The Local Command at the before-mentioned Stations, shall, however, be always vested in the Papal Officers. In case of a large body of Troops, an Austrian Officer shall be stationed in every Place where there is a Depôt, for the maintenance of order among the Troops. In the 2 Places where they will halt for a day, besides Rome, that is, at Velletri and at Viterbo, there shall be constantly stationed 2 Austrian Officers, as Commandants of Transports, for the object above named.

System of furnishing Provisions and Forage.

VII. The Austrian Officer in command of the body of Troops which are to march through, shall send, 24 hours in advance, a Quarter

Master to the Papal Commandant at every Depôt, in order that he may have the number of rations of provisions and of forage, and the means of transport corresponding to the body of Troops under his command.

VIII. This Commanding Officer shall address, through the Quarter-Master, to the Papal Commandant of the Place, a Demand, in which he shall state the rations of provisions, and of forage, and the means of transport required for his Troops. This Demand shall be attached to the Assignment of the Austrian Commissariat, which Assignment shall correspond in number and quantity with the Return in which the Papal Commandant of the last Depôt has stated the number of the rations of provisions and of forage, and the means of transport which he has furnished. The Officer shall be bound to present this Return to the Papal Commandant of the Place, who shall not give orders for furnishing the supplies unless he receives it.

IX. The Forms of such Demands shall be ready in every Place where there is a Depôt, printed in the 2 languages, and the Austrian Officer in command of the body of Troops shall only fill up the blanks.

X. Upon receipt of this Demand, the Papal Commandant of the Place shall give orders to the Person in charge of the Stores, to furnish the required number of rations of provisions and of forage, and to the Person charged with the transports, the required number of waggons. The Forms of these Orders shall be printed in like manner, and the Papal Commandant of every Place, and the Austrian Commandant of the Transports where such Officer is appointed, shall have Copies of them in readiness.

XI. After this Order shall have been presented by the Quarter-Master, the Person in charge of the Depôt of Stores, and the Person entrusted with the Transport Department, shall prepare the corresponding number of rations of provisions, and of forage, and the means of transport expressed in the Order. The articles demanded shall not be made over until the arrival of the Troops and of the Commandant-in-Chief; and the latter, as soon as these articles are received, shall transmit to the Person in charge of the Depôt of Stores, and to the Person entrusted with the Transport Department, a Receipt for the articles cou. signed, certified by the same Commandant-in-Chief.

XII. As the Quarter-Master, who is to be 24 hours in advance of the body of Troops, will be accompanied by some of the Soldiers, ra tions shall be provided for them, and the Quarter-Master shall deliver to the Chief of the Depôt of Stores a provisional Receipt for the same; which Receipt, on the arrival of the body of Troops, shall be given, instead of so many rations, to the Officer, who will receive the rations for the whole party, and shall be included in the General Receipt given by the Commandant of the Troops.

XIII. The forms of these Receipts or Acknowledgments, printed in

the two languages, shall be provided at each Station or Depôt of Stores, and the Austrian Officer in command of the Troops which arrive there shall merely fill up the blanks.

XIV. The Chief of the Depôt of Stores, and the Person charged with the Transport Department, shall deliver, vice versa, to the Austrian Officer, the Counter-Acknowledgments for the articles furnished by them.

XV. The Forms of these Counter-Acknowledgments, printed in the two languages, shall in like manner be obtained at each Station or Depôt.

XVI. The models of such Demands, Orders, Acknowledgments, and Counter-Acknowledgments, and Returns, shall be annexed to the present Convention, and be numbered 1, 2, 3, 4, 5, 6, 7, 8, and 9.

Provisions and Forage for the Troops, and Compensation for the Officers.

XVII. The ration of provisions for each Soldier shall consist of the articles mentioned in the Tariff annexed to the present Convention, and numbered 10, and shall correspond with the weights and measures expressed therein.

XVIII. The Treasury of His Imperial and Royal Majesty shall pay to the Treasury of His Holiness, the indemnity agreed upon in the Act annexed to the present Convention, for the ration of each Soldier.

XIX. The ration of forage for the Horses shall consist of the articles mentioned in the Tariff, annexed as above to No. 8, and shall correspond with the weights and measures expressed therein.

In case it should be required to provide increased rations of forage, such increase shall consist only of one-half more of oats.

XX. The Treasury of His Imperial and Royal Majesty shall pay to the Treasury of His Holiness, the indemnity agreed upon in the Act annexed to the present Convention, for every ration of forage, and for the increased ration.

XXI. A Copy, printed in the Italian and German languages, of the Tariff of the rations of provisions and forage, with the respective weights and measures, shall always be affixed on the doors of the Magazines of Stores, and of the Dwelling-house of the Papal Com mandant of the Place, as also of the Austrian Commandant of the Transports, wherever such an Officer is appointed.

XXII. The detached Soldiers shall not receive rations of provisions and of forage, without presenting the proper Billet in regular order, as in the annexed Form numbered 9. Any Soldier not having such Billet shall be arrested forthwith, and given into the custody of the nearest Austrian Commander.

XXIII. The Austrian Officer who may be in command of à

Body of Troops ou their march, shall be bound to notify in writing to the Local Commandant of His Holiness, the number of the Soldiers of his party who have remained behind, and who will follow him on the subsequent days.

XXIV. The Papal Commandant of the Place shall cause these detached Soldiers when they arrive, to be provided with their respective rations; he shall make out for the Chief of the Magazine of Stores the Provisional Receipts or Acknowledgments for them, and shall address them, together with the Counter-Acknowledgments, to the nearest Austrian Commandant of the Transports, who shall make out the definitive Receipts or Acknowledgments for the rations furnished to these detached Soldiers, and shall exchange them for those made out by the Local Commandant of His Holiness.

XXV. The General Returns of the body of Troops shall be rectified at Rome, by the Austrian Commandant resident in that City, deducting from them the number of those who have died, deserted, and fallen sick on the march.

For the grand march of the Army, an Austrian Commissary of War shall be charged with this rectification.

XXVI. In case an Officer should refuse to deliver an Acknowledg. ment or Receipt, or should demand more than the Tariff, the Local Commandant of His Holiness shall make a detailed report of the circumstance, to the Austrian Commandant nearest to the Place to which the said Officer has been directed, expressing the name of the Officer, the Regiment to which he belongs, and the particulars of the abuse complained of, accompanying his Statement with a Certificate from the Magistrate of the Place. Upon this Report and Certificate, the Austrian Commandant shall remit to the Local Commandant of His Holiness the Receipt in proper order, or shall correct the abuse which has been committed.

XXVII. The Subaltern Officers, the Captains, and the Superior Officers, shall receive the indemnities for supplies of Stores agreed upon in the Act annexed to the present Convention, according to their rank, and in conformity with the Decision of His Imperial and Royal Apostolic Majesty, of the month of January, 1815. They shall have no right to receive any other supply of provisions, except the rations of bread and forage suitable to their rank.

Military Transports.

XXVIII. The providing of Military Transports shall be effected, in the same way and under the same regulations as are expressed in Articles VII, VIII, IX, X, XI, XII, XIII, and XIV of this Convention.

XXIX. No means of transporting Troops shall be demanded, without a special authority from the General Commanding in Chief of the
